S-653 - 09/13/1988 - SPECIAL USE - Ordinances �4 ORDINANCE NO. s-651 �ittlCTt C`MtA 40% TPAS Lam. 1.-zs—4•!C' AN ORDINAWX GRANTING A F1A)0D PLAIN SMIAL tISR FOR Rf��Ia7?A3 FILLING AND CONSTRUOxION WITHIN THE FLOOD PLAIN PURBUU•r To o SHCTION 10-34 of THE COW OF ORAINAN= OF THI9 YII"= OF OW MGM (459 PORKST TRRIL) S WHEREAS, the owner of certain property described herein has petitioned the corporate authorities of the Village of Oak Brook, Dupage and Cook Counties, Illinois, for a Flood Plain Special Use Permit under Section 10-34 of the Code of Ordinances of the Village of Oak Brook, relating to flood plain and wetland regulations; and WHEREAS, a public hearing on such petition has been conducted by the Zoning Hoard of Appeals of the Village on August 2, 1988 pursuant to due and appropriate legal notice; and WHEREAS, the Plan Commission of the Village of Oak Brook has submitted its recommendation to the Village President and Board of Trustees; and WHEREAS, the Plan Commission and Zoning Board of Appeals have both recommended approval of the petition since the proposed use is consistent with the best use of the flood plain; and WHEREAS, the proposed use satisfies the requirements of and is consistent with each of the factors set forth in Section 10-34(c) of the Code of Ordinances of the Village of Oak Brook; and WHEREAS, the corporate authorities of the Village of Oak Brook deem the passage of this Ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook; NOW, THEREFORE, BE IT ORDAINED By THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: Pursuant to section 10-34 of the Code of Ordinances of the Village of Oak Brook, Illinois, a Flood Plain Special Use Permit is hereby granted to allow construction of building additions and regrading on the property legally described as follows: Lot 10 in Timber Trails Estates Annex, being a subdivision of a part of the East half of Section 23, Township 39 North, Range 11 East of the Third Principal Meridian according to the Plat thereof recorded August 17, 1950 as Document 601607 in DuPage County, Illinois. Permanent Parcel No. 06-23-402-005. Section 3% That the Flood Plain Special Use Permit herein granted in Section 2 o£ this Ordinance is expressly subject to the following conditions: A) Approval of the flood plain work by the Illinois Department of Transportation, Division of Water Resources. B) That all. slopes be kept to a maximum 3:1 ratio. C) Compliance with all engineering requirements as reviewed by the Village Engineer. D) if a fence is constructed, said fence shall bs open and most all Village reoulaticns for fences. Section C That this ordinance shall he in full force and effect from and after its passage and approval as provided by law. ordinance No. S- 653 Granting a special Use Permit for Filling and Conctruction Within a Flood Plain (459 Forest Trail) Page 2 w Section 5: All ordinances, rules and regulations of the Village of Oak Brook which are in conflict with the proviaions of this Ordinance are hereby repealed to the extent Of such conflict but only as they apply to the property hereinbefore described. I Section 6: If any portion of this Ordinance :a for any reason held to be invalid, such determination shall not affect the validity of any remaining portion of this Ordnance.
