AN ORDINANCE AMENDING ORDINANCE S-619 RELATING TO A VARIATION
RELATIVE TO PARKING REQUIREMENTS IN AN ORA DISTRICT
(1919 Swift Drive)
WHEREAS, on December 8, 1987, the Village President and Board of
Trustees passed and approved Ordinance No. S-619, which Ordinance amended
Ordinance S-498 and approved a Variation concerning parking on the subject
property; and
WHEREAS, subsection 2 of Section 3 of Ordinance S-498 referenced a site
plan referred to as Exhibit I; and
WHEREAS, the intent of Ordinance S-619 was to substitute a new approved
site plan for that referred to as Exhibit I of Ordinance S-498; and
WHEREAS, subsection 2 of Section 3 of Ordinance S-498 is inconsistent
with the provisions of Ordinance S-619 and the relief granted therein;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:

Section 1: That subsection 2 of Section 3 of Ordinance S-498 and
subsection 2 of Section 2 of Ordinance S-619 be and is hereby amended to read as
follows:
2. That Swift-Eckrich, Inc. agrees to construct an additional 95 off-
street parking spaces upon finding by the Village that the existing
parking is inadequate. 'Inadequate° for purposes of said agreement
shall mean any time where other parking areas not depicted on a
site plan approved by the Village are utilized by Swift or its
employees or invitees for parking purposes in any five (5) days of
any thirty (30) day period.
Section 2: That except as amended hereby the provisions of Ordinance
S-619 are hereby ratified and confirmed in all respects.
Section 3: That this Ordinance shall be in full force and effect from
and after its passage and approval pursuant to law.
