S-748 - 01/26/1993 - VARIATION - Ordinances ORDINANCE S- 748 AN ORDINANCE GRANTING A VARIATION FROM SECTION XII(B) (2) (b) OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK, AS AMENDED, TO ALLOW EXPANSION OF AN EXISTING NON-CONFORMING STRUCTURE (2124 OAK BROOK ROAD, OAK BROOK, IL) BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, Cook and DuPage Counties, Illinois as follows: Section 1: That the President and Board of Trustees have received the recommendation of the Zoning Board of Appeals of the Village of Oak Brook, that a petition for variation be granted pursuant to a public hearing held before the Zoning Board of Appeals on August 24, 1992. Section 2: That the property for which the variation is recommended is commonly known as 2124 Oak Brook Road, Oak Brook, IL, and is legally described as: Parcel 1: The West 10 rods and 2.0 feet of the South 5 rods and 13 feet of the East half of the Southwest Quarter of Section 27, Township 39 North, Range 11, East of the Third Principal Meridian, except that part taken, dedicated or used for highway purposes, in DuPage County, IL, Parcel 2: The South 10.0 feet, as measured on the West line thereof, of Lot 163 and the West 10.0 feet, as measured on the South line thereof of that part lying South of a line 55.49 feet North, as measured on a line parallel with the West line of said lot and parallel with the South line thereof, of Lot 162, both in Brook Forest, being a subdivision of Section 27, Township 39 North, Range 11, East of the Third Principal Meridian, according to the plat thereof recorded July 26, 1965, as Document R65-27092 and Certificate of Correction filed September 24, 1965, as Document R65-37405, in DuPage County, IL. Permanent Parcel Nos. 06-27-304-014 and 06-27-304-016. Section 3: That the President and Board of Trustees hereby adopt the findings of fact of the Zoning Board of Appeals that granting the requested variation will not alter the essential character of the locality and will alleviate the particular hardship of the petitioner. Section 4: That a variation from the provisions of Section, XII(B) (2) (b) to permit the expansion of an existing non-conforming structure is hereby granted for the aforementioned property subject to the following conditions: (1) That the expansion of the non-conforming structure is constructed in substantial conformity with the plans as submitted with the Petition for Variation and herein incorporated by reference, a copy of which is on file with the Petition for Variation official file; (2) That the building permit required to accomplish the proposed expansion be obtained on or before July 26, 1993; Ordinance S- 748 Granting a Variation for the Expansion of an Existing Non- Conforming Structure 2124 Oak Brook Road Page 2 (3) That construction of the proposed expansion be commenced on or before January 26, 1994; (4) That construction of the proposed expansion be completed on or before July 26, 1994; and (5) That the Hinsdale Sanitary District approve the sewer service at the subject property. If any of the foregoing Conditions are not satisfied within the time specified, this variation shall be null and void without further notice or action by the Village. That this ordinance shall be in full force and effect from and after passage and approval pursuant to law. PASSED THIS 26th day of January , 1993.
