AN ORDINANCE EXTENDING COMPLETION DATE
FOR PUBLIC IMPROVEMENTS IN OWNER'S SUBDIVISION
WHEREAS, the Corporate Authorities of the Village of Oak Brook approved
the Final Plat of Owner's Subdivision by passing Resolution No. R-352; and
WHEREAS, Section 3(A) of the Subdivision Regulations, Ordinance No.
6-140, as mended, requires that all public improvements be completed by the
owner or subdivider in accordance with plans and specifications approved by the
Village Engineer within three years following the approval of the final plat by
the President and Board of Trustees; and
WHEREAS, the subdivider of Owner's Subdivision has requested that the
completion date for public improvements be extended fr an May 15, 1987 to
August 15, 1987; and
WHEREAS, the Corporate Authorities find that the requested extension is
in the best interests of the Village of Oak Brook provided that the conditions
set forth below are satisfied.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby incorporated herein as though fully set forth.
Section 2: That the date for completion of the public improvements in
the Owner's Subdivision is extended to August 15, 1987, provided that each of the
following conditions is satisfied by the subdivider on or before May 15, 1987:
a) The Subdivision Improvement Agreement is revised and
reexecuted to show the most recent set of engineering
plans;
b) The two (2) Letters of Credit are revised to show the new
engineering firm, the new engineering plans and
specifications and the revised expiration date;
c) The engineering plans are revised to show the revised
construction schedule date; and
d) A new certificate of insurance is furnished to the
Village.
Section 3: That all requirements, conditions and standards of the
Subdivision Regulations of the Village of Oak Brook, except as waived or limited
herein or by previous action by the President and Board of Trustees, shall be
applicable to the subdivision and development of said Owner's Subdivision.
Section 4: This Ordinance shall be in full force and effect from and
after its passage and approval as provided by law.
