AN ORDINANCE GRANTING A VARIATION
FROM THE PROVISIONS OF SECTION XI(D)
OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK
RELATING TO LOADING DOCKS
(2100 YORK ROAD, OAK BROOK, IL)
WHEREAS, an application has been filed by JWP Midwest, Inc. requesting a
variation from the provisions of the Zoning ordinance regarding loading docks;
and
WHEREAS, the Zoning Board of Appeals conducted a public hearing on the
request on July 2, 1991 pursuant to due and appropriate legal notice; and
WHEREAS, the Zoning Board of Appeals recommended approval of the
requested variation subject to conditions; and
WHEREAS, the Village President and Board of Trustees have considered the
recommendation of the Zoning Board of Appeals and concur in same;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth are
hereby adopted as though fully set forth herein.
Section 2: That a variation is hereby granted from the provisions of
Section XI(D) of the Zoning Ordinance of the Village of Oak Brook to permit a
loading berth 40' in length instead of the required 55' to be located in the
required side yard adjacent to Clearwater Drive.
Section 3: That this ordinance is specifically subject to the condition
that the loading berth in question may be utilized only by vehicles not
exceeding 30' in length.
Section 4: That this ordinance replaces and supersedes Ordinance S-312
passed and approved September 10, 1974 which ordinance by its terms lapsed
pursuant to the provisions contained therein.
Section 5: That the loading berth which is the subject matter of this
variation shall be maintained as depicted on the attached Exhibit "A", a copy
of which is attached hereto and hereby made a part hereof.
Section 6: That this ordinance shall be in full force and effect from
and after passage and approval pursuant to law.
