S-540 - 07/24/1984 - ZONING - Ordinances ORDINANCE NO. 5-540 AN ORDINANCE REZONING A CERTAIN PARCEL FROM THE R-3 TO THE ORA-2 ZONING DISTRICT (East Parcel - 1909 Spring Road) WHEREAS, on March 30, 1984, the Oak Brook Hotel Company, a limited partnership, filed an application with the Village Clerk of the Village of Oak Brook requesting that a certain part of a parcel legally described in Exhibit A, a copy of which is attached hereto and made a part hereof, be rezoned from the R-3 Zoning District to the ORA-2 Zoning District; t.nd WHEREAS, on April 10, 1984 the corporate authorities referred the application to the Plan Commission and the Zoning Board of Appeals for public hearings; and WHEREAS, at its meeting on May 21 , 1984, the Plan Commission recommended to the Village Board that the subject property be rezoned as requested by the Applicant; and WHEREAS, a motion recommending that the Village Board grant the requested rezoning failed to receive a majority vote of the members of the Zoning Board of Appeals when that body met pursuant to notice on June 5, 1984; and WHEREAS, the President and Board of Trustees deem it in the best interest of the Village of Oak Brook that the subject property be rezoned to the ORA-2 Zoning District and hereby adopt the findings of fact (reasons) set forth in the Applicant's attorney's letter dated May 31 , 1984; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1 : That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That the following described parcel be and is hereby rezoned as follows: That part of the following described parcel commonly known as 1909 Spring Road, and legally described in Exhibit A which is attached hereto and incorporated herein as though fully set forth which is not now zoned ORA-2 Office Research Assembly District, is hereby rezoned from the R-3 Single Family Detached Residence District to the ORA-2 Office Research Assembly District. Section 3: That the Village Clerk is hereby directed to amend the "Official Map of Zoning Districts of the Village of Oak Brook" in accordance with the provisions of Section 2 of this Ordinance. Section 4: All ordinances, rules, and regulations of the Village of Oak Brook which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of the conflict and only as they apply to the specific properties hereinbefore described. The present- Landscaping Plan appears to provide a fairly dense planting of evergreen_ trees adjacent to the northeasterly parking area which should provide a substantial screen to the residential units across Salt Creek. The present plan provides more substantial screening than the previous plan dated May 10, 1984 and received June 13, 1984. 2. The Section Elevation sheet is not drawn to scale. Specifically, the 2.5:1 slope on the Hyatt side of Salt Creek does not extend the entire distance from the parking lot to the channel. Please note that IDOT's plans for the Salt Creek improvement does provide for 2.5:1 slope immediately adjacent to the channel, but that steep slope flattens out as it proceeds toward the Hyatt House parking area. SUBJECT: Hyatt House - Special Use Flood Plain I have reviewed drawings Al, A2, A3, Cl, and C2, all dated 7/02/84 and all received 7/02/84, and offer the following comments: 1. Sheets Cl and C2 are similar to sheets Cl and C2 which were dated revised 4/05/84 and received on 4/10/84. 2. The plan presently proposes to remove approximately forty (40') feet of the existing parking area near Salt Creek at the far northeast portion of the property. As you recall, the initial submittal removed approximately seventy (70') feet. 3. This plan contemplates a two and one-half (21�") inch asphalt overlay over the existing parking area which should not measurably effect the Salt Creek Flood Plain or high water elevations. 4. Surface parking directly under the parking structure will be inundated with flood waters from depths ranging between zero (0') feet at the far northwest corner to two (2') feet along the northeasterly edge of the parking structure. Additionally, this plan proposes a flood depth of approximately 0.8 feet along the southwesterly wall adjacent to the banquette facilities; the previous plan had zero (0') feet along this wall. 5. This plan shows a new retaining wall around an existing lower level opening which is southeasterly of the truck dock area. The previous plans did not incorporate this retaining wall. 6. A note within the plan sheet needs to be revised from nine (9") inches of compacted stone to fourteen (14") inches of compacted stone. 7. The calculations on Sheet C2 state 0.23 acre feet of excess compensatory storage provided with this plan. 8. Should a special use in the flood plain be granted, it should be conditioned upon the applicant applying for and receiving a permit from the State of Illinois concerning same. The- Brickman plan is significantly different than the Lindley plan, dated 10/28/83. As you know, the Lindley plan was submitted last October and was presented to various Village Boards as evidence to show that the Hyatt House will provide significant screening of its proposed improvements from the residences across the creek. The present Brickman plan does not provide the level of screening as contemplated within the previous Lindley plan. 2. I note that the Brickman plan contains many proposed large shade trees. Please note that shade trees do not provide any screening within the winter months. 3. Since screening of the hotel improvements was an important aspect of the overall plan, and since the Brickman plan does not contain the amount of screening as originally contemplated within the Lindley plan, I suggest that you revise the Brickman plan to provide for additional screening. I understand that a covenant is being generated to insure that the Hyatt House properly installs and maintains the necessary screening along Salt Creek. As noted on the attached Zoning Map, the Hyatt Hotel is presently located on a parcel of property comprised of the blue and orange areas noted on the map. The orange portion of their property has always contained some type of residential zoning classification, although it appears in reviewing older maps that the orange and blue areas were always part of the same lot. I have attached, for your review, copies of the 1959 and 1966 Zoning Maps which note that the current dividing line between ORA-1 and ORA-2, running between 22nd Street and Harger Road, has always existed. This zoning boundary line does follow a lot line between Harger Road and Commerce Drive, and when that line reaches Harger Road, it is, in some manner, arbitrarily, drawn across Hyatt's property apparently following no previous lot line. He noted that this property has never been built on by the Hyatt and would, most likely, never be built, since it is covered almost entirely by Salt Creek Floodway and is also governed by overlapping 100-foot rear, 150-foot side and 50-foot front yards. He noted that the Village Board, at their meeting of March 27, 1984, directed "the applicant to file a plat consolidating the subject property with the abutting 9-acres to the North providing a Conservation/Recreation easement on sane and, further, that the applicant file the necessary documents relative to rezoning the north 9-acre parcel plus the easterly portion of the subject property from R-3 to ORA-2 and provide for the maintenance of landscaping". He noted that the Conservation Easement is presently being reviewed by the Village, and that the Landscape Maintenance Easement will be forwarded presently. In response to Chairman Reece, Mr. Gooder stated that the easterly piece of property along Harger Road was always assumed to be under the ORA-2 Zoning District, since the existing line between ORA-2 and R-3 does not follow, and apparently never did follow, a lot line. Furthermore, Village Staff has been unable to determine the exact location of the zoning boundary line. Ir. response to Chairman Reece, Village Engineer Dale Durfey stated that the Plat is ready for action by the Plan Commission, except for a few minor drafting items, following a decision by the Plan Commission on the following two policy issues: 1) Bicycle paths, both along Spring Road and adjacent to the easterly lot line of the parcel adjacent to Harger Road. 2) Requirement to provide a rear yard Public Utility Easement within Salt Creek. Mr. Gooder stated that the Village's most recent Bike Plan called for use of the Steeplechase bridge as an access point between Timber Trails and the rest of the Village. He noted that, at the Timber Trails residents' request the Village abandoned the idea to use such a bridge, for subdivision security reasons. He noted that there are then two alternative routes which could be utilized to provide access to Timber Trails, these being either to the West along the Frontage Road and South along Spring Road down to 16th Street, or in the alternative, to the East along a Frontage Road around and past Yorkshire Woods onto Harger Road. He noted that there are certain problems associated with construction of a path in the first alternative due to a steep slope along some points adjacent to Salt Creek and that portions of the path would pass through Oakbrook Terrace. Member Marcy stated that an advantage to the westerly route as being more direct to the central part of the Village. With respect to the requested bike easement along the easterly lot line between Salt Creek and Harger Road, Mr. Gooder stated that that easterly parcel will be restricted from having any construction and, therefore, the applicant is willing to grant the requested bike easement. Specifically, the Village Board approved the concept of the combination of the existing hotel parcel with the + nine acres to the North of it into one lot of record. Concurrently with that, the Village Board would propose to rezone this new lot to ORA-2. The small portion of the existing hotel lot to the southeast would remain under its current zoning as R-3, although as part of the single lot thus created. Concurrently the Village Board expressed the desire to receive from the record owners a conservation easement on the 9-acre undeveloped parcel in recognition of the mutual desire to maintain that property in its present undeveloped state. In order to facilitate these matters, it would be necessary that Hyatt file an appropriate application for approval of a subdivision in conformance with the consensus noted above. We, of course, would be most anxious to work with you to finalize any documents or other procedural concerns as soon as possible so that the subdivision matter can be forwarded to the Plan Commission for its consideration as expeditiously as possible. In this regard, I would appreciate it if you would work closely, with myself and Bruce Kapff to accommodate this goal. Specifically, as part of the subdivision process and the various relief considered, we would likewise appreciate your thoughts concerning the best method to incorporate the concept of permanent landscaping and perpetual maintenance as necessary to receive maximumscreening of the Hotel facility from the residential neighbors to the East, North and South of the subject property across Salt Creek. SUBJECT: Hyatt House - Special Use Floodplain I have reviewed the latest revised submitted drawings, noted as Alternate IV on Sheet C3 and Alternate III on Sheet C3-A and offer the following comments: 1. The lower level of the parking structure is set at elevation 661 which is equal to the anticipated high water level of Salt Creek under existing conditions. 2. The fill on the northeast side of the proposed parking structure has depicted on previous plans) has now been removed thereby eliminating the previous encroachment into the floodway. Additionally, areas immediately adjacent to and westerly of Salt Creek are being excavated, northeasterly of the parking structure, which will provide for additional floodway capacity which should benefit the residential structures on the opposite side of the stream. 3. Even though the proposed parking area northeast of the proposed parking structure has been lowered from previous plans , the latest plan has left the flood water capacities the same, approximately 1.248 acre feet of compensatory storage being required on the northerly parcel . In discussing this with the applicant's engineer, we concluded that this drawing will now require less compensatory storage on the northerly parcel and that its exact determination will be postponed until the time of building permit review. For purposes of the special use, the numbers as presently depicted on these plan sheets can be utilized. 4. Regarding the fence issue as stated within my memo to you of September 8, 1983, I have not received any information. 5. Should a special use in the floodplain be granted, it should be conditioned upon applicant applying and receiving a permit from the State of Illinois concerning same. the northeast boundary of the developed property to screen the hotel and its appurtenant structures from the residences on the opposite side of the creek. Member O'Brien again stated that he had a potential conflict of interest with this applicant and would, therefore, not participate in the proceedings of this issue. Don West, managing partner of the Oak Brook Hotel Company, presented a brief summary of these requested applications and further explained his proposed expansion. Alternate I would place parking on the northerly parcel, while Alternate II would leave the northerly parcel in its present state and construct a parking structure adjacent to the hotel and install fencing and screening also within the hotel area. Mr. West stated that he had met with many of the neighbors within Timber Trails regarding his proposed construction activity. Mr. West also stated that he would give complete access to the Illinois Department of Transportation for their Salt Creek construction project. Mr. Bill Lindley, Lindley & Sons, briefly described the engineering aspects of Alternate II. He stated that the lowest level of the parking structure would be approximately equal to the Salt Creek 100-year high water level and that any filling on the site would be compensated for to the East of the parking structure and along the westerly bank of Salt Creek, leaving the northerly parcel untouched. Mr. Lindley stated also that approximately 10 percent of the existing parking lot paving would be removed and that detention would be provided within the parking area East of the proposed parking structure. Mr. West asked the Plan Commission to consider a recommendation reducing the size of parking stalls and increasing the percentage of compact car spaces, even though this particular issue is not presently before the Plan Commission. In response to a question from Acting Chairman Beard, Mr. West stated that the height of the parking structure would be either four or five levels of parking, approximately equal to the first level of rooms. Mr. West stated that approximately 50 feet of existing parking lot paving is scheduled for removal adjacent to the westerly bank of Salt Creek under Alternate II. In response to Acting Chairman Beard's comment regarding past landscaping letters, Mr. West stated that they will provide new landscaping plans which will comply with the wishes of the Village. Kapff, Assistant to Village Manager SUBJECT: Hyatt Applications The Plan Commission, at their meeting of June 20, 1983, tabled further consideration of these applications until their July regular meeting. In the past, it has been our procedure to delay the Zoning Board's hearing of an application until such time as the Plan Commission has finished their proceedings and has made final recommendations on the particular application. Also, the pro- cedures as listed under Section XIII(I) of the Zoning Ordinance state that "The Plan Commission shall submit an opinion report relative to such proposed amend- ment to the Zoning Board of Appeals and Board of Trustees" which implies that the Zoning Board of Appeals should have in their possession the Plan Commission's recommendation prior to hearing the particular application. In addition, it should be noted that a large number of- residents were in attendance at the June Plan Commission relative to the Hyatt's applications and are under the impression that the Village's next consideration will be at the July Plan Commission meeting. Kapff Assistant to Village Manager BFK/j r 1 I � • PLAN COMMISSION Minutes 7- June 20, 1983 IV HYATT - REZONE FROM R-3 TO ORA-2 AND TEXT AMENDMENT RE: FAR Mr. Don West, managing partner of the Oak Brook Hotel Company, operating group of the Hyatt Hotel, was present representing this application. Mr. West stated that the proposal is to rezone a 9-acre parcel presently owned by the Oak Brook Hotel Company from R-3 to ORA-2 in order to benefit from that area's Floor Area Ratio. Their proposal is to add certain additions to their existing hotel and provide for no construction on this northerly parcel which is also proposed to be rezoned. The two properties are presently contiguous along a line 10 feet in length located within Salt Creek. They are in the process of preparing an Assessment Plat formalizing the tying together of these two parcels. They are also willing to covenant to keep the northerly parcel in its natural state in perpetuity. He stated that the proposed Text Amendment to Section X(C)(3) of the Zoning Ordinance would be to increase the permitted Floor Area Ratio from .3 to .4 for uses as permitted in the B-2 Regional Shopping District. The proposed additions to the hotel include meeting rooms and approximately 120 guest rooms resulting in a total of 500 guest rooms. Current parking includes 500 spaces which, under the proposal, will be increased to 910 spaces. Member Marcy noted that if the northerly parcel were not rezoned and used for Floor Area Ratio purposes, then the proposed additions, when figured solely on the southerly parcel, would result in a .566 FAR. He also stated that the proposed rezoning is not justified, as it is solely for the economic benefit of the hotel. He would prefer that the Floor Area Ratio be increased to some extent, as opposed to using the northerly parcel for a Floor Area Ratio credit. The Chairman noted no members of the audience expressing support for either the proposed rezoning or the Text Amendment. The following members of the audience expressed their opposition to these proposals: Roger McNid er, 370 Forest Trail: 1) The current Hyatt operation subjects residents across the Creek to increase noise, lights, and a negative view in the winter when foliage is nonexistent. 2) The Hyatt, under a previous request, had promised the installation of additional vegetation which never took place. 3) May 17, 1982, a tree located on the Hyatt property fell across Salt Creek onto private property. 4) June 25, 1982, Village Manager Carmignani forwarded a letter to Mr. West advising the Hyatt of their responsibility to remove the tree. 5) June 25, 1982, the house on the affected private property was robbed, with the robbers using the fallen tree as a means of retreat across Salt Creek. 6) June 26, 1982, affected property owner removed the tree with no assistance from the Hyatt. Kapff, Assistant to Village Manager SUBJECT: Hyatt Applications including: 1) Rezoning from R-3 to ORA-2 2) Text Amendment to Section X(C)(3) RE: Floor Area Ratio 3) Special Use Permit for Construction in the Flood Plain The Oak Brook Hotel Company, as lessor of the property occupied by the Oak Brook Hyatt Hotel, is proposing to construct additions including guest and conference rooms and a parking structure to the existing Hyatt Hotel on the property noted as Parcel B on the attached map. The applicant has also purchased Parcel A which is contiguous with Parcel B along a line 10 foot in length located in Salt Creek. Following are the specific applications which have been made with respect to this project: . 1) Rezoning of Parcel A from R-3 to ORA-2 - The purpose of this proposed rezoning is to permit the applicant to construct more floor area on Parcel B taking advantage of the additional site area of Parcel A. The applicant has no plans to construct any improvements on Parcel A and has stated a willingness to covenant that no development will ever take place on this northerly parcel. 2) Text Amendment to Section X(C) (3) of the Zoning Ordinance to increase the floor area ratio from .3 to .4 for uses as permitted in the B-2 Regional Shopping District. The ORA-2 District currently provides for up to .3 FAR for B-2 type uses as noted on the attached page 935 of the Zoning Ordinance. The B-2 standard contained on page 911 of the Zoning Ordinance originally stated a maximum FAR of .3. This standard was increased to .4 in 1978. The applicant feels that the reference to the B-2 standards, as contained in the ORA-2 section of the Ordinance, should also be modified to .4 for B-2 type uses. In the way of history, the current development as contained on Parcel B results in a .33 FAR. The applicant received, in 1977, a Variation from the .3 FAR to permit construction up to .3414 for certain specific uses as noted in the attached Ordinance G-205. KM: Hyatt Applications June 17, 1983 Page 2 The proposal currently before the Village which includes the total site area of Parcels A and B as well as the additional floor area of the proposed additions results in .a floor area ratio of .344. 3) Special Use Permit for Construction in the Flood Plain The proposed additions located on Parcel B extend into what is presently the floodway or moving water portion of Salt Creek. I have attached pertinent sections of Chapter 10 of the Village Code which govern proposed encroach- ments into the flood plain. As noted on page 630.1, the proposed additions are not permitted as they: 1) Affect the rate of flow or quantity of flood waters flowing into, over or off of the subject property; 2) Affect the available detention area of the flood plain; and .3) Result in an increase in the risk of blockages forming in a floodway during a flood. Therefore, the proposed additions to the Hyatt Hotel require the issuance of a Special Use Permit. Pages 632 through 636 outline the specific procedure to be followed by the Plan Commission as well as factors which the Plan Com- mission should include in their review of the proposed development. The applicant has submitted plans which indicate the construction of additional detention area on Parcel A to compensate for the proposed development of Parcel B. On Parcel A, the proposal calls for regrading the entire area east of Salt. Creek in order to provide this additonal storage area. As this regrading activity will remove a majority of the existing plant lif a should the Village decide to grant this Special Use Permit, it would be appropriate for the Village to require some degree of reforestation of this area. Even with the "no-building" covenant, re-contouring a"ection A to com- pensate for building on Section B would surely damage the roots of the large oak trees on my property (Timber Trails Lots 95 and 96). The death of these trees could cause erosion of existing top soil and widen flooding in the area. I am certainly not opposed to Oak Brook Hotel Company but am concerned about damage to the few remaining oak trees in Oak Brook.
