Tom Hawk, Director of Code Enforceme SUBJECT: Zoning Board of Appeals Recommendation Calinog-34 Royal Vale Drive Variation - Front Yard Setback Reduce From Forty Feet to Twenty-Seven Feet The Zoning Board of Appeals at their meeting on May 7, 1996, held the necessary Public Hearing regarding the request. Most of the nearby neighbors have indicated their support along with the Architectural Review Committee of the Ginger Creek Community Association. There have been no opposition comments. Please see my memo of April 23, 1996(page 8 of this file)for a more complete description of the proposal. The Zoning Board of Appeals, by a vote of 6 to 0 passed a motion recommending approval of the variation as requested. I If it is your wish to proceed toward approval of this variation, it would be appropriate to pass a voice motion authorizing Attorney Martens to draft an Ordinance for final action at your meeting on June 11, 1996. President Bushy and Board of Trustees Village of Oak Brook 1200 Oak Brook Road Oak Brook, I L 60521 RE: Calinog 34 Royal Vale Drive-Variation - Front Yard Setback Dear President Bushy and Board of Trustees: The Zoning Board of Appeals at their meeting on May 7, 1996, held the required Public Hearing for the Calinog request for a front yard variation to allow construction of an entryway vestibule and canopy which will encroach approximately thirteen feet into the required front yard. Mr. & Mrs. Mariani,33 Royal Vale Drive,who are the neighbors directly across the street from the Calinog's spoke in support of the proposal. There was no public testimony in opposition. Mr. Calinog testified as follows: 1. That the existing nonconforming front setback represented a hardship. 2. That the proposed addition will allow the home to be architecturally current and maintain property values. 3. That due to the size, appearance,and location of the encroachment there are no detrimental effects to the neighbors. The consensus of the Zoning Board of Appeals was in agreement with the above and a motion to recommend approval was passed by a vote of 6 to 0. CALINOG -34 ROYAL VALE DRIVE- VARIATION- FRONT YARD SETBACK Mr. Calinog said that they have lived in the house for 25 years and it is about 30 years old. It really needs updating and remodeling. The remodeling will include a canopy foyer in the front of the house that will be about seven (7') feet from the front building line. This will not be living space, but a foyer and an entrance canopy supported by columns. This is the main issue of the variation request. The street in front of the house curves toward the house. The previous survey showed a 40-foot setback and the present survey shows a 38-foot setback. He believes the change will improve the house and will attract natural lighting. Acting Chairman Aldini questioned if the improvement will enhance the appearance of the property or appreciate the property. Calinog acknowledged that it will not only enhance the house, but it will also enhance the neighborhood. He said that he has talked to his neighbors and no one objected to the plan. The following persons spoke in favor of the variation request, as follows: 1. Bob Mariani resides at 33 Royal Vale, across the street from Calinog. He has lived there for ten years and believes what they propose to do will enhance the neighborhood. There has been quite a bit of remodeling in the neighborhood and this will fit it. 2. Kurt Cook, Vice-President of Operations for Reliable Home Improvement, said that they are basically squaring off the front of his home with an enclosure. The part that will jut out is just a covered walkway. He said he drove through Ginger Creek extensively looking for other types of additions that were similar and a lot of homes did have these types of covered canopies. They have tried to make it look like a natural part of the house and not something just added on. No one spoke in opposition to the request. Member Hasen moved, seconded by Member Shah to recommend approval of the variation to reduce the front setback to 27 feet to allow construction of an entrance vestibule and canopy in substantial conformance with the plans submitted with this petition (see pages G & H of this file). This motion is based on the following findings: 1. The existing front setback represents a unique situation and hardship for the property owner. 2. The addition will better allow the owner to maintain his property value and investment return. 3. There are no detrimental effects to the public health and welfare. The Zoning Ordinance requires a front yard setback of forty feet for the main structure and allows canopies to project into the front yard a distance of three feet. The home was constructed in 1964/65 and encroaches approximately three feet into the required front yard and is illegal nonconforming with respect to the front yard requirement. I have no explanation for how this took place. It could have happened in any number of ways. The area of the vestibule encroachment is approximately thirty-six feet and the area of the canopy encroachment is approximately one hundred twenty square feet. The area of the front yard is in excess of 6000 square feet. The depth and area of the proposed encroachment does not constitute a significant loss of open space or building separation. However, the same arguments can be made for many of the existing homes in Oak Brook where the owners may want to enhance and update their front entry ways. TRH/gp cc: Petition files O. Authority: The Board of Trustees shall decide all applications for variations of the provisions of this ordinance after a public hearing held before the Zoning Board of Appeals on such notice as shall be required by the Illinois Statutes. The Zoning Board of Appeals shall hold public hearings upon all applica- tions for variations and shall report its recommenda- tions to the Board of Trustees as to whether a requested variation would be in harmony with its gen- eral purpose and intent, and shall recommend a varia- tion only where it shall have made a finding of fact specifying the reason or reasons for recommending the variations. Such findings shall be based upon the stand- ards prescribed in Section XIII G-4 of this ordinance. No variation shall be granted by the Board of Trustees . without such findings of fact. In the case of a variation where the Zoning Board of Appeals fails to recommend the variation, it can only be adopted by an ordinance with the favorable vote of two-thirds of the Trustees. (4) Standards: (a) The Zoning Board of Appeals shall not recom- mend a variation of the provisions of this ordinance as authorized in this section unless it shall have made findings of fact based upon the evidence presented to it on the following specific issues that: (1) The property in question cannot yield a reasonable return if permitted to be used only under the conditions allowed by the regula- tions governing the district in which it is located. (2) The plight of the owner is due to unique circumstances. (4) The proposed variation will not impair an adequate supply of light and air to adjacent property, or substantially increase the danger of fire, or otherwise endanger the public safety or substantially diminish or impair property values within the neighborhood. (5) That the purpose of the variation is not based exclusively upon a desire to make more money out of the property. (6) That the alleged difficulty or hardship has not been created by any person presently having an interest in the property. (c) The Zoning Board of Appeals may recommend and the Board of Trustees may require such conditions and restrictions upon the premises benefited by a variation as may be necessary to. comply with the standards set forth in this section to reduce or minimize the injurious effect of such variation upon other property in the neighbor- hood, and to implement the general purpose and intent of this ordinance. (6) Re-applications: Any person, firm, or corporation having been denied a variation to the Zoning Ordinance respecting a specific parcel of property may not re-apply for a like variation on said real property until the period one (1) year has elapsed since the denial of the application for variation by the President and Board of Trustees. Motivated with the expectation that this would bolster the value and enhance the appearance and at the same time be be an asset to the neighborhood, we would like to submit the following descrip- tion and explanation of the proposed addition and remodeling. As indicated in the architectural rendering herein submitted, the main part of the remodeling is the addition in the front entrance of a canopy-foyer that will extend forward and be supported by two sets of tripod columns. In doing so, this overhang cano- py will extend beyond the building line by about seven feet. It might be import- ant to emphasize that this is not a living space. I might add that by reviewing the original survey of this property compared to the succeeding ones, some differences in the measurement from the building line in the front to the street can be noticed. A "non-conforming" construction might have occurred originally. It is possible also that the curving or bending of the road at this point compli- cated the matter. The homeowners association of Ginger Creek have approved already this proposed remodeling. Our neighbors in the immediate vicinity have expressed their support and approval. This minor zoning variation will not alter therhysical surroundings or the topography of this specific property. be- We have lived in this residential home for about 22 years. The house is about 30 plus years old. As we aged so does the house and its materials. Now we are con fronted with the prospect of getting old and beset with the feeling of depression especially with our children gone to their respective calling. Both ourselves and the house need some updating and remodeling and a treatment of our crumbling make- up. The original construction of the house was so poorly conceived especially in regard to natural lighting. Without artificial lighting inside its a dark world, adding to our depressed spirits. It is a common knowledge medically that depression can be treated with bright lights esp. a natural one. Some have used artificial flourescent lights as we have, the brighter, the better. In view of the foregoing predicament, I must say that the proposed construction remodeling will open up a large portion of the house for incoming natural lighting as this would be facing the sun most of the day. This would be very headhful to us and would lead to other things that would occupy our time such as inside gardening and planting.
