S-791 - 12/19/1994 - SPECIAL USE - Ordinances ORDINANCE 94-ZO-S-791 AN ORDINANCE AMENDING ORDINANCE G-342 RELATIVE TO A SPECIAL USE PERMIT OAK BROOK PARK DISTRICT (1300-1500 Forest Gate Road) WHEREAS, on February 14, 1984, the Board of Trustees of the Village of Oak Brook passed Ordinance G-342, which rezoned certain property and granted the following special use in Section 5 of the ordinance: Section 5: That a special use is hereby granted to the Oak Brook Park District, a unit of local government, under the provisions of Section VIA(2) (d) of Ordinance No. G-60, the Zoning Ordinance of the Village of Oak Brook, to permit the use of Parcel No. 3 (Central Park) legally described in Section i(C) above, as a governmental service facility; and WHEREAS, the Oak Brook Park District filed an application requesting an amendment to the foregoing special use to permit construction of a Family Recreation/Administration Center in Central Park; and WHEREAS, at its meeting of October 17, 1994, the Plan Commission unanimously recommended to the Village Board that the requested amendment to the special use be granted, subject to certain conditions; and WHEREAS, the Zoning Board of Appeals, at its meeting of November 1, 1994, unanimously recommended to the Village Board that the requested amendment to the special use be granted, subject to certain conditions and restrictions, and made certain findings of fact in support thereof as set forth in the Chairman of the Zoning Board's letter to the President and Board of Trustees dated November 16, 1994, all pursuant to due and appropriate legal notice; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That the Village President and Board of Trustees deem it in the best interest of the Village of Oak Brook that Section 5 of Ordinance G- 342 be amended to read as follows: Ordinance 94-ZO-S-791 Relative to a Special Use Amendment 1300-1500 Forest Gate Road Page 2 Section 5: That a special use is hereby granted to the Oak Brook Park District, a unit of local government, under the provisions of Section VIA(2) (d) of Ordinance No. G-60, the Zoning Ordinance of the Village of Oak Brook, to permit the use of Parcel No. 3 (Central Park) legally described in Section 1(C) above, as a governmental service facility, including a Family Recreation/Administration Center, subject to the following conditions and restrictions: 1. That the Recreation/Administration Center shall be constructed in substantial conformity with the revised site plan, floor plan and elevations submitted by Smith & Stephens Architects, Inc. dated, as last revised October 25, 1994 and consisting of a total of three sheets; 2. That the Recreation/Administration Center shall be developed in accordance with all other applicable local, state and federal regulations including building codes and stormwater management regulations; and 3. That the Park District shall provide sufficient parking in Central Park for all Park District activities. Section 3 : That all other provisions of Ordinance G-342 are and shall remain in full force and effect. Section 4: That this ordinance shall be in full force and effect from and after passage and approval pursuant to law. PASSED THIS 19th day of December, 1994.
