S-800 - 03/14/1995 - SPECIAL USE - Ordinances ORDINANCE 95-ZO-SU-EXI-S-800 AN ORDINANCE AMENDING ORDINANCE S-693, GRANTING A SPECIAL USE PERMIT FOR A HELIPORT Reed Elsevier Inc. 2000 Clearwater Drive, Oak Brook, IL WHEREAS, Ordinance S-693, granting a special use to Official Airline Guides, Inc. for a heliport for as long as Official Airline Guides occupied the property, was passed and approved June 12, 1990, with certain conditions, a copy of this ordinance is attached hereto as Exhibit A; and WHEREAS, the corporate ownership of the property located at 2000 Clearwater Drive has changed; and WHEREAS, Reed Elsevier Inc. , the new corporate owner of the subject property, requests that all reference to Official Airline Guides, Inc. be changed in Ordinance S-693 to reflect the correct corporate ownership, Reed Elsevier Inc. ; and WHEREAS, Reed Elsevier Inc. , the new corporate owner of the subject property, further requests that its corporate neighbor, ChicagoLand Television News, Inc. , also be permitted to use the existing heliport; and WHEREAS, accordingly, Reed Elsevier Inc. has proposed an amendment to Section X(B) (2) (a) (8) of the Zoning Ordinance which would permit occupants adjacent to a heliport to use the heliport when authorized by the Village Board after notice and hearing; and WHEREAS, the Village Board has passed Ordinance 95-HE-G-553 which amends Section X(B) (2) (a) (8) of the Zoning Ordinance as requested by Reed Elsevier Inc. ; and WHEREAS, the Plan Commission of the Village of Oak Brook has submitted its report on the subject petition to the President and Board of Trustees and recommended approval of the requested amendment to Ordinance S-693; and WHEREAS, a public hearing on the application has been conducted on February 7, 1995 by the Zoning Board of Appeals of the Village of Oak Brook pursuant to due and appropriate legal notice; and WHEREAS, a recommendation was made by the said Zoning Board of Appeals that the requested amendment to Ordinance S-693 be granted; and WHEREAS, the President and Board of Trustees have reviewed these recommendations and concur with the recommendation of the Zoning Board of Appeals and deem the passage of this Ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Ordinance 95-ZO-SU-EXI-S-800 Amending S-693, Granting a Special Use Permit Page 2 Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That all references to "Official Airline Guides" in Ordinance S-693 are changed to "Reed Elsevier Inc." Section 3: That Sections 3.F. and 3.G. of Ordinance S-693 are amended to read as follows: 3'.F. "Except for the provisions of subparagraph D, only helicopters owned or leased by Reed Elsevier Inc. may utilize the heliport, and only so long as Reed Elsevier Inc. is occupying the property, provided, however, pursuant to agreement between Reed Elsevier Inc. and ChicagoLand Television News the latter may utilize the heliport so long as ChicagoLand Television News is occupying property adjacent to the property and complies with all other conditions and terms of this Ordinance. 3.G. Reed Elsevier Inc. and ChicagoLand Television shall maintain appropriate and sufficient insurance coverage relative to the installation and use of said heliport, insuring against any property damage or personal injury arising therefrom with policy limits of not less than twenty million dollars ($20,000,000.00) ." Section 4: That, except as modified above, all provisions of Ordinance S-693 are and shall remain in full force and effect. Section 5: That this ordinance shall be in full force and effect from and after passage and approval pursuant to law. PASSED THIS 14th day of March, 1995. Address: 2000 Clearwater Drive Oak Brook, IL 60521 PIN 06-24-307-022 EXHIBIT A ORDINANCE S- 693 AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR A HELIPORT Official Airline Guides, Inc_ 2000 Clearwater Drive WHEREAS, the applicant was previously granted a Special Use for a heliport pursuant to Ordinance S-673, passed and approved June 13, 1989; and WHEREAS, said Ordinance provided that the Special Use granted shall be for a 1 year period ending June 13, 1990; and WHEREAS, the applicant has requested an extension of such Special Use; and WHEREAS, the Plan Commission of the Village of Oak Brook has submitted its report on the subject petition to the Zoning Board of Appeals and the President and Board of Trustees and recommended approval of the Special Use of the heliport; and WHEREAS, a public hearing on the application has been conducted on May 1, 1990 by the Zoning Board of Appeals of the Village of Oak Brook pursuant to due and appropriate legal notice; and WHEREAS, a recommendation was made by the said Zoning Board of Appeals that the Special Use requested be granted; and WHEREAS, the President and Board of Trustees have reviewed these recommendations and concur with the recommendation of the Zoning Board of Appeals and deem the passage of this Ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That a Special Use permit is hereby granted to the property described in Section 4 hereof to permit a heliport pursuant to Section X(B)(2)(a) of the Zoning Ordinance of the Village of Oak Brook. Section 3: That the Special Use permit herein granted pursuant to Section 2 of this Ordinance is expressly subject to compliance with the following conditions: A. Approach routes shall be limited to those depicted in the attached Exhibit A. C. Helicopters utilizing this heliport shall fly at-the maximum safe level prior to entering the approach pattern to the heliport. D. Use of the heliport be made available to the Village of Oak Brook or its designees in the event of emergencies. E. The location of the heliport shall be limited to that area as depicted on the attached Exhibit B. F. Except for the provisions of subparagraph D, only helicopters owned or leased by Official Airline Guides may utilize the heliport, and only so long as Official Airline Guides is occupying the property. G. Official Airline Guides shall maintain appropriate and sufficient insurance coverage relative to the installation and use of said heliport insuring against any property damage or personal injury arising there from with policy limits of not less than $20,000,000. H. Only the Bell 206-L Jet Ranger, seven-passenger helicopter, or a substantially similar type helicopter may utilize the heliport. I. A log of usage shall be submitted to the Village on a monthly basis.. J. Operation of the heliport shall at all times be in conformance with the provisions of Section X(B)(2)(a) of the Zoning Ordinance of the Village of Oak Brook including any and all amendments thereto. Section 4: This Ordinance is limited and restricted to the property located at 2000 Clearwater Drive, Oak Brook, Illinois as legally described as follows: Lot 1 in Official Airline Guides Resubdivision, being a Resubdivision in the Southwest Quarter of Section 24, Township 39 North, Range 11, East of the Third Principal Meridian, according to the plat thereof recorded July 15, 1985 as Document R85-55758, in DuPage County, Illinois. Permanent Parcel #06-24-307-022. Section 5: That this Ordinance shall be in full force and effect from and after passage and approval as provided by law.
