S-924 - 02/09/1999 - ZONING - Ordinances ORDINANCE 99-ZO-V-EX1-S- 924 AN ORDINANCE GRANTING AN AMENDMENT TO ORDINANCE S-487 OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK RELATIVE TO FRONT YARD REQUIREMENTS (3701 Madison Street, Oak Brook, IL 60523) WHEREAS, on May 25, 1982 the Village President and Board of Trustees passed Ordinance S-487, which, in Section 2, granted a variation from the provisions of Section VII(D)(8)(a) of the Zoning Ordinance of the Village of Oak Brook to allow construction of a garage in the required forty foot (40')front yard, provided that a front yard setback of not less than 18.0 feet was maintained on the property commonly known as 3701 Madison, Oak Brook ("Subject Property"); a copy of Ordinance S-487 is attached hereto as Exhibit A; and WHEREAS, an application has been filed requesting an amendment to that front yard setback variation to allow construction up to eighteen feet (18')from the front lot line, including construction of an attached garage with a second floor consisting of bedrooms and bathroom facilities over the garage which would be attached to a new house; and WHEREAS, it is the petitioner's intent to demolish the existing home and to build a new home; and WHEREAS, a public hearing on such application has been conducted by the Zoning Board of Appeals of Oak Brook on September 1, 1998 pursuant to due and appropriate legal notice; and WHEREAS, a recommendation has been made by said Zoning Board of Appeals that the amendment requested be granted and made explicit findings that the amendment requested meets the applicable standards set forth in Section XIII(G)(4) of the said Oak Brook Zoning Ordinance; and WHEREAS, the Village President and Board of Trustees concur with the recommendations and findings made by the Zoning Board of Appeals; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That Section 2 of Ordinance S-487 is amended to read as follows: "Section 2: That a variation is hereby granted from the provisions of Section VII(D)(8)(a) of the Zoning Ordinance of the Village of Oak Brook to permit construction of a garage (attached to a new main house)with a second floor consisting of bedrooms and bathroom facilities over the garage and also additional portions of the main house, both located in the required forty-foot (40') front yard at the property commonly known as 3701 Madison Street, Oak Brook, Ordinance 99-ZO-V-EX1-S- 924 Granting an Amendment to Ordinance S-487, Front Yard Requirements 3701 Madison Street, Page 2 which construction shall be in substantial conformity with the plans and specifications drawn by Eifler&Associates, Architects, dated July 24, 1998 which were presented with the application, provided further that not less than an eighteen foot(18')front yard setback be maintained at said property." Section 3. all other provisions of Ordinance S-487 are and shall remain in full force and effect. Section 4: That this ordinance shall be in full force and effect from and after passage and approval pursuant to law. PASSED THIS 9th day of February, 1999. S- 487 AN ORDINANCE GRANTING VARIATIONS FROM THE PROVISIONS OF SECTION VII (D) (8) (a) and (c) OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK, ORDINANCE G-60, AS AMENDED, RELATIVE TO YARD REQUIREMENTS IN A R-2 SINGLE FAMILY DETACHED RESIDENCE DISTRICT (3701 Madison Street) WHEREAS, an application has been filed requesting variations from the provisions of Section VII (D) (8) (a) and (c) of the Oak Brook Zoning Ordinance, Ordinance G-60, as amended; and WHEREAS, a public hearing on such application has been con- ducted by the Zoning Board of Appeals of the Village on May 4, 1982 pursuant to due and appropriate legal notice; and WHEREAS, a recommendation has been made by the said Zoning Board of Appeals that the variations requested be granted; and WHEREAS, the said Zoning Board of Appeals made explicit findings that the variations requested meet the applicable standards set forth in Section XIII (G) (4) of the said Oak Brook Zoning Ordinance; and; WHEREAS, the President and Board of Trustees of the Village of Oak Brook concur with the recommendation and findings made by the said Zoning Board of Appeals; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows : Section 1: That the provisions of the preamble hereinabove set forth are sere y adopted as though fully set forth herein. Section 3: That a variation is hereby granted from the pro- visions o ection VII (D) (8) (c) of the Zoning Ordinance of the Village of Oak Brook so as to allow the construction of an enclosed swimming pool in the required 60 foot rear yard on the East side of said property described in Section 4 hereof, provided that the variation hereby granted shall allow a rear yard setback of not less than 18.0 feet. Section 4: That this .Ordinance is limited and restricted to the property located at 3701 Madison Street, Oak Brook, Illinois, which property is legally described as follows : Parcel 1: The North 16 feet of the South 1,321 feet of the West 779.5 feet of the Southwest quarter of Sc ion 36, Township 39 North, Range 11 East C the Third Prin- cipal Meridian (except ':gat part taken for roads and highways) in DuPage County, Illinois. .
