S-527 - 05/08/1984 - SPECIAL USE - Ordinances ORDINANCE NO. S- 527 AN ORDINANCE AMENDING AN ORDINANCE GRANTING A SPECIAL USE PERMIT PURSUANT TO THE PROVISIONS OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK, ORDINANCE ISO. G-60, AS EMENDED (Oak Brook Christian Center) WHEREAS, on April 23, 1974 the corporate authorities of the Village of Oak Brook passed Ordinance No. S-301 which granted a special use permit for the construction and operation of a "church and school of Oak Brook Centre Church" at what is now known as Lot 1 of the Oak Brook Christian Church Subdivision, commonly known as 3100 Midwest Road, subject to approval of final site and construction plans by the appropriate Village Boards and Commissions; and WHEREAS , on October 26, 1976, the corporate authorities upon the recommendation of the Plan Commission, approved the final site plan subject to certain conditions including the following: 1. The existing frame building on the property (at the Northeast corner of the property at 31st Street and Midwest Road) be razed not later than 24 months from the issuance of an Occupancy Permit for Phase 1, and 2. The site plan contain a note prohibiting overnight parking of buses; and WHEREAS, a No-Fault Certificate (Early Occupancy Permit) was issued to the Church on June 2, 1978; and WHEREAS, in its application dated November 11, 1983, the Oak Brook Christian Center Church requested that the Village rescind the foregoing two conditions and further that the Village rezone the subject property to the Institutional District; and WHEREAS, the Plan Commission at its March 19, 1984 meeting and the Zoning Board Board of Appeals at its April 3, 1984 meeting, both recommended that the Village Board grant a two year extension for razing the existing frame building and further, that the Village Board deny both the request for rezoning and the request for permission to park buses on the subject property overnight; and WHEREAS, on April 24, 1984 the corporate authorities voted to deny the requested rezoning and adopted by reference the Zoning Board's findings set forth in the Zoning Board's April 3, 1984 Minutes; and WHEREAS, the applicant has had an opportunity to present additional testimony before the corporate authorities. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section l: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That Sections l and 2 of Ordinance No. S-301 are amended to read as follows: Section 1: That a special use permit be and hereby is granted for the construction and operation of a "church and school of Oak Brook Centre Church" essentially as shown on the site plan marked Exhibit A, and subject however, to the conditions 1) that the existing house on the subject property (at the Northeast corner of the subject property at 31st Street and Midwest Road) be razed not later than June 1, 1986, 2) that the applicant comply with all other conditions imposed at the time the site plan was approved on October 26, 1976, including, but not limited to the provisions against parking buses on the subject property overnight, and 3) that the applicant install a culvert under the driveway onto Midwest Road, or present another alternative acceptable to the Villae by its engineer, on or before October 1, 1984, in accordance with the permit granted June 8, 1977. Ordinance No. 5-527 Page 2 Ordinance Granting Special Use Permit - Oak Brook Christian Center Section 2: That the real estate effected hereby is legally described as: Lot One of Oak Brook Christian Center Subdivision, a Subdivision of part of the Northwest Quarter of Section 34, Township 39 North, Range 11 East of the Third Principal Meridian , in the Village of Oak Brook, DuPage County, Illinois, according to the Plat thereof recorded on February 25, 1977 as Document No. R77-13099. Section 3: That all other provisions of Ordinance No. 5-301 shall remain in full force and effect. Section 4: That this Ordinance shall be in full force and effect from and after its passage and approval all as provided by law. Passed this 8th day of May , 1984.
