S- o4 2 AN ORDINANCE ASCERTAINING THE PREVAILING RATE OF WAGES FOR LABORERS WORKMEN AND MECHANICS EMPLOYED ON PUBLIC WORKS IN THE VILLAGE OF CAK BROOK, DU PAGE AND COOK C� OUNTIES. ILLINOIS WHEREAS, the State of Illinois has enacted "An Act Regulating Wages of Laborers, Mechanics and Other Workers Employed In Any Public Works By The State, county, City Or Any Public Body Or Any Political Subdivision Or By Any One Under Contract For Public Works," approved June 26, 1941, as amended, Sections 398-1 through 39s-12, inclusive, of Chapter, 48 of the Illinois Revised Statutes; and 4HEREAS, the aforesaid Act requires that the Board of Trustees of the Village of Oak Brook investigate and ascertain the prevailing rate of wages as defined in said Act for laborers, mechanics and other workmen in the locality of said Village, employed in performing construction of public works for said Village; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OA: BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: To the extent and as required by Section 39s-1 through 39s- 12, of Chapter 48 of the Illinois Revised Statutes, the general prevailing rate of wages in this locality for laborers, mechanics and other workmen engaged in the construction of public works coming under the jurisdiction of this Village is hereby ascertained to be the same as the prevailing rate of wages for construction work in the DuPage County area as determined by the Devartment of Labor of the State of Illinois as of June 2. 1988. A,4orv_of that determination is attached hereto, labelled Exhibit "A" and made a part thereof. The definition of any terms appear:,ng in this Ordinance which are also used in the aforesaid Act shall be the same as in said Act. Section 2: Nothing herein contained shall be construed to apply said general prevailing rate of wages as herein ascertained to any work or employment except public works construction of this Village to the extent required by the aforesaid Act. Section 3: The Village Clerk shall publicly post and keep available for inspection by any interested party in the Village Hall this determination of such prevailing rate of wage, Section 4: The Village shell ma0 a copy of this eetermination to aif employer, and to any association of employers and to any person or association of employees who have filed, or file their names and addresses, with a request that copies of any determination stating the particular rates and the particular class of workmen whose wages will be affected by such rates be mailed to them. Section 5: The Village Clerk shall prompltly file a certified copy of this Ordinance with the Secretary of State of the Sate of Illinois. Section 6: The Village Clerk shall cause to be published in a newspaper of general circulation within the Village a notice of the determination mnde hereby, and such publication shall constitute notice that such determination i,s effective. WORKS IN THE VILLAGE OF OAK BROOK, BU PAGE An COOK COUMNS, ILLINOIS i air WHEREAS, the State of Illinois has enacted "An Act Regulating Wages of Laborers, Xechanicis .and Other Yorkers Eaploytd In Any Public Yorks By The State, County, City Or Any Public Sody Or Any Poli:iagl Subdivision Or By Any One Under `ontract For Public Yorks," approved June 26, 1941, as saended, Stctions 394-1 through 39s-12, inclusive, of Chapter 48 of the Illinois Revised Statutes; and WHEREAS, the aforesaid Act requires that the Boar3 of Trustees of the Village of Oak Brook investigate and ascertain the prevailing rate of rages as defined in said Act for laborers, mechanics and other workmen in the locality of II said Village, employed in performing construction of public works for said Village; NOW, TRMUPOEE, BE IT ORDAINED BY THE MNSIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK cOD11TIN3, ILLINOIS so follows: Section 1: To the extent and as required by Section 398-1 thronch 394- �I 12, of chaptor48 of the Illinois Revised Statutes, the general prevailing rate of wages in this locality for laborers, mechanics and other workmen engaged in -- the construction of pub=ic works coming under the jurisdiction of this Village is ;I hereby ascertained to ba the same as the prevailing rate of wages for it construction work in the DuPage County area as detersimed by the Department of Labor of the State of Illinois as of Juno 2, 1986. A copy of that determination it is attaches hereto, labelled Exhibit "A" and made a part thereof. The definition of any terms appearing in this Ordinance which are also wood in the aforesaid Act shall be the ease as in said Act. Section 2: Nothing herein contained shall be construed to apply Maid jk general prevailing rate of rages ae herein ascertained to any work or employment except public works construction of this Village to the extent required by the aforesaid Act. Section 3: -The Village Clerk shall publicly post and keep available For inspection--by interested party in the Village Hall this determination of such prevailing rate of rage. I I, I Pursuant to the provisions of Chapter 48, Section 39s-9 of the Illinois Revised Statutes the Village is required to ascertain the prevailing rate of -wages for various trades during June of each year. The Illinois Department of Labor has released statistics relative to such prevailing wage rates for DuPage County. I have drafted the attached ordinance which adopts these mandated wage rates.
