S- 619 AN ORDINANCE AMENDING ORDINANCE S-498 REGARDING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK, ORDINANCE G-60, AS AMENDED, RELATIVE TO PARKING REQUIREMENTS IN AN ORA DISTRICT (1919 Swift Drive) WHEREAS, on November 23, 1982 the Village President and Board of Trustees passed and approved Ordinance S-498, which ordinance granted a variation from the provisions of Section XI(E)(12)(d)(8) of the Zoning Ordinance of the Village of Oak Brook relative to parking requirements for property located at 1919 Swift Drive; and WHEREAS, an application has been filed requesting an amendment to the variation granted pursuant to said Ordinance; and WHEREAS, a public hearing on such application has been conducted by the Zoning Board of Appeals of the Village of Oak Brook on November 3, 1987 pursuant to due and appropriate legal notice; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That Section 3 of Ordinance S-498 be and is hereby amended to read as follows: 1. That the variation herein granted is granted specifically and solely to Swift and Company and only for so long as the property described in Section 3 is utilized for office i purposes and is owned and controlled by Swift and Company. For purposes of this condition "Swift and Company" shall mean Swift and Company, its parent corporation (if any) , or any wholly owned subsidiary of the parent corporation. 2. That Swift and Company agrees to construct an additional 95 off-street parking spaces upon finding by the Village that the existing parking is inadequate. "Inadequate" for purposes of said agreement shall mean any time where other parking areas not depicted on the attached Exhibit I are utilized by Swift or its employees or invitees for parking purposes in any five (5) days of any thirty (30) day period. 3. That Swift and Company correct existing nonconformities to conform to the applicable provisions of the Village Zoning Ordinance, including: A. Installation of screening and landscaping for off- street parking areas; and B. Construction of loading berths. Section 3: That this Ordinance is limited and restricted to the property located at 1919 Swift Drive, Oak Brook, Illinois for the use of Swift and Company as herein defined, which property is described as follows: Ordinance No. S- 619 Ordinance Amending Ordinance 5-498 Relative to Parking Requirements (1919 Swift Drive) Page two Lot l of Swift and Company Assessment Plat, being a part of the Southeast Quarter of Section 24, Township 39 North, Range 11 East of the Third Principal_Meridian in DuPage County, Illinois, recorded as Document Number R64-26943 in the Recorder's Office of DuPage County, Illinois. Also, all that part of vacated Swift Drive as vacated per "Street Right of Way Vacation Plat", being a part of the Southeast Quarter of Section 24, Township 39 North, Range 11 East of the Third Principal Meridian in DuPage County, Illinois, recorded as Document Number R66-4635 in the Recorder's Office of DuPage County, Illinois. Permanent Parcel Numbers 06-24-402-003 and 06-24-402-004 Section 4: That except as amended hereby the provisions of Ordinance 5-498 are hereby ratified and confirmed in all respects. As you may recall, Ordinance S-619 amended Ordinance S-498 regarding a parking variation for the Swift property located at 1919 Swift Drive. Section 2 of Ordinance S-619 amended Section 3 of the prior ordinance, S-498. Subsection 2 thereof referred to Exhibit I which depicted the parking configuration on the property before the passage of Ordinance S-619. Since the approved parking plan which has recently been reviewed by the Village is inconsistent with the prior Exhibit I, the ordinance is somewhat self-contradictory. Therefore, the attached ordinance has been drafted to eliminate this problem by deleting the reference to Exhibit I and substituting in place thereof language relating to the site plan recently approved by the Village. A copy of that Site Pla n is a ttache d for you r information and reference. It is therefore recommended that the attached ordinance be passed as a correction to previously approved Ordinance S-619. The applicant wishes to amend Ordinance S-498 by: (a) deleting subsection 2 of Section 3 which states: "That the parking be constructed substantially in compliance with the schematic plan therefore depicted in the attached Exhibit 1 which is hereby made a part hereof." (b) Substituting the number 95 in place of the number 142 in subsection 3 of Section 3. Ordinance No. 5-498 allowed the applicant to reduce its required parking from 467 spaces to 325 spaces. The proposed amendment would allow Swift-Eckrich, Inc. to increase parking spaces to approximately 385 spaces, and bring the property closer to the 428 spaces required by the present Village parking ordinance. It was recommended to the President and Board of Trustees that the requested amendment to Ordinance No. S-498 be granted conditional on the applicant submitting a new Parking Site Plan which is reviewed and accepted by the Village staff. SWIFT-ECKRICH, INC. - REQUEST TO AMEND VARIATION ORDINANCE RE: PARKING ( 1919 Swift Drive) The Secretary noted that the required Legal Notice was published in the Suburban Life Graphic on October 17, 1987 , and letters to nearby property owners were mailed on October 20 , 1987. Chairman Savino swore in all those members wishing to testify in this matter. David Gooder was present to represent this applicatin. Mr. Gooder stated that this application arises out of a parking ordinance variation that permitted a reduction in the number of parking spaces at the Swift-Eckrich site on Swift Road, which was requested in order to avoid the necessity of a parking structure. Mr. Gooder indicated that the applicant wishes now to increase the number of parking spaces, but that it was a mistake in 1985 when the Variation Ordinance was written to refer in it to a specific site plan which today is out of date. Mr. Gooder stated that the applicant wishes to expand the parking on the existing blacktop in order to avoid a parking structure on the northeast corner of the lot, but that this was prevented by the original site plan. Mr. Gooder indicated that Swift-Eckrich would increase the number of parking spaces from 325 to approximately 385 . At that time it was granted a variation to reduce the surface parking from 467 to 325 spaces. At the time it was converting the use of the building from largely a research and development facility to a corporate headquarters with a minor research area. The ordinance required that parking be laid out in a specific configuration. However, since that time the Village has changed the parking requirements with regard to the size of parking spaces and the width of parking aisles for office facilities. This makes it possible to redesign the parking areas to provide additional parking spaces in the number of 385 or more. At the same time the Village has re- duced the requirement for the facility by an amendment to the Zoning Ordinance . The Board may reverse or affirm, wholly or.partly, or may modify the order, requirement or decision or determina- tion as in its opinion ought to be made on the premises and to that end has all the powers of the official from whom the appeal is taken. (4) Decisions: All decisions, after hearing of the Zoning Board of Appeals on appeals from an administrative order, requirement, decision, or determination of the Building Inspector or other authorized official of the Village of Oak Brook, shall, in all instances, be final administrative determinations and shall be subject to judicial review only in accordance with applicable Statutes of the State of Illinois. (G) Variations. (1) Authority: The Board of Trustees shall decide all applications for variations of the provisions of this ordinance after a public hearing held before the Zoning Board of Appeals on such notice as shall be required by the Illinois Statutes. The Zoning Board of Appeals shall hold public hearings upon all applica- tions for variations and shall report its recommenda- tions to the Board of Trustees as to whether a requested variation would be in harmony with its gen- eral purpose and intent, and shall recommend a varia- tion only where it shall have made a finding of fact specifying the reason or reasons for recommending the variations. Such findings shall be based upon the stand- ards prescribed in Section XIII G-4 of this ordinance. No variation shall be granted by the Board of Trustees without such findings of fact. In the case of a variation where the Zoning Board of Appeals fails to recommend the variation, it can only be adopted by an ordinance with the favorable vote of two-thirds of the Trustees.
