S-696 - 07/10/1990 - SPECIAL USE - Ordinances ORDINANCE S- 696 AN ORDINANCE GRANTING A SPECIAL USE FOR A DAY CARE FACILITY IN THE ORA-1 DISTRICT PURSUANT TO THE PROVISIONS OF SECTION X(B)(2)(h) OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK WHEREAS, an application has been filed requesting a text amendment to create a Day Care Center as an authorized special use and the issuance of such special use; and WHEREAS, the Plan Commission, on May 21, 1990, considered such application and forwarded its report thereof to the Zoning Board of Appeals, recommending approval of the requested special use permit; and WHEREAS, the Zoning Board of Appeals conducted a public hearing on the application pursuant to due and appropriate legal notice on June 5, 1990; and WHEREAS, the said Zoning Board of Appeals recommended approval of the special use permit for a Day Care Center; and WHEREAS, the Village President and Board of Trustees have reviewed the recommendations of the Zoning Board of Appeals and the report of the Plan Commission and concur with the same; and WHEREAS, the Village President and Board of Trustees have amended the Zoning Ordinance of the Village of Oak Brook to provide for day care centers as a Special Use in the ORA-1 District pursuant to Ordinance G- 448 ; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That a Special Use for a Day Care Center, pursuant to the provisions of Section X(B)(2)(h) of the Zoning Ordinance of the Village of Oak Brook be and is hereby granted to the property as described in Section 3 hereof. Section 3: That the Special Use herein granted is limited and restricted to the property located at 1520 Kensington Road, leased by The Servicemaster Company, which property is legally described as: Lot 1 in The Crossings at Oakbrook, being a resubdivision of part of Section 26, Township 39 North, Range 11 East of the Third Principal Meridian, according to the plat thereof recorded June 13, 1984 as Document R84-44967 in DuPage County, Illinois (except- ing therefrom that part of said land condemned for highway purposes by decree dated May 16, 1985 in Case No. 85 ED 14) . Ordinance S- 696 Granting a Special Use for a Day Care Facility in the ORA-1 District Pursuant to the Provi- sions of Section X(B)(2)(h) Page 2 Section 4: That the Special Use granted herein is specifically subject to the conditions that (a) maximum child occupancy of the facility,,enot exceed 160; (b) the facility shall maintain a direct alarm hook up to the Oak Brook Police Department; (c) the square footage of activity area for children shall be at least 110% of the minimum area required by the Illinois Department of Children and Family Services, and (d) the square footage of outdoor play area shall be at least 75 sq. ft. per child and shall be capable of accommodating not less than 100% of the licensed capacity at any one time. Section 5: That this Ordinance shall be in full force and effect from and after passage and approval as provided by law. PASSED THIS 10th day of July 1990.
