AN ORDINANCE AMENDING ORDINANCE S-825
EXTENDING THE EXPIRATION DATE OF THE VARIATION GRANTED THEREIN
(3400 St. Paschal Drive)
WHEREAS, the President and Board of Trustees of the Village of Oak
Brook, by Ordinance S-825, granted to the property described therein a
variation to the rules and regulations of the Zoning Ordinance of the Village
of Oak Brook subject to certain conditions and restrictions; and
WHEREAS, said variation permits construction of a parking lot, provided
that construction is completed on or before August 8, 1997; and
WHEREAS, the owner of the subject property has petitioned the President
and Board of Trustees to extend the construction deadline by one year; and
WHEREAS, the President and Board of Trustees of the Village of Oak Brook
deem the passage of this Ordinance to be in the best interest and in
furtherance of the general welfare of the Village of Oak Brook.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That Section 2(2) of Ordinance S-825 is hereby amended to
read as follows:
(2) That this variation shall automatically terminate if a
building permit for the parking lot has not been issued by August
17, 1998.
Section 3: That all other provisions of Ordinance S-825 are in full
force and effect.
Section 4: That all ordinances, rules and regulations of the Village of
Oak Brook which are in conflict with the provisions of this ordinance are
hereby repealed to the extent of the conflict, and only as they apply to the
property described in Section 2 of Ordinance S-825.
Section 5: That if any section, subsection, sentence, clause or phrase
of this ordinance is for any reason held to be invalid, such determination
shall not affect the validity of any remaining portion of this ordinance.
Section 6: That this ordinance shall be in full force and effect from
and after passage and approval pursuant to law.
