Illinois 605)21 - (DepQ_ Name &Address of Recipient N/A of Consideration (when applicable): G/L Account#to be Charged 96-ZO-Su-EXl-S-859 AN ORDINANCE GRANTING A SPECIAL USE FOR FACILITIES INCIDENTAL TO THE OPERATION OF A GOLF COURSE (2616 York Road, Oak Brook, IL 60521) WHEREAS, the property at 2616 York Road, Oak Brook, Illinois has been used as a golf course prior to the incorporation of the Village of Oak Brook; and WHEREAS, on May 6, 1996, an application was filed by Butler National Golf Club requesting that portions of this property, located in the northwest corner of the site, presently zoned ORA-1 and R-4 be rezoned to R-1, Single Family Detached Residence District, so that the entire golf course property is zoned R-1; and WHEREAS, the Village has rezoned those portions of property from the "ORA-1" (Office Research Assembly) and "R-4" (Single Family Detached Residence) to the "R-1" (Single Family Detached Residence) District pursuant to the Village's Ordinance 96-ZO-R-S- 858; and WHEREAS, the subject Butler National Golf Course property includes a clubhouse, a maintenance building, a caddie shack and a training center, all having a common address of 2616 York Road; and WHEREAS, the Butler National Golf Course also filed an application on May 6, 1996 with the Village for a special use in the R-1 Single Family Detached Residence Zoning District and an application for a special use permit to use the aforestated property ("special use property") for a "golf club" and "accessory uses" thereto. WHEREAS, a public review of the applications has been conducted by the Plan Commission of the Village of Oak Brook on July 15, 1996, and said Commission has submitted its report on the subject application to the Zoning Board of Appeals and the President and Board of Trustees and has recommended approval of the proposed special use permit, subject to certain conditions; and WHEREAS, a public hearing on such application has been conducted by the Zoning Board of Appeals of the Village of Oak Brook on August 6, 1996, pursuant to due and appropriate legal notice, and said Board has submitted its report on the subject application to the President and Board of Trustees and has recommended the approval of the proposed special use permit, subject to certain conditions; and WHEREAS, pursuant to the recommendations of the Plan Commission and the Zoning Board of Appeals, the President and Board of Trustees have passed Ordinance 96-ZO-R-S-858 which rezones the entire parcel to the R-1 Single Family Detached Residence District; and WHEREAS, the President and Board of Trustees have reviewed the recommendations from the Plan Commission and the Zoning Board of Appeals regarding the issuance of a special use permit and concur with the Ordinance 96-ZO-SU-EXI-S-859 Granting A Special Use For A Golf Course and Club, Page 2 recommendations and deem the passage of this ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That (a) a Special Use Permit for an 18-hole golf course and club and accessory uses customarily incidental thereto be granted pursuant to Section VII (C) (2) (e) (5) ; an (b) a Special. Use Permit for a clubhouse containing customary facilities incidental to the operation of a golf course and club be granted pursuant to Section (C) (2) (g) (2) . Section 3: That the Special Use Permits grant authority for customary facilities and uses incidental to the operation of a golf course, golf club or club house including without limitation: 1. Practice facilities such as putting greens, pitching and driving ranges; 2. Food service facilities inside and outside the club house; 3. Pro shop and locker rooms; 4. Grounds maintenance and equipment storage facilities; and 5. Administrative offices; Section 4: That the Special Use Permit herein granted shall be subject to the following conditions: 1. The required front, side and rear yards shall be located as depicted on the site plan attached hereto as Exhibit "A". 2. The golf course shall be operated only during daylight hours. At this point in time all of the property was zoned R-1. In subsequent rezoning, property to the west and north of the planned Jorie Boulevard were rezoned to R-4 and ORA-1 respectively. The final location of Jorie left small portions of the property zoned R-4 and ORA-1. For undetermined reasons, the nonresidential use of the property has never been reconciled with respect to the Zoning Ordinance. The use of the property has therefore been classified as preexisting legal nonconforming. This petition seeks to accomplish the following. 1. BUTLER NATIONAL GOLF CLUB - 2616 YORK ROAD - REZONING FROM ORA-1 AND R4 TO R-1 AND SPECIAL USES- GOLF CLUB AND ACCESSORY USES Dave Gooder introduced himself as attorney for the petitioner. He said that the Golf Course exists as a nonconforming use. He reviewed the history of the property and the change of the location of Jorie Blvd. that led to the zoning being split on the property in June of 1971. He noted that the property will continue to be used as it has been used in the past. It is operated in the best interest of the public and maintains the open space and does not negatively impact the value of surrounding property. It was discovered last year by the bank that the property was existing nonconforming. The text amendment will change the entire property to an R-1 zoning. There are two Special Use permits they are seeking. One is for a Golf Course and Golf Club, the second Special Use is for the Accessory Use permitting the Club house. The requested language has been included in the file. The granting of a Special Use permit will not create a hardship or loss of value to the surrounding property owners. There will be no changes to the use, it will only confirm what they have been doing since the 1971 establishment of Butler National. The property has been used for golf and other open field activities since the 1920's. Hawk noted,that the Ordinance would pertain specifically to Butler National Golf Club. The Plan Commission recommended that staff and petitioners work out a reasonable set of controls that would be acceptable to the petitioner and give the Village the type of controls that you would expect to put on any open field Special Use that might come in for an application in a residential zoning district. BUTLER NATIONAL GOLF CLUB -2616 YORK ROAD - REZONING FROM 0RA-1 1 AND R-4 AND SPECIAL USE- GOLF CLUB Hawk advised the members that the Butler National Golf Club is an existing nonconforming use in multiple zoning districts. The requested action will clean up the split zoning and establish Special Uses for the golf club and accessory uses. Dave Gooder introduced himself as attorney for the petitioner. He reviewed the history of the zoning and uses on the property. He explained to the Members that during development of the area a change was made in the curve on Jorie Boulevard. As a result the zoning was split through that area. The purpose of the petition request is to correct the record. They are not seeking a change in the existing use, but are seeking to continue to operate as a Special Use, what they have been doing as a legal nonconforming use. It has been a long time use and they maintain about 170 acres of open space. No residential areas will be disturbed and there is no danger of property values being hurt. Hawk noted that the property looks like a flag lot. The South lot line appears to be the side yard and Jorie Boulevard appears to be the rear yard. The rear yard setback should be more restrictive than the five feet that would be allowed by Ordinance. Provisions should be made for accessory uses and .structures that may be used by a golf course. He said that the principal, accessory and secondary use language need to be clearly defined for the present uses and for the future needs that will allow some flexibility. The list should be acceptable between the Village and the property owner. To avoid unnecessary zoning activities in the future we need to carefully draft the Special Use Ordinance for a private golf club. Member Girgis moved, seconded by Member Mueller, to recommend for approval the Butler National Golf Club request to rezone the property to R-1 and for Special Use as a Golf Club as follows: A. (Section VII (C)(2)(g)(2)). e r Plan Commission and Zoning Board of Appeals Actions Needed Both the Plan Commission and Zoning Board of Appeals are required to make recommendations on Map Amendments and Special Uses. The Zoning Board of Appeals must have the Plan Commission recommendation in hand before it makes its recommendation. Map Amendments are made without conditions. A recommendation should include reference to the standards contained within the Plan Commission Rules of Procedure (see page 1-b of this file). Special Uses should be evaluated on the basis of the standards contained within the Zoning Ordinance (see page 2-b of this file). Also, it is appropriate to specify conditional elements which protect the general public. In this instance I suggest the following: 1. List the approved uses that are a part of the principal Special Use as well as the uses that are covered by the Special Use for Accessory Uses. 2. Designate the location of the required yards --front, side, rear and specify the setback requirements for the principal structures, accessory structures and • parking areas. In this case the existing site plan can act as a guideline. 3. If the structure height exceeds the permitted forty-five feet, either recommend a variation or leave it as an existing nonconforming structure. Background The property has been used as a Golf Course since before the existence of Oak Brook. The original Village of Oak Brook Zoning Map designated the entire property as R-1; however, in 1966, when the Zoning Ordinance underwent major revision, property along 1-88 generally north of Jorie Blvd. was zoned ORA-1 and property generally west of Jorie Blvd., was zoned R-4. When the final location of Jorie Blvd. was established in the late 1960's it left small portions of the Golf course property zoned R-4 and ORA-1. Although the property has been in continuous uses as a golf club since the incorporation of Oak Brook the needed Special Uses have never been sought. The current zoning situation is as follows: 1. The property is split zoned consisting primarily of R-1 and small areas of R-4 and ORA-1 2. With respect to use the property is existing nonconforming in that Special Uses for the golf club and accessory uses have not been requested or granted. 3.
