S_ 648 R AN ORDINANCE VACATING 15th STREET ERNIE PYLE DRIVE AND ROSE COURT IN THE VILLAGE OF OAK BR001, ILLINOIS, WHEREAS, the Plan Commission of the Village of Oak Brook on December 14, 1987, unanimously recommended to the Village Board that the following Village streets be vacated: 15th Street, Ernie Pyle Drive and Rose Court to become part of a subdivision in the adjacent property north of 16th Street and East of Route 83; and WHEREAS, the Village President and Board of Trustees have considered the recomnendation and being of the opinion that such vacation, without requiring payment therefore, is in the best interests of the Village because of the benefits to it of development of the property abutting said streets; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DUPAGE A1.0 COOK COUNTIES, ILLINOIS, AS FOLLOWS: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That the following streets of the Village of Oak Brook. are hereby vacated: 15th Street, Ernie Pyle Drive and Rose Court. Section 3: That this Ordinance is subject to the conditions that the John Buck Company or its nominee take title to the property North of 16th Street, East of Illinois Route 83 and West of the Oak Brook Club Subdivision, (also known as the Buck/Ernie Pyle Resubdivision) on or before December 31, 1988 and provide the Village with written proof thereof and that the record owners of the Buck-Ernie Pyle Resubdivision execute and deliver to the Village a covenant in form and substance acceptable to the Village as approved by the Village Attorney agreeing to the conditions set forth in Resolution R-456 of the Village of Oak Brook. Lots 5 through 20 in Block 1 and Lots 1 through 30 in Block 2 of Town Development Company's Elmhurst Countryside Unit Number 2 according to plat thereof recorded on September 12, 1945, as Document No. 483701 being a part of the Northwest Quarter of Section 23, Township 39 North, Range 11 East of the Third Principal Meridian in DuPage County, Illinois (excluding that portion thereof owned by the State of Illinois). Permanent Parcel Nos.: 06-23-102-004 through 06-23-102-019; 06-23-103-002 through 06-23-103-007; 06-23-103-009 through 06-23-103-012; 06-23-103-015 through 06-23-103-032; 06-23••103-034 and 06-23-103-036. Section 4: That the Village Clerk is hereby authorised and directed to file with the Recorder of Deeds of DuPage County a certified copy of this Ordinance, together with the Vacation Platt, attached hereto, labelled Exhibit "=_tend hereby made a part hereof prov ea that the conditions not forth- 1K Section 3 have been met and satisfied.
