AN ORDINANCE GRANTING VARIATIONS FROM THE PROVISIONS of
SECTION VII(C)18)(c) MW SECTION XII(B)(2)(b)
OF THE ZONING ORDIMUCE OF THE VILLAGE OF OAK BROOK
RELATIVE TO REAR YUM REQOIRENRITS

WHEREAS, an application has been filed requesting variations from the
provisions of Section VII(C)(8)(c) and Section XII(B)(2)(b) of the Zoning
Ordinance of the Village of Oak Brook to permit the construction of a rear
yard addition to an existing single-family residence; and
WHEREAS, a public hearing on such appl-4cation has been conducted by the
Zoning Board of Appeals of the Village of Oak BrMk on October 4, 1988 i
pursuant to due and appropriate legal notice; and
WHEREAS, a recommendation has been made by said Zoning Hoard of Appeals
that the variations requested be granted; and
WHEREAS, the Village President and Board of Trustees concur with the
recommendation and findings made by the Zoning Board of Appeals; j
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF j
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:

Section 1: That the provisions of the preamble hereinabove set forth are
hereby adopted as though fully set forth herein.
Section 2: That variations are hereby granted from the provisions of j
Section VII(C)(8)(c) and Section XII(B)(2)(b) of the Oak Brook Zoning
Ordinance to permit construction of a non-conforming addition to an existing
non-conforming structure to the rear of the existing house, increasing the
existing encroachment to approximately 34.5 feet, resL.lting in a 65.5 foot
rear yard instead of the 100-foot requirement, in substantial conformity with
the Area Plan dated August 246 1988 which is attached hereto, labelled
'%id jh;t W and hereby made a part hereof.
Section 3: That this Ordinance is limited and restricted to property
commonly known as 116 Oak Brook Road, Oak Brook, Illinois, which property is
legally described as:

Lot 12 in Oak Brook Estates, of the South 40 acres (except the west 30
feet thereof) of the East Half of the Southeast Quarter of Section 25,
Township 39 North, Range 11 East of the Third Principal Meridian,
according to the plat thereof recorded April 25, 1952 as Document 605115
in DuPage County, IL. Perma:aeut Parcel #06-25-409-004.
Section 4: That this Ordinance shall be in full force and effect from
and after its passage and approval pursuant to law.
