M WHEREAS, 35th Street intersects with the east right of way line of
A illinoi.s Route 83; and
WHEREAS the State of Illinois Department of Transportation has
precluded an, present or future access of 35th Street to Rate 33; and
WHEREAS, a portion of 35th Street abutting Route 83 is in the opinion of
the corporate authorities no iouger necessary, appropriate or required to
provide access to abutting property owners to 35th Street; and
WHEREAS, the provisions of the Illinois Municipal Code, Chaptar 24 of
the Illinois Revised Statutes, authortce the corporate authorities to control
and regulate the use of streets and other municipal property;
Now, THEREFORE, BE IT ORDAIM By TfM PRKSIDMT AND BOARD OF TRUSTMS
OF THE VILLAGE OF OAK BROOK, DPI PAM Ate? COOK COUNTISS, ITZINO'S as follows:
Section 1: That the provisions of the preamble bereinabOvs set forth are
hereby adopted as though fully set forth herein.
Section 2: That a portion of 35th Street east of Route 83 in the
Village of Oak Brook is heresy closed since it is no longer necessary,
appropriate or required for the use of public vehicular traffic, Said
portion of Route 83 is legally described as follow ,:
All that part of the 35th Street right-of-way from the east side of
Illinois Route 83 to the west side of Indian Trail Road, all within
the w6;t half of Section 35, Township 39 North, RW,,3 11 Sat,*_ of
the Thifd Principal %ersdian iri DuPage County, Illinois,
Section 3: That this Ordinance shall be in full force and effect from
and after its pasaage and approval according to law.
Section 4: That the village Clark is hereby author2.Eed and directed to
file with the Recorder of Deed& of Dupage County a certified copy of this
Ordinance together with a map depicting the property described in Section 2
hereof and incorporated herein.
