Doran: This is to advise that the Oak Brook Zoning Board of Appeals at a meeting held in the Village Hall on January 5, 1965 voted unanimously to grant the variation requested in your letter of December 8, 1964 in the following manner. From evidence received at the hearing it was determined only one lot in the developmei4t known as Central Induistrial Plaza was ready for i.>ntsonediate improvement having been purchased by the Johnson Wa)( Company. Since the Board has no authority to q_rant a variation where a use is not involved, the variation of the front lot line to a depth of 40 f was granted only on the Johnson lot known as No. and indicated as au on a plat s tted in evince and marked Exhibit A. The granting of this variation is conditioned on continued ownership of the plot by the Johnson Wax Company a>rrd j the building improvement being completed within a reasonable time. As purchasers or lessees are found for other parcels in this development it would be in order for you to seek variations demanded by the individual circumstances. k Ve ly yours, George eery Chairman II . The Plan Commission tentatively approves this proposal and will recommend that the final plat of this property be approved when submitted. This approval includes the awareness of the Plan Commission that the proper development of this property may require that a variation be granted which will permit a set-back of less than the 100 feet on all lots facing the service road. The service road divides the frontage of this area on 22nd Street into two lots on the east numbered on this plat as Lots 15 and 16 and a lot to the west of the service road idntified as Lot 1. We are somewhat confused by some of the statements that W*re given to our representatives tkt evening. It was our impression of the meeting hold on January 5. 1965 that your preference for'bandling this variance in the Central, Industrial Plana would be on min individual ciss o basis and you advised at that time that under the present law you aXe not in t position to grant no an overall variance. That evening you did great u a variance for johnson Wax and suggested , that w* come back wheraevar we•had specific sales or lerstet. We assumed from this that you were suggesting this procedure be followed in the future and that your at the same time,, were acknowledging the setback pattern for Criniral Industrial Pla n&* In this particular application, our request was not to vary the oo*"kL of 100' for building on Cormak but was for the.purpose ad ch"ging the parking problem and side yard setback in effect for this pxXticularsite. To say the least. Lot No. I is a anon% difficult property to develop wherein you hava_91,000 9• Ft. of land area with less than 19,000 dq, p't. of buildatblo area. I would point out that it is imposvible to interest; any riser in this lot if we are unable to Obtain a variance of torn* t," pe, particularly for the parking. The street is now known as Enterprise Drive. After much research and with the very helpful aid of Linda Andrys who was able to locate and pull up the documents on microfilm, she was able to locate the variation approval in the archived records. Bob Kallien found that in the original Zoning Ordinance, the Zoning Board of Appeals had the authority to approve certain variations without Village Board approval, because it was not required at that time. This is why an approved Ordinance could not be found. They could not approve Ordinances, so they issued a zoning letter as the official format of approving variations stating any conditions. We believe the Zoning Ordinance was amended around 1966-67 and after that time the Zoning Board held the required public hearings and provided recommendations on variation requests; but only the Village Board had the - authority to approve variations by way of an ordinance. This explains why other properties on Enterprise had - - approved variations that could be easily tracked. Hopefully, this resolves the issues that you had with the legality of the front yard setback for this property. It certainly was interesting finding the information along with this little bit of history about the Village.
