S-691 - 05/08/1990 - ZONING -VARIATION - Ordinances ORDINANCE NO. S- 691 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF SECTION VII(D)(8)(b) OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK RELATIVE TO SIDE YARD REQUIREMENTS (3515 Spring Road) WHEREAS, an application has been filed requesting a variation from the provisions of Section VII(D)(8)(b) of the Zoning Ordinance of the Village of Oak Brook to permit the construction of an addition encroaching approximately 1 foot into the required 18-foot side yard on the property hereinafter described; and WHEREAS, a public hearing on such application has been conducted by the Zoning Board of Appeals of the Village of Oak Brook on April 3, 1990 pursuant to due and appropriate legal notice; and WHEREAS, a recommendation has been made by said Zoning Board of Appeals that the variation requested be granted and made explicit findings that the variation requested meets the applicable standards set forth in Section XIII(G)(4) of the said Oak Brook Zoning Ordinance; and WHEREAS, the Village President and Board of Trustees concur with the recommendations and findings made by the Zoning Board of Appeals; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That a variation is hereby granted from the provisions of Section VII(D)(8)(b) of the Zoning Ordinance of the Village of Oak Brook so as to permit construction of an addition encroaching approximately l foot into the required easterly 18-foot side yard, provided that the addition is constructed in substantial conformity with plans submitted as a part of the application dated February 13, 1990, a copy of which are attached hereto, labelled "Exhibit A", and hereby made a part hereof. Section 3: That this Ordinance is limited and restricted to property commonly known as 3515 Spring Road, Oak Brook, Illinois, which property is legally described as: Lot 1 in James Hannah's Assessment Plat of part of Section 36, Township 39 North, Range 11, East of the Third Principal Meridian, according to the Plat thereof recorded January 10, 1962 as Document R62-00992 except that part described as beginning at the Northwest corner of Lot 1 in Morrison's Subdivision of part of the Ordinance No. S 691 An Ordinance Granting a Variation Relative to Side Yard Requirements 3515 Spring Road Page 2 Northwest 1/4 of the Southwest 1 A of said Section 36, according to the Plat thereof recorded December 17, 1958 as Document 906505 (said Northwest corner being also a corner of said Lot 1 in James Hannah's Assessment Plat) and running thence Easterly on the line between said lots, 216.38 feet to the Southeast corner of Lot 1 in said James Hannah's Assessment Plat; thence North 0° 5 minutes West on the East line of said Lot 1, 7.O feet; thence Westerly in a straight line 216.38 feet to a point in the West line extended North of said Morrison's Subdivision that is 4.9 feet North of the Northwest corner of said Morrison's Subdivision; thence Southerly on said West line 4.9 feet to the point of beginning in DuPage County, Illinois. Permanent Index Nos. 06-36-101-004 and 06-36-301-001. Section 4: That this Ordinance shall be in full force and effect from and after passage and approval as provided by law.
