S-782 - 09/13/1994 - VARIATION - Ordinances ORDINANCE 94-ZO-V-S 782 AN ORDINANCE AMENDING ORDINANCE S-748 EXTENDING THE EXPIRATION DATE OF THE VARIATION GRANTED THEREIN WHEREAS, the President and Board of Trustees of the Village of Oak Brook, by Ordinance S-748, granted to the property described therein a variation to the rules and regulations of the Zoning.Ordinance of the Village of Oak Brook subject to certain conditions and restrictions; and WHEREAS, said variation permits expansion of a non-conforming structure on the property, provided that construction is completed on or before July 26, 1994; and WHEREAS, the owner of the subject property has petitioned the President and Board of Trustees to extend the construction deadline by six months; and WHEREAS, the President and Board of Trustees of the Village of Oak Brook deem the passage of this Ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That Section 4(4) of Ordinance S-748 is hereby amended to read as follows: (4) That construction of the proposed expansion be completed on or before January 26, 1995. Section 3: That all other provisions of Ordinance S-748 are in full force and effect. Section 4: That all ordinances, rules and regulations of the Village of Oak Brook which are in conflict with the provisions of this ordinance are he property repealed to the extent of the conflict, and only as they apply to described in Section 2 of Ordinance S-748. Section 5: That if any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such determination shall not affect the validity of any remaining portion of this ordinance. Section 6: That this ordinance shall be in full force and effect from and after passage and approval pursuant to law. RECOMMENDATION - VARIATION REQUEST - ENLARGEMENT OF EXISTING NON- VARIATION CONFORMING STRUCTURE (2124 Oak Brook Road - Geralds 2124EST: Broo1 Trustee Winters stated there is no real value of said building Road-Geralds being restored to its original structure due to the bulk, that the structure would have little historical significance and would cause hardship to surrounding property owners due to bulk and, therefore, would deny the requested variation. Trustee Bartecki voiced a concern of a safety factor due to the proximity of the two crossroads and concurred with Trustee Winters to deny the request. President Bushy noted her approval of said variation due to the reasonable cooperation of the applicant and concurs with Director of Code Enforcement Hawk's recommendation. Trustee Skinner moved to approve the request of the variation of the enlargement of an existing non-conforming structure from 1170 square feet to approximately 1763 square feet subject to the following conditions: the required building permit be applied for within 6 months; work be initiated within 12 months and completed within 18 months of the date of the Ordinance; installation of a proper sanitary sewer system; and direct the Village Attorney to draft the necessary ordinance to effectuate same. REQUEST TO AUTHORIZE NEGOTIATION OF CONSULTANT CONTRACT - CONSULTANT AMERICANS WITH DISABILITIES ACT (ADA : CONTRACT On October 22, 1992, a committee composed of Trustee Payovich, Superintendent of Public Works Meranda, Village Engineer Durfey and Director of Code Enforcement Hawk interviewed the following firms who responded to our Request for Qualifications regarding our ADA Compliance Plan: Arcon Associates, Inc. , Lombard, IL Inc. , Oakbrook (estimated cost - $4,100) ; The BOloo°tol$25,000)P,and Interplan Terrace, IL (estimated cost - $ Practice, Ltd. , Oakbrook Terrace, IL (estimated cost - $7,900) . Permitting the rehabilitation of this property with the increased floor area will remove the principle detrimental effect this run down property represents for the immediate neighbors. Please see my previous memorandum regarding this issue (Page 42 of this file). The Zoning Board of Appeals at their December 1, 1992 meeting again reviewed this request and confirmed their original recommendation for approval by a vote of 4 to 1. Due to the condition of the existing structure and the small size of the lot, there is no perfect solution. If the structure is rehabilitated and used as a single family residence, many of the negative aspects of the property are minimized. If the property owner fails to repair the structure in the time frame agreed to, we will have to take action to require the repairs completed or to remove the building. Having established a posture of reasonable cooperation with the property owner will be helpful if it should become necessary to seek a demolition order. Also, please keep in mind that we must be careful in the application of the Zoning Ordinance to properties such as this in order to allow the property owner the ability to make reasonable use of the property, in this case, as a single-family residence. 33. Janu 6 , 1993 29 De shire Dr. TO:- Oak Brook Village Board of Trustees Subject : Mrs. Ardelle Geralds ' variation request , 2124 Oak Brook Road - The Old Rabbit Hill School Though on September 15 we wrote you of our fears pertaining to the possible approval of this variation, we would appreciate your taking another moment to review our rebuttals to Mrs. Geralds ' pleas : 1. She speaks of her desire to preserve the historical signif- icance of this structure as well as the interest of the His- torical Society in it , yet she has allowed it to fall into absolute disrepair since acquiring it in 1979. The Histor- ical Society's interest , if any, is puzzling since there would not be a shred of the original building remaining. In addition, the Historical Society makes it very clear they would put none of their money into project , so at best their interest is incidental. 2. Mrs. Geralds speaks of the taxes she pays. According to the "Doings" issue of September 25 , 1991 , the total assessed value of her building and land was $15 ,020 for 1991 , whereas the comparable total assessed value of our property for the same year was $120,880. Our home is the one that stands to lose value. She pays taxes but we pay eight times more ! 3. Mrs. Geralds says she wants to live there , yet has not done so since purchasing it in 1979. If she desires to live there she can, by simply repairing it and moving in - without enlarging. It did accommodate a whole school class at one time! : We seriously doubt she would ever live there , and can testify that without question she has not been good at sel- ecting quality tenants. 4. We do not believe truly caring parents would live in that house , even if it were enlarged. The lot is too small and too dangerous. Contrary to what she and her lawyer claim, it would not be in the interest of Oak Brook to allow the variation. There is too much likelihood that tenants drawn to it would be of questionable character and questionable activities as has been the case in the past , and this too we can testify to. We thank the Village Board for rejecting the variation request in the past. We deeply hope you will do so again. We tell you without exaggeration it has been a bad situation there , and one can only judge the future by the past. We fault ourselves that we somehow were unable to convey the seriousness of the condition to some members of the Village and Zoning Boards. We don't ob- ject to Mrs. Geralds rehabilitating; we know that is her right , but she knew the restrictions when she bought the property. She should live up to them. We welcome you to visit us , see for yourselves the situation as it is and the possibilities fhat exist , and put yourselves momentarily into our shoes. Thanks 3� again. We have previously told you, verbally and by letter.-of our very uncomfortable life and anxiety throughout the period of time this cottage was occupied, because of questionable activities in such proximity to our home. This dilapitated structure is practically in our back yard. You members of the board decided though to grant the varia- tion, and we had to conclude that we did not properly present our case or you did not believe us. We did, and are now telling the truth, and it is difficult to understand how you, as neighbors, could put yourselves into our shoes, which I think would be a normal thought process in making these judg- ments, and yet approve the variation. If, as _the owner declares , this is a historical building worth preserving, how could she have allowed it to fall into such disrepair? It has to be almost completely demol- ished, so :what will be left that is historically significant? She states she is ,paying taxes , implying this entitles her to the variation. But what about our taxes? The total assessed valuation of that cottage for 1991 was $15 ,020; our total was $120,880. Would we really devalue a $120,880 home for the sake of a $15 ,020 one? She claims she wants to live there , but hasn't since purchasing it in 19799 and her history of selecting tenants is not good. There is no guarantee that tenants will not live there again; Do we not have rights too? And the right to live under decent condi- tions? We are not objecting to her renovating this cottage ; we are objecting to enlarging it. We know the problems by experience with the cottage in the past. The lot is too small for a family of any size - the problems have to spill over into our yard and home, The owner knew the rules when she bought the cottage; We have done nothing wrong. Shouldn't people live up to agreements they make? We deserve consideration. We are real taxpayers. We urge you to put yourselves into our shoes. Come and see the configuration here if you have not done so. and ask yourselves whether you would approve the variation if you lived in . our home. Thank you. The school was attended by area school children since 1848. In 1860. the building burned to the ground and the present structure was built. The children attend- ing classes there numbered about 17 to 20 in class size. The building has fallen int¢disrepair and the widening of Oak Brook Road has taken much of the property. The present owner has decided to renovate and occupy the building. The Oak Brook Historical Society supports her efforts to restore the build- ing and the property. The Zoning Board of Appeals, at its regular meeting of October 6, 1992, voted (5 to 1) to recommend approval of this request subject to an 18 month, completion schedule. Following are several key elements pertaining to this issue. 1. The building was the Rabbit Hill School and it dates from the turn of the century. 2. According to Audrey Muschler, the Historical Society does not have any interest in this structure due to its condition. 3. It has been in use as a residence for many years but has been vacant for the last few years. 4. The owner wishes to rehabilitate it and increase the habitable floor area. 5. The property was isolated with the development of Brook Forest and was reduced in size by land takings for Oak Brook Road and Midwest Road. 6. The building condition is so deteriorated that if it isn't repaired soon, we will have to take action to force its removal. 7. As a non-conforming structure both repairs and alterations are permissible as long as any enlargements comply with the ordinance. The entire structure falls within required yards. There is no buildable area on this lot. The owner wishes to rehabilitate the building and add a partial 2nd level to make it more viable as a single family home. We presented our variation objections at the :iZ oning Board of Appeals September 1 meeting, and desire to similarly convey them to you via this letter because we will shortly be spending time with family in Upper Michigan, and while we hope this variation request will clever come up before you, it might while we are away. We are senior citizens and we recognize the danger of being dubbed "old fogies" in this matter, but we are not. We readily accept neighbors' normal back yard cookouts, games, etc , and we do our own share also, We are only asking, for good reason; that the owners of this cottage comply with what we were told by the now retired Fire/Building Commissioner in 1984, that the cottage could never be enlarged; that it could be repaired, but must remain arc ii ecturally unchanged. The owners say they pur- chased the cottage in 1979, so they had to be aware then of what the 1965 covenant stated , and they should not be allowed now to deviate at our expense. This cottage is not located in the same configuration as other homes here. Its north wall becomes a sounding board for all kiridd of noises and grill smoke that reverberates back into our home. We know, because we lived through it when there was just one tenant there. Now they want to add bedrooms and who knows how many people wind up there? And who knows what type of people would live there? We got a taste of this too and without burdening you with details can say it was not a good experience. We don't exaggerate when we say that after we moved in in 1984 is transformed our house into an attractive , well kept home , one Brook Foresters can look on with pleasure , and we did most of it through our own efforts. We know what prospective buyers of homes adjacent to this cot- tage ask about it , and they are given all kinds of inaccurate answers by realtors, which is not the village 's fault, but we asked the Building Commissioner directly, in his office , face to face , both of us, and he gave us the assurance mentioned. To permit this variation is tantamount to approving deprecia- tion of property owned by us, decent citizens of Oak Brook, in favor of a non-Oak Brook owner of a non-conforming, low value cottage that is practically yardless and completely out of sync with the rest of the area. Susan Johnson, President of the Park District, stated that the County had asked the Park District if they would consider responsibility for the buildings. As there has not been a Park Board meeting since the request was made, the Commissioners had not yet investigated the details thoroughly, but preliminary informal talk among the commissioners indicated they were not opposed to such a suggestion. She also noted that the configuration of the proposed buildings did not allow for parks as is the practice of new residential developments. Resident Nora Jackson, as well as resident Dorothy Dean Cavenaugh, urged the board to keep the open space for now and in the future. Additional support was given by resident Robert .Antoniolli, who is an intern architect. Resident Bob Waite urged the board to give the Nov. 3 referendum a chance and to not make a decision until after the referendum. Audrey Muschler then read a portion of a letter from Mr. Turner, Regional Director of the National Trust for Historic Preservation regarding legal cases in similar instances. She further noted that if the development would be allowed, it would have a substantial impact on the Village's. water allotment,-:schools, etc. She also encouraged the board not to act on berms until after the referendum. Resident Howard Trier spoke as a resident and pyschologist, and stated his views that open space should be preserved. He opposes berms as they tend to "close up" a community and take away open relaxation areas that are valuable to society. Concern over a small portion of land between Trinity Lakes and Mayslake was voiced by Ron Cullum, Trinity Lakes Homeowners Association. The land, referred to as "the grotto" is only accessible through Mayslake but contains a dam that is vital to Trinity Lakes. He also noted that the proposed - development did not come about as a "hardship", one of the criteria for granting a variation. At this point, with no other audience members wishing to speak, Member Davis made a motion, seconded by Member Shah to table this matter to the next Zoning Board meeting, at which time the developer, Tom Shannon, will have a chance to present his proposal and to answer the concerns raised at this meeting. III WOo VARIATION - 38 Devonshire Drive, rear yard variation Mr. Mike Campbell, Normandy Builders, presented Mrs. Woo's request for the variation to allow the Woo family to construct a 2 story addition to the rear of their home. Because of the angled rear yard, they are not able to enlarge their kitchen area, and maintain the required 40 ft. setback. The board agreed that such a variation would not alter the character of the neighborhood and would help the homeowner get a reasonable return on their property. It is adjacent to, but not part of, Brook Forest. Originally built as a schoolhouse, it has been a single family residence since the 1920's. The present owner seeks to renovate and reconstruct the residence. However, due to the present disrepair of the home, Zoning Board members were concerned that little could be saved and questioned whether this would be a renovation or entirely new home that was being requested. Other questions arose as to sanitary sewer and water connections, the use of a "catwalk" to join the home to a coachhouse, and the actual height of structure being requested. Because of the incomplete proposal and presentation by Mrs. Gerald, Member Shah made, and Member Martis seconded, a motion to table this matter until the next meeting so that Mrs. Gerald could return with more definite plans. We moved into our home in 1984 and have devoted our retire- ment lives, including our personal labor and resources to constant improvement of our property so that today we have a very attractive home and surroundings, of which we are proud, and at which we believe our neighbors can look with satisfaction. We have always minded our own business. But at this point we are compelled to make it our business to let it be known we strenously object to approval of the above variation, and for good reasons. We were assured by the previous owners of our home, and we had it confirmed to both of us face to face by the Fire Commissioner/Building Commissioner at that time , now retired, that this cottage , by covenant, could never be altered; that repairs could be made but the basic design must be kept intact. At the time we occupied our new home a young man lived in the cottage, and we optimistically assumed one person could hardly present a problem, and there seemed to be insufficient space for much more than one person. How little we knew ! Our only pleasant days living here have been since he moved out. We need not go into the more sordid details, but we certainly learned the imperative need for space between homes, which is precisely what makes Oak Brook a desireable location. This cottagg is certainly not in keeping with the Oak Brook standards, nor would it be with the proposed improvements. The cottage is on our flank and has an absolutely minimum yard space, all of which is on our side of the cottage. The what seemed to be toxious smoke from the young tenant's grill, the noise from his late night get-togethers, the odors from chemicals he used in preparing commercial signs, and large ones, all done in the "yard" , bounced off the background (the northern wall of the cottage) into our rooms. L EIVE14G 1 � NI 0 -2- As an "aside" I can state the Oak Brook policewoman was not sympathetic. And now they want to enlarge the cottage to accommodate more tenants! The outdoor space there is not adequate. We buy homes in Oak Brook to get some space , pleasant living space which this variation would take away from us. The owners of this cottage, if we were given accurate in- formation by the Building Commissioner, have known about the restricting covenant for years. We can't imagine the Village of Oak Brook prolonging the mistake made years ago when this piece of non-conforming property was demarcated. Approval of this variation and non-conformity will lead to depreciation in the value of property in Lots 162 and 163 placing the village in the position of supporting a non- Oak Brook owner of a subpar, non-conforming cottage of relatively low value against two solid, conforming Oak Brook families who we believe are assets to the community, and who have very substantiA-1 investments here. Village water service is available as per Mike Meranda' s May 8, 1992 letter. 2. Sanitary sewer service presents somewhat of a problem. The closest Hinsdale Sanitary District sewer line is on Midwest Road approximately 1,000 feet north of 31st Street . This would be a long run to service a single building. The cost factors alone may render it economically unfeasible. Mrs. Geralds states in her June 19th submittal letter that a chemical sewer system could be augmented to service this residence. As I am presently unfamiliar with that type of a system, it would have to be reviewed pending formal submittal of all required documentation. Section V ( I )(2) of the Zoning Ordinance provides for such relief. It appears that Section V ( I ) (4) might also apply to this site. A further variation from this provision may be required. 3. I question whether or not this parcel is a lot of record. In this regard, I am confused by the Plat of Survey submitted which shows that this property entails the south ten ( 10' ) feet of Lot 163 and west ten ( 10' ) feet of Lot 162 of the Brook Forest Subdivision. I question if these ten ( 10' ) foot strips had a transfer of title and what documents transferred title. An Assessment Plat may be required depending upon the answers to these questions. 4. Mrs. Geralds in her letter mentions an attached letter from the DuPage County Department of Transportation. That letter was not attached to my packet and I would like a copy of same. ;.1 s � 5. Mrs. Geralds mentions a severe incline for the driveway serving this property. In viewing the site, the driveway incline is more than one would desire, but is useable. Prior to any construction activity, the grades should be designed to insure that vehicles do not "bottom out" upon entering or exiting the street or garage. 6. The Zoning Board of Appeals shall hold public hearings upon all applica- tions for variations and shall report its recommenda- tions to the Board of Trustees as to whether a requested variation would be in harmony with its gen- eral purpose and intent, and shall recommend a varia- tion only where it shall have made a finding of fact specifying the reason or reasons for recommending the variations. Such findings shall be based upon the stand- ards prescribed in Section XIII G-4 of this ordinance. No variation shall be granted by the Board of Trustees without such findings of fact. In the case of a variation where the Zoning Board of Appeals fails to recommend the variation, it can only be adopted by an ordinance with the favorable vote of two-thirds of the Trustees. (2) Initiation: An application for a variation shall be in triplicate and may be made by any governmental 966 APPENDIX A—ZONING Sea XIII office, department, board, bureau or commission, or by any person, firm or corporation having a freehold interest, a possessory interest entitled to exclusive possession, a contractual interest which may become a freehold interest, or any exclusive possessory interest applicable to the land or land and improvements described in the application for a variation. (3) Processing: An application for a variation shall be filed with the Village Clerk who shall forward one copy of such application to the Zoning Board of Appeals for processing in accordance with applicable Statutes of the State of Illinois and one copy to the Board of Trustees. (4) Standards: (a) The Zoning Board of Appeals shall not recom- mend a variation of the provisions of this ordinance as authorized in this section unless it shall have made findings of fact based upon the evidence presented to it on the following specific issues that: (1) The property in question cannot yield a reasonable return if permitted to be used only under the conditions allowed by the regula- tions governing the district in which it is located. (2) The plight of the owner is due to unique circumstances. (3) The variation, if granted, will not alter the essential character of the locality. (b) For the purpose of supplementing the above standards, the Zoning Board of Appeals, in making the. determination whether there are practical difficulties or particular hardships, shall also take into consideration the extent to which the following facts, favorable to the applicant, have been established by the evidence that: 967 Sec.XIII OAK BROOK CODE (1) The particular physical surroundings, shape, or topographical conditions of the specific property involved would bring a particular hardship upon the owner as distinguished from a mere inconvenience if the strict letter of the regulation were to be carried out. (2) The condition upon which the petition for variation is based would not be applicable generally to the other property within the same zoning classification. (3) The granting of the variation will not be detrimental to the public welfare or injurious - to other property or improvements in the neighborhood in which the property is lo- cated. (4) The proposed variation will not impair an adequate supply of light and air to adjacent property, or substantially increase the danger of fire, or otherwise endanger the public safety or substantially diminish or impair property values within the neighborhood. (5) That the purpose of the variation is not based exclusively upon a desire to make more money out of the property. (6) That the alleged difficulty or hardship has not been created by any person presently having an interest in the property. (c) The Zoning Board of Appeals may recommend and the Board of Trustees may require such conditions and restrictions upon the premises benefited by a variation as may be necessary to comply with the standards set forth in this section to reduce or minimize the injurious effect of such variation upon other property in the neighbor- hood, and to implement the general purpose and intent of this ordinance. A variation in zoning requirements is requested to relieve hardships and unique circumstances involved in restoration of the property at 2124 Oak Brook Rd. , Oak Brook, Ill. The property, which is one of the few structures existent of the Village history, is recognized as the Rabbit Hill School and a residence for many years. (See "As Built" submitted. ) Due to location and community development, the property has been cut back many times by highway development as progress was induced by forfeiting its boundaries and pre-existing conditions. In upgrading the living area and comprising a far superior residence, the addition of a second floor and dormer, the necessitated reconstruction of the foundation and for basement use, and dormer additions to the coach house to provide light and for utilization of a second floor cat walk (for easy access from the loft of the main residence) , and functional purpose providing space that is greatly needed, the property will closer comply with Village code. The footprint of the two buildings remains basically the same with minor differences. With the removal of the shed (for drive-thru facilitation) there is a decreased building lot coverage. A chemical sewer system could be augmented, as has been the case in Oak Brook and for less in installed cost since no obvious sewer hook-up has been facilitated. The attached letter from the DuPage County Dept. of Transportation shows authorization of a sewer connection on Midwest Road in the event no other closer or more feasible exposure is granted. A request for a drive-through coach house for a turn-around is a facility necessary to accommodate a severe incline induced by the cutback of the road and an access drive adjacent to the east of the coach house for exiting and entering a heavy traffic area to Oak Brook Road (31st Street) . The property at this address cannot yield a reasonable return as restricted as it presently is.
