S-703 - 08/14/1990 - VARIATION - Ordinances ORDINANCE S- 703 AN ORDINANCE GRANTING VARIATIONS FROM THE PROVISIONS OF SECTIONS VII(C)(3) AND VII(C)(4) OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK RELATIVE TO LOT AREA (3515, 3603 YORK ROAD) WHEREAS, an application has been filed requesting variations from the provisions of Sections VII(C)(3) and VII(C)(4) of the Zoning Ordinance of the Village of Oak Brook regarding lot area and lot width to allow for the creation of seven lots pursuant to subdivision; and WHEREAS, a public hearing on such application has been conducted by the Zoning Board of Appeals of the Village of 0ak Brook on March 6, 1990, pursuant to due and appropriate legal notice; and WHEREAS, no recommendation has been made by said Zoning Board of Appeals concerning the variations as evidenced in the minutes of that body; and WHEREAS, the Village President and Board of Trustees have reviewed the report of the Zoning Board of Appeals concerning the requested variation and deem the granting of the variation to be consistent with the standards set forth in the Zoning Ordinance for variations; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That lot area variations are hereby granted for Lots 5 and 6 from the provisions of Section VII(C)(3) to permit each lot to contain 0.96 acres instead of the required 1.0 acres. Section 3: That this Ordinance is limited and restricted to property described as follows: Lot 1 of Graue's Assessment Plat No. 1 (except the South 540.26 feet and except the North 237.9 feet thereof as measured along the East line of Lot l) being a part of the North 1/2 of the Southeast 1/4 of Section 36, Township 39 North, Range 11, and now known as Brush Hill Acres, being a subdivision of the South 480.94 feet of the North 718.84 feet (as measured on the East line) in Graue's Assessment Plat No. 1, in the West 1/2 of the Southeast 1/4 of Section 36, Township 39 North, Range 11, East of the Third Ordinance S--703 Granting Variations Relative to Lot Area 3515, 3603 York Road Page 2 Principal Meridian, reference being had to the record thereof on February 11, 1944, as Document No. 458793, in DuPage County, Illinois, Permanent Parcel Nos. 06-36-400-002, 06-36-400-003 and 06-36-400-004.
