S-760 - 07/13/1993 - SPECIAL USE - Ordinances { i ORDINANCE 93-ZO-S-760 AN ORDINANCE REZONING A CERTAIN PARCEL TO THE B-3 GENERAL BUSINESS DISTRICT (2001 22ND STREET) WHEREAS, on May 17, 1993, the Costco Wholesale Corporation as contract purchaser filed an application requesting that certain property in the area of the southeast corner of 22nd Street and Midwest Road in the Village of Oak Brook, Illinois, presently zoned ORA-1 be rezoned to B-3, General Business District; and WHEREAS, at its meeting of June 21, 1993, the Plan Commission unanimously recommended to the Village Board that the requested rezoning be granted; and WHEREAS, the Zoning Board of Appeals, at its meeting of July 6, 1993, unanimously recommended to the Village Board that the requested rezoning be granted and made certain findings of fact in support thereof as set forth in the Chairman of the Zoning Board's letter to the President and Board of Trustees dated July 27, 1993, all pursuant to due and appropriate legal notice; and WHEREAS, the Village President and Board of Trustees deem it in the best interest of the Village of Oak Brook that the property described herein be rezoned to B-3 General Business District; and WHEREAS, the Village President and Board of Trustees find that the rezoning of certain property as set forth below is in the best interest of the Village of Oak Brook: NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That the hereinafter described be and is hereby rezoned from ORA-1 Office Research Assembly to B-3 General Business District: That part of the Illinois Toll Highway Commission Parcel T-6A-139G situated in part of Section 27, Township 39 North, Range 11 East of the Third Principal Meridian in DuPage County, Illinois, described as follows: Commencing at the Northwest corner of the East half of the Northwest Quarter of said Section 27; thence South 0 115'12" West, a distance of 0.97 feet to the southerly right-of-way line of 22nd Street (extended across Midwest Road) ; thence North 89 044'13" East, a distance of 40.0 feet to a point of beginning; said point being the intersection of the southerly right-of-way line of 22nd Street and the easterly right-of-way line of Midwest Road; thence Ordinance 93-ZO-S-760 Rezoning a Parcel to the B-3 Zoning District 2001 22nd Street Page 2 continuing North 89°44'13" East along said southerly right-of-way line of 22nd Street, a distance of 1379.93 feet to a point; thence South 0°47112" West, 459.00 feet; thence South 89 031156" West, 452.83 feet to a line 135.0 feet North of and parallel with the center line of Illinois State Toll Road (I-88) ; thence North 89 025147" West, along said parallel line, 922.82 feet to said easterly right-of-way line of Midwest Road; thence North 0 015' 12" East along said easterly right-of-way line of Midwest Road a distance of 447.14 feet to the point of beginning, containing 14.416 acres, more or less. Permanent Parcel Nos. 06-27-103-012 and 06-27-103-013 Section 3: That the Village Clerk is hereby directed to amend the "Official Map of Zoning District of the Village of Oak Brook" in accordance with the provisions of Section 2 of this Ordinance. Section 4: That all ordinances of the Village of Oak Brook which are in conflict with the provisions of this ordinance are hereby repealed to the extent of such conflict and only as they apply to the specific properties hereinabove described. Section 5: That this ordinance shall be in full force and effect upon receipt by the Village Clerk of written proof satisfactory to the Village Attorney that title to all of the above described property has been recorded in the name of Costco Wholesale Corporation or its nominee, provided, however, that if such proof has not been so filed on or before February 24 , 1994, this ordinance shall be of no force or effect.
