S-783 - 09/13/1994 - SPECIAL USE - Ordinances ORDINANCE 94-z0-SU-S-783 AN ORDINANCE APPROVING THIRD AMENDMENT TO ORDINANCE S-301 AND GRANTING AN AMENDED SPECIAL USE PERMIT (OAK BROOK CHRISTIAN CENTER, 3100 MIDWEST ROAD) WHEREAS, on April 23, 1974, the corporate authorities of the Village of Oak Brook passed Ordinance S-301, which approved a special use for the construction and operation of a "church and school of Oak Brook Centre Church" known as Lot 1 of the Oak Brook Christian Church Subdivision hereinafter described; and WHEREAS, on October 26, 1976, the corporate authorities, upon the recommendation of the Plan Commission, approved the final site plan subject to the conditions that the existing frame building on the property be razed not later than 24 months from the issuance of an occupancy permit and that the site plan contain a note prohibiting overnight parking of buses; and WHEREAS, upon the recommendation of the Plan Commission, on May 8, 1984, the corporate authorities of the Village of Oak Brook passed Ordinance S-527 (First Amendment) which amended Ordinance S-301 by requiring construction pursuant to a modified site plan and extending the deadline for demolition of the existing frame house at the northeast corner of the subject property to June 1, 1986; and WHEREAS, pursuant to Ordinance S-606 passed on May 12, 1987 (Second Amendment) , the corporate authorities, again extended the time period for razing of the existing house on the subject property to no later than January 1, 1988 and reconfirmed compliance with the 1984 site plan; WHEREAS, in its application dated April 15, 1994, the Oak Brook Christian Center, has asked for approval of a revised site plan with a different building configuration than the previously approved plan and extension of the parking area into the south area of the property; and WHEREAS, the Plan Commission on July 18, 1994 recommended approval of the Special Use Amendment to revise the approved site plan subject to certain conditions; and WHEREAS, a public hearing thereon was conducted by the Zoning Board of Appeals of the Village of Oak Brook on August 2, 1994, pursuant to due and appropriate legal notice; and WHEREAS, a recommendation has been made by both the said Zoning Board of Appeals and Plan Commission that the amendment to special use be granted; and WHEREAS, the President and Board of Trustees concur with the recommendations of the Zoning Board of Appeals and Plan Commission and deem the passage of this ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook, subject to the conditions and restrictions set forth below; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Ordinance 94-ZO-SU-S-783 Approving Third Amendment to S-301 and Granting an Amended Special Use 3100 Midwest Road Page 2 Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That Section 1 of Ordinance No. 5-301, as amended by Ordinances Nos. 5-527 and 5-606 be and are hereby further amended to read as follows: That a special use permit be and hereby is granted for the construction and operation of a "church and school of Oak Brook Centre Church", subject to the following conditions and restrictions: A. That the site shall be developed in substantial conformance with the following plans: 1. Preliminary Site Plan drawn by Roake and Associates, Naperville, IL, dated July 21, 1994. 2. The landscaping plan as submitted on July 28, 1994. 3. The Parking Lot Lighting Plan as prepared by Rudd Lighting and as submitted with the petition. B. That all berms and landscaping, including those adjacent to the Phase II area, shall be constructed at the same time as the initial parking area expansion. C. That all required landscaping shall be maintained indefinitely. Any plantings which are not successful or which subsequently do not survive, shall be replaced. D. That the existing parking lot lighting shall be adjusted to prevent light spillage off site and to reduce as much as possible the visibility of the sources of illumination from off site. The existing and future lights shall be turned off when the parking areas are not in use. E. That the parking area identified as Phase II on the site plan is not included in this approval. The parking provided in Phase II is not necessary to meet the ordinance parking requirements. If, upon completion of the balance of the site, the actual parking needs warrant the construction of these additional spaces, the petitioner shall apply for an amendment to their site plan approval. Section 3: That this Ordinance is limited and restricted to the property located at Lot 1 in Oak Brook Christian Center Subdivision, being a subdivi- sion in the Northwest Quarter of Section 34, Township 39 North, Range 11 East of the Third Principal Meridian, according to the plat thereof recorded February 25, 1977 as Document No. Ordinance 94-ZO-SU-S-783 Approving Third Amendment to 5-301 and Granting an Amended Special Use 3100 Midwest Road Page 3 R-77-073099, all in DuPage County, IL Permanent Parcel No. 06-34-100-008. Section 4: That this ordinance shall be in full force and effect from and after passage and approval pursuant to law. PASSED THIS 13th day of September, 1994.
