AN ORDINANCE AMENDING AN ORDINANCE
GRANTING A SPECIAL USE PERMIT FOR CERTAIN WORK AND CONSTRUCTION
WITHIN THE FLOOD PLAIN PURSUANT TO SECTION 10-34
OF THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK
(15 Yorkshire Woods)
WHEREAS, by Ordinance S-733 adopted on March 24, 1992, the President and
Board of Trustees of the Village of Oak Brook granted a Flood Plain Special
Use Permit for the property at 15 Yorkshire Woods, subject to certain
conditions; and
WHEREAS, one condition of the special use permit was that all work be
completed prior to December 31, 1995; and
WHEREAS, the applicant has requested that the Village Board extend the
date for completion of a flood protection system three years to December 31,
1998; and
WHEREAS, it is in the best interest of the Village of Oak Brook that the
extension requested by the applicant be granted;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That Section 4 of Ordinance S-733 entitled, "An Ordinance
Granting a Flood Plain Special Use Permit Pursuant to Section 10-34 of the
Code of Ordinances of the Village of Oak Brook, Illinois (15 Yorkshire Woods)"
passed by the corporate authorities on March 24, 1992 is amended to read as
follows:
"Section 4: That the special use permit herein granted in Section
2 of this ordinance be further expressly subject to the condition
that all land modifications on the subject property be completed
on or before December 31, 1998, in substantial conformity with the
aforementioned Site Plan. If the property owner fails to meet the
conditions of this section, this special use permit shall
automatically terminate and be of no further force or effect. The
foregoing completion date may be extended without public hearings
by the President and Board of Trustees upon a showing of necessity
by the property owner."
Section 3: That all other provisions of Ordinance S-733 are and shall
remain in full force and effect.

Section 4: That this Ordinance is limited and restricted to the
property located at 15 Yorkshire Woods.
Section 5: That this ordinance shall be in full force and effect from
and after passage and approval pursuant to law.
