S-661 - 01/24/1989 - SPECIAL USE - Ordinances ORDINANCE S-661 AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR A CLINIC FOR CERTAIN PROPERTY IN THE ORA-1 OFFICE RESEARCH ASSEMBLY DISTRICT (2425 22ND STREET, OAK BROOK, ILLINOIS) WHEREAS, an application has been filed requesting a Special Use Permit for a Clinic as provided in Section X(B)(2) (F) of the Zoning Ordinance of the Village of Oak Brook; and WHEREAS, a public hearing on said application has been held by the Plan Commission on November 21, 1988 and its report submitted to the Zoning Board of Appeals and to the President and Board of Trustees; and WHEREAS, a public hearing on said recommendation has been held by the Zoning Board of Appeals of the Village of Oak Brook on December 6, 1988 pursuant to due and appropriate legal notice; and WHEREAS, a recommendation has been made by the Zoning Board of Appeals that the requested Special Use Permit be granted subject to certain conditions; and WHEREAS, the President and Board of Trustees deem the passage of this ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook subject to certain conditions. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section l: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That pursuant to Section X(B)(2)(F) of the Zoning Ordinance of the Village of Oak Brook, a Special Use is granted to property located at 2425 22nd Street for use as a clinic. Section 3: That this Ordinance is limited and restricted to the property commonly known as 2425 22nd Street, Oak Brook, Illinois, which property is legally described as follows: Parcel 1: Lot 1 in Butler Co. M-1, Inc. Assessment Plat No_ 6, in Section 28, Township 39 North, Range 11, East of the Third Principal Meridian, according to the plat thereof recorded July 20, 1964 as Document R64-25649, in DuPage County, Illinois. Parcel 2: Lot 1 in Rapistan Assessment Plat of part of the North- east 1/4 of Section 28, Township 39 North, Range 11, East of the Third Principal Meridian, according to the plat thereof recorded May 4, 1961 as Document R61-5593, in DuPage County, Illinois. Parcel 3: That part of the Northeast 1/4 of Section 28, Township 39 North, Range 11, East of the Third Principal Meridian, described as follows: Beginning at the Southwest corner of Lot l of Butler Co. M-1 Inc. Assessment Plat No. 6; thence South on the extension of the West line of said lot to its intersection with the South line of Northern Illinois Gas Company right of way; thence Easterly along said South line, also being the North line of the East-West Toliway to the point of intersection with an extension Southerly of the East line of Lot 1 of Butler Co. M-1 Inc. Assessment Plat No. 6; thence North on said extension of the East lot line to the Southeast corner of said lot; thence Westerly along the South line of said lot, also being the North line of Northern Illinois Gas Company right-of-way to the point of beginning, all in York Township, in DuPage County, Illinois. Permanent Parcel Nos. 06-28-202-005 and 06-28-202-008. Section 4: That the special use granted pursuant to Section 2 of this ordinance is hereby made expressly subject to the following conditions: (A) That the improvements to be constructed on the subject property be done in substantial conformity with the Site Plan therefor prepared by James Cox Associates, Inc. , Project 2288, and dated December 20, Ordinance S-661 An Ordinance Granting a Special Use Permit for a Clinic in the �. ORA-1 District Page 2 1988. A copy of Site Plan is attached hereto labelled Exhibit A and hereby made a part hereof. (B) That no voluntary abortions shall be conducted on the premises. Section 5: That this Ordinance shall be in full force and effect from and after passage and approval as provided by law. PASSED THIS 24th day of January 1989.
