S-777 - 07/12/1994 - SPECIAL USE - Ordinances y e ORDINANCE 94—ZO—SU—S-777 AN ORDINANCE GRANTING A SPECIAL USE FOR A NON—RESIDENTIAL, POST BACCALAUREATE SCHOOL (2625 BUTTERFIELD ROAD, OAK BROOK, IL) WHEREAS, an application has heretofore been filed for an amendment to Section X(B) (2) (f) of the Oak Brook Zoning Ordinance to allow as special uses in the ORA-1 Zone District non-residential, post baccalaureate schools, provided that not more than twenty percent (20%) of the course offerings may be prerequisite to admission to the post baccalaureate programs; and WHEREAS, pursuant to Ordinance 94-ZO-TA-G- 536 , the Village President and Board of Trustees of the Village of Oak Brook have amended the Zoning Ordinance of the Village of Oak Brook to incorporate the same as a Special Use in the ORA-1 Zone District; and WHEREAS, the Plan Commission of the Village of Oak Brook has submitted its report on the subject petition to the Zoning Board of Appeals and the President and Board of Trustees and has recommended the approval of the issuance of a Special Use Permit subject to certain conditions; and WHEREAS, a public hearing on such application has been conducted by the Zoning Board of Appeals of the Village on June 7, 1994 pursuant to due and appropriate legal notice, and said Board has submitted its report on the subject application to the President and Board of Trustees and has recommended approval of the amendment; and WHEREAS, the President and Board of Trustees have reviewed these recommendations and concur with the recommendations and deem the passage of this Ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That a Special Use Permit pursuant to the provisions of Section X(B) (2) (f) , as amended, be and is hereby granted for the use of a non- residential, post baccalaureate school, provided that not more than twenty percent (20%) of the course offerings may be prerequisite to admission to the post baccalaureate programs at property located at 2625 Butterfield Road, which property is legally described as follows: That part of Lot 1 in Butler Company - M-1 Inc. Assessment Plat No. 2 of part of the North half of Section 28, Township 39 North, Range 11, East of the Third Principal Meridian, DuPage County, Illinois, as per plat thereof recorded July 8, 1964 as Document No. R64-24069 described as follows: Ordinance 94-ZO-SU-S- 777 Granting a Special Use for Schools, Post Baccalaureate 2625 Butterfield Road Page 2 Commencing at the Northeast corner of said Lot 1; thence westerly along the Northerly line of said Lot 1, an arc-distance of 746.57 feet to the place of beginning; (said part of said Northerly line being a curved line, having a radius of 3719.83 feet, having a chord length of 745.32 feet and said chord having a bearing of South 79 degrees, 23'-13" West) ; thence South 16 degrees, 21'-45" East, a distance of 788.34 feet to a point on the Southerly line of said Lot 1; thence South 65 degrees, 27'-� 37" West along said Southerly line of said Lot 1, 481.92 feet; thence North 24 degrees, 32'-23" West at right angles to last described line, a distance of 817.57 feet to a point on the Northerly line of said Lot 1; thence Easterly along said Northerly line of said Lot 1, an arc-distance of 595.85 feet to the place of beginning, (said part of said Northerly line being a curved line, convex to the North, having a radius of 3719.83 feet and having a chord length of 595.22 feet and having a bearing of North 69 degrees, 02'-55" East) ; containing 10,000 acres. Permanent Parcel No. 06-28-202-017. Section 3: That the Special Use permit herein be granted specifically subject to the following conditions: 1. That said special use shall not exceed 12,000 square feet in floor area; 2. That activities are limited to classroom instruction, related educational programs, and administrative and support services. Non-academic activities are not permitted; and 3. That a minimum of 75% of the courses offered shall be taught in the evening and on weekends. Section 4: That this Ordinance is limited and restricted to the property located at 2625 Butterfield Road, Oak Brook, IL 60521. Section 5: That this ordinance shall be in full force and effect from and after passage and approval pursuant to law. PASSED THIS 12th day of July , 1994.
