WHEREAS, an application has been filed requesting a variation from the
provisions of Section VII(D)(8)(h) to permit construction of a house
encroaching approximately 2.25 feet into the required IS foot side yard on the
north side of the subject property: ausd
WHEREAS, a public hen ing on such application has been conducted by the
Zoning Board of Appears of the Village of cask Brook on May 3, 1988 .pursuant to
dtne and appropriate legal notice; and
WHEREAS, a recommendation has been made by the said Zoning Board of
Appeals that the variation requested t<• granted; and
WHEREAS, the said Zoning Board of Appeals made explicit findings that the
variation requested mats the applicable standards set forth in Section
XIT(G)(4) of the said oak Brook Zoning Ordinance; and
WHEREAS, the President and Boyd of Trustees of the Village concur with
the recommendations and findings by the Zoning Board of Is;
NOW, THEREFORE, BE IT ORMMM BY THE PRESIDE" AND DDAW OF of
THE VTLT AGE of OAK BRWK, DU PAGE AND COOK WWnZS, ILLINOIS as followg:
Section 1: That the provisions of the preamble hereinabove set forth are
hereby adopted as though fully set forth herein.
Section 2:2: That a variation is hereby granted from the provisions of
Section VII(D)(8)(b) of the node of ordinances of the Zoning ordinance of the
Village of Oak Brook sea as to permit construction of a single family residence
encroaching appraKimately 2.25 feet into the required 18 foot side yard on the
north side of the subject property. Such construction shall be in substantial
conformity with the ZILL.E s, a copy of which is attached hereto labelled
"E UUL_&&",and hereby made a part hereof.
Section 3: That this ordinance is limited and restricted to the property
located at 3323 Heritage oaks Court, oak Brook, Illinois, which property is
legally described as:
Lot 4 in Heritage Oaks amended and restated, being a subdivision of
part of the Northwest Quarter of Section 33, Township 39 North, Range
11 East of the Third Principal meridian according to the plat thereof
recorded November 21, 1480 as document number R'30-.2',bx '—r. ^- -�
County, Illinois. Permanent Parcel No. 06-33-102-023.
Section 4: That this Ordinance shall be in full force and effect from and
after passage and approval as provided by law.
