S-685 - 03/27/1990 - SPECIAL USE - Ordinances ORDINANCE S- 6 8 5 AN ORDINANCE GRANTING A SPECIAL USE FOR A CLINIC FOR CERTAIN PROPERTY IN THE ORA-1 ZONING DISTRICT (800 ENTERPRISE DRIVE) I WHEREAS, an application has been filed requesting a Special Use Permit for a clinic as provided in Section X(B) (2)(g) of the Zoning Ordinance of the Village of Oak Brook; and WHEREAS, a hearing on said application has been held by the Plan Commission on January 15, 1990, and a report of the Plan Commission was submitted to the Zoning Board of Appeals and to the Village President and Board of Trustees; and i WHEREAS, a public hearing on said aprpi ca-ion was 4_ald by the Zoning Board of Appeals on February 6, 1990, pursuant t3 due and appropriate _legal j notice; and WHEREAS, a recommendation was made by the Zoning Board of Appeals that the requested Special Use Permit be granted; and WHEREAS, the Village President and Board of Trustees deem the passage of this Ordinance to be in the best interest and furtherance of the general welfare of the Village of Oak Brook with the conditions set forth herein; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section l: That the provisions of the preamble hereinabove set forth are 1 hereby adopted as though fully set forth herein. Section 2: That pursuant to the provisions of Section X(B)(2)(g) of the Zoning Ordinance of the Village of Oak Brook, a Special Use is granted to property located at 800 Enterprise Drive, Oak Brook, IL for use as a clinic. Section 3: That this Ordinance is limited and restricted to the property commonly known as 800 Enterprise Drive, Oak Brook, IL, which property is legally described as follows: Lot 1 in Central Industrial Plaza Subdivision, being a subdivision in the Southeast Quarter of Section 23 and in the Southwest Quarter of Section 24, Township 39 North, Range 11, East of the Third Principal Meridian, according to the plat thereof recorded June 1, 1965 as Document No. R65-18254, in DuPage County, Illinois. Permanent Parcel No. 06-23-405-003. Section 4: That the Special. Use granted pursuant to Section. 2 of this Ordinance is hereby made expressly subject to the following condition: i i Ordinance S-6 8 5 Granting a Special Use for a Clinic in the ORA-1 Zoning District Page 2 A. That the Special Use herein granted is specifically limited to Rush-Anchor HMO and only for those portions of the premises described in Section 3 as constituting approximately 18,000 square feet as further set forth in the Site Plan prepared by Jensen & Halstead, Ltd. , dated as received January 10, 1990, which Site Plan is attached hereto labelled as Exhibit A and hereby made a part hereof. The FEMA Map has been amended as of 1981 of a relocation of the Flood Plain. 4 2. A letter has been forwarded to the Village dated February 14, 1990 in reference to the bicycle path easement on the proposed expansion project. 3. Donahue b Associates agreed the stormwater detention area in the proposed site to meet Village Code and additional detention was not feasible. Kapff, Assistant to Village Manager SUBJECT: Oak Brook Partners Special Use Regarding Clinic 800 Enterprise Drive Mr. Jim Hughes, contract purchaser of the subject property, has made application for a special use permit which would allow the location of a clinic at 800 Enterprise. This building contains approximately 56,000 sq. ft. of which 33% is presently occupied. The RUSH-Anchor HMO presently located on the 8th floor of the 1200 Harger Road office building (12,037 sq. ft. ) is proposing relocating to the 2nd floor of the 800 Enterprise building in order to provide a better level of service to the community. The relocated HMO will occupy approximately 18,000 sq. ft. of this building. Both the Plan Commission and Zoning Board of Appeals have recommended approval of this special use permit. At the Zoning Board hearing, Dr. White questioned whether or not the proposed relocation of this HMO would require some type of "Certificate of Need" or other State approvals. In that regard, the applicant, by letter of February 20, 1990, to the Illinois Health Facilities Planning Board (attached) , is requesting a statement of any particular requirements. A written response from the State Planning Board should be received prior to the Village Board's February 27 meeting. In reviewing requests for special use permits, Section XIII(J)(5) of the Zoning Ordinance requires that the Village Board determine that the proposed special use: 1. "Is so designed, located and proposed to be operated that the public health, safety and welfare will be protected; and 2. Would not cause substantial injury to the value of other property in the neighborhood in which it is located." 3 Oak Brook Partners - 2 - February 21, 1990 Both the Plan Commission and Zoning Board felt that these two requirements have been met by the applicant. The proposed relocation is needed in order to expand the practice from the current Harger Road facility. 2. Hours of operation will remain the same at Monday through Friday 9:00 a.m. to 8:00 p.m. and Saturday 9:00 a.m. to 1:00 p.m. 3. The number of doctors using the facility will also remain the same at 13 with approximately 150-160 patients per day utilizing the facility. 4. The facility will remain as a family practice-type HMO and will not include surgery. A motion was made by Member Martinello, seconded by Member Crouch, to recommend approval of the requested Special Use Permit based on the following findings of facts: 1. Firfer who further explained the need for this special use. In response to a question, Mr. Cella stated that they presently have approximately 12,000 sq. ft. of space in a building on Harger Road and the proposed space on 800 Enterprise would be approximately 19,000 sq. ft. General discussion ensued between members of the Plan Commission and the applicants. The applicant noted that this would not be an emergency room type facility, but only an HMO-type facility. The building, comprising approximately 56,000 sq. ft. is presently 33% occupied. Although the Zoning Ordinance contains no specific standards by which to review requests for clinics, the Plan Commission should use the general standards which require a special use to (1) be designed, located and proposed to be operated that the public health, safety and welfare be protected; and (2) not cause substantial injury to the value of other property in the neighborhood in which it is located. As indicated in attached correspondence and plans, the Rush-Anchor HMO presently located on the 8th floor of the 1200 Harger Road office building is proposing relocating to the 2nd floor of the subject property in order to provide a better level of service to the community. The HMO will occupy approximately 19,000 sq. ft. of the top floor of this building. Our success has been through the provision of high quality care by our own primary care doctors who have staff privileges at local hospitals and use the services of a variety of specialists, many of whom who practice in the community. This methodology, combined with the ability to offer superb tertiary care (i.e. , highly specialized care such as transplants) at Rush-Presbyterian-St. Luke's Medical Center allow our health management organization to provide these services at an affordable cost. It has always been the goal of RUSH-ANCHOR HMO to provide the personalized medical services that our patients, many of whom are corporate employees from within the area, have come to expect. In addition, we have always made it a point to change with recent trends in medicine that relate to wellness and individual counseling regarding sickness and health. Our present quarters have served us well to date. We have, as you may know, smaller medical offices in Glendale Heights and the Aurora/Naperville area. Our intention is to maintain the present primary care hours of Monday through Thursday 9:00 a.m. to 7:00 p.m. , Friday 9:00 a.m. to 5:00 p.m. , and Saturday 9:00 a.m. to 1:00 p.m. , as well as the present number of primary care physicians. As we design new space, the size of the doctors' consultation rooms are to be increased and additional rooms added for the creation of specifically identified needs, such as specially separated "clean" and "soiled" storage rooms, as well as the changes necessary to plan an exceptional traffic pattern which will provide privacy and quiet areas for the patients of Obstetrics & Gynecology, Pediatrics, etc. It will also allow us to better utilize our ancillary staff and avoid prolonged waiting time in common areas. The ability to provide parking in a sheltered atmosphere is, of course, a definite advantage for our patient population. While we do not treat a substantial number of handicapped patients, I am sure those patients who do not feel well will appreciate the covered parking during the winter months. I should like to mention once again, that we have had no problems in integrating with the present occupants of a general office building both from an internal traffic standpoint or a parking aspect. Our present landlord has asked us to stay but cannot accommodate our needs for the present or the foreseeable future. Because of the proximity of the local hospitals and the traffic patterns as well as our history of success, RUSH- ANCHOR HMO would prefer to stay in the Oak Brook area. While we have been offered a number of alternative locations at sites neighboring the Oak Brook area, none offers the advantages of the 800 Enterprise building in our opinion. Its geographic location is ideal for patients and physicians alike with regard to their work, homes and families. In addition, the building is shielded from the hustle and bustle of the Oak Brook Shopping Center while still being unusually accessible by public and private transportation. It is clear that this building is not ideally suitable for a large corporate headquarters, but is nicely situated for small to moderate size companies and • • Mr. Bruce Kapff January 4, 1990 Page 3 the presence of a tenant with a quality, national reputation in the healthcare world should help to attract well-qualified tenants. Our tenancy will only impact the present tenants in a positive manner. There are few of them present, and those that are will benefit from the improvements to be made by the new owners. In summary, it is Rush's opinion that we have been a good Oak Brook neighbor over the past years and the combination of building improvements, a respectable, well known tenant as an anchor tenant and the addition of good management will provide a "win-win" opportunity for the Village of Oak Brook, its citizens, and the 800 Enterprise building. Mr. Michael Lach, from Bollinger, Lach & Associates, Inc. presented the Board with a letter stating reasons why the proposed 8" watermain was not beneficial to the fire safety of the area. �+ It was the consensus of the Board: 1. To request Staff to respond to Bollinger, Lach & Associates, Inc. letter of March 13, 1990 on the requested watermain so a Board decision can be made at the next Regular Meeting. 2. McDonald's Corporation Status Report on Kensington Road Development: Attorney Gooder, representing McDonald's Corporation, presented information requested by the Board at its February 13, 1990 meeting. '1. FEMA has recently approved a Letter of Map Revision which corrects a deficiency in our current maps on the McDonald's property. 2. A letter has been forwarded to the Village dated February 14, 1990 in reference to the bicycle path easement on the proposed expansion project. 3. Donahue & Associates, our Ginger Creek Stormwater Consultant, agreed additional detention would be so small it would be inconsequential. Staff agreed past area development had met the Village's stormwater requirements. Also, apparently the McDonald's Phase 1 area provided 9 acre feet of flood storage over which is required. 4. The berms located on the Jorie Boulevard site will meet the required ordinance height. 5. McDonald's will install temporary signs at the proposed sites for Board inspection. Public Works Superintendent Meranda, Village Engineer Durfey, Fire Chief Nielsen and Village Manager Berley are to further develop their recommended requirement of the applicant to loop the watermains located on project site to Kensington Road.
