S-946 - 07/13/1999 - PUBLIC WORKS - Ordinances ORDINANCE 1999-PW-CR-EX1-S- 946 AN ORDINANCE ESTABLISHING THE POLICY OF THE VILLAGE OF OAK BROOK BY ADOPTING THE PUBLIC WORKS CONSTRUCTION STANDARDS WHEREAS,the Village President and Board of Trustees of the Village of Oak Brook(the"Board") have determined that it is necessary and appropriate to establish uniform policies concerning requirements for and procedures regarding public works construction standards in the Village; and WHEREAS, it is in the best interests of the Village of Oak Brook that the attached Public Works Construction Standards be adopted. NOW,THEREFORE,BE IT ORDAINED BY THE VILLAGE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows: Section 1: That the provisions of the preamble are hereby adopted as though fully set forth herein. Section • That Public Works Construction Standards for the Village of Oak Brook, a copy of which is labeled Exhibit A,which is attached hereto and incorporated herein, are hereby approved and adopted in their entirety. Section : That the validity of any action otherwise taken by the Board in accordance with applicable State law shall not be invalidated, impaired or otherwise affected by noncompliance with any part of the procedures or policy set forth in this ordinance. Section 4: That the Village Clerk is authorized and directed to publish this ordinance in pamphlet form in the manner provided by law. Section 5: That all ordinances or resolutions or parts of ordinances and resolutions in conflict with this ordinance are hereby repealed. BACKFILL OF TRENCHES Trenches under or within 5 feet (1.5 m) of roadways/pathways/driveways shall be backfilled, as soon as practicable, to 5 feet (1.5 m) outside the roadways/ pathways/driveways with CA-6 aggregate mechanically compacted in 1 foot (0.3 m) lifts starting 1 foot (0.3 m) above the top of pipe. Compaction by backhoe bucket is never acceptable. Flowable fill ("Flash Fill" as supplied by Engineered Fill Systems, Inc. of Naperville, IL, or equal) is permitted in place of CA-6 unless otherwise specifically stated. CONSTRUCTION NOISE Construction noise restrictions are found in Section 9-2 of the Code of Ordinances. Generally, residential areas are restricted to between 7:00 a.m. - 6:00 p.m. Monday - Friday and 8:00 a.m. - 5:00 p.m. Saturday & Sunday. Commercial areas are restricted to between 6:00 a.m. - 6:00 p.m. Sunday - Saturday. CONSTRUCTION SCHEDULE A construction schedule shall be required for all work. The Village Engineer shall review any schedule submitted and shall approve it or require revisions as he/she deems necessary and appropriate. i I Section GEN ITEMS, Page I of 8 MAILBOXES Mailbox structures are a unique issue. The OBJECTS WITHIN PARKWAYS section allows a United States Post Office mailbox on a normal wood or metal post without a permit. Other structures require a permit and an indemnification covenant. MISCELLANEOUS ITEMS All work areas shall be restored in accordance with these Public Works Standards. Excavations outside of pavements remaining open overnight shall be protected each night; this may be achieved by backfilling to grade or lighted barricades and fencing on all sides. When the Village notifies a permittee of a failure in the work area (e.g., cave-in or settlement), the permittee shall respond and permanently repair said work area within 2 calendar days unless the failure poses a safety hazard, as determined by the Village Engineer, in which case the permittee shall respond within six(6) hours. Disturbed areas shall be limited to no more than 100 linear feet of open trench before backfilling and,temporary repairs are initiated. Care must be taken in job site parking to avoid damage to sidewalks, pathways, driveways, or landscaping. Parked vehicles and equipment shall not restrict private property access nor hinder sight distances for traffic or pedestrians. Erosion and sediment control .in and around work sites shall be in accordance with pertinent Village requirements and documents. Inlet protection shall be provided at all inlets (within paved or unpaved areas). Under no circumstances shall material be washed into storm drains. Excess material/sediment shall be allowed to dry and then removed by vacuum sweeper or shoveling and hauled away. OBJECTS WITHIN PARKWAYS. The Village hereby establishes the following policy regarding objects within parkways: A. Notwithstanding section 12-11 of the Oak Brook Code, items that are relatively mobile and have low mass and low height are allowed within the parkway as a matter of right and do not require a permit. Examples include grass, flowers, flexible reflectors, wooden lathe stakes (often used to mark driveways in winter), and normal mailbox posts. Section GEN ITEMS, Page 2 of 8 B. Items that are more permanent than those contemplated in section A might be allowed within the parkway under a permit issued by the Village. This section addresses those objects that are substantial enough to require a permit and justify,engineering review and Village control over what they are and where they go. Examples include sprinkler lines, light posts, small identification walls, ornate/substantial mailbox structures, "minor" ornate mailbox-type structures, and trees/shrubs. Except for those items discussed in the preceding paragraph, a private clear zone of 10 feet adjacent to the back of curb or edge of pavement (shoulder if one exists) should be maintained. This does not include items that are or become Village property such as hydrants, street trees, etc. This private clear zone can be occupied by objects smaller than eight inches above the ground and which would not require a permit. This would allow applicants to place small items within the private clear zone that should not cause damage to vehicles. Examples include small boulders or timbers. The parkway beyond the private clear zone could be used by applicants for other larger objects such as light posts which would require a permit. C. Items that pose safety hazards or interfere with the private clear zone within parkways are prohibited within the parkway. Examples include larger boulders, vertical pipes, berms (as defined in Village Ordinance), and private retaining walls. RESTORATION OF GRASS AREAS All areas covered with grass prior to construction shall be sodded after construction. The Village Engineer may allow seed depending upon the unique circumstances of a particular site. STORMWATER Detention Facilities Restrictor plates and short pipe sections are not permitted. The entire length of the outlet pipe must be sized for the required detention release rate. Section GEN ITEMS, Page 3 of 8 VILLAGE REVIEW& INSPECTION The Village will review permit applications as expeditiously as possible and correspond with applicants, either by telephone or in person, to correct any deficiencies so that a permit can be approved as soon as possible. Submittal of correct and complete application documents by the applicant will speed the review and approval process. Inspection services will be provided by the Village as necessary and upon request by permittees. Twenty-four (24) hours advance notice must be given. Also see "General Permit Conditions - Engineering Permits Only"for further information. Patches will be approved based on their general appearance, compliance with these Public Works Standards, and their "rideability". Rideability is defined as a leveling tolerance to within one- quarter(1/4") inch at any point across the parch as it relates to the surrounding pavement surface. Design and construction shall comply with the latest Illinois Department of Transportation standards except as modified herein. Pavement and sidewalk/pathway work shall also comply with the requirements of the Subdivision Site Grading, Roadway and Pedestrian/Bicycle Path Construction section of the Public Works Construction Standards. Pavement cuts: - Open cutting of pavements is generally not permitted. The Village Engineer may allow open cutting of pavements when he/she deems it necessary or appropriate. - When permitted, only one-half of any road pavement may be closed to traffic and have an open trench at any time unless special permission is obtained from the Village Engineer. - All saw cuts shall be full depth. At locations where the proposed utility must be installed across an existing roadway and open cut construction for this location has been approved by the Village, the limits of the trench shall be initially saw cut. The disturbed pavement within the trench area and any additional pavement width weakened by the trench (all such additional areas shall be saw cut) shall be restored in kind using equal or better materials to lines and grades equal to or better than that which existed prior to construction subject to the following: All pavement edges shall be vertical, clean and structurally sound for restoration. This may require saw cutting just prior to restoration activities. The thickness of the replacement pavement shall be a minimum of 2" (50 mm) thicker and below the existing pavement depth, but must also comply with the following minimum pavement replacement thicknesses and materials: Concrete pavement: a rich mix/high early strength Portland Cement Concrete, 8" (200 mm) thick. Section P&S, Page 1 of 5 I • Bituminous pavement: 2" (50 mm) Bituminous Concrete Surface Course,Class I, Type 2 over 7" (175 mm) Bituminous Base Course (BAM) (lift thicknesses shall depend upon compaction equipment-2"with vibrating plate; 4"with self-propelled roller). Restoration of pavement shall be accomplished as soon as practicable (in no event shall it be longer than 15 calendar days), and temporary repair with bituminous mixture (2" minimum thickness) shall be provided within one calendar day and maintained until restoration takes place. Any.subsequent failure of either the temporary repair or the restoration shall be rebuilt by the permittee, at his/her sole expense, upon notification by the Village. In cases where work disturbs a significant portion of a pavement,the Village may require overlay of an area larger than the work area to insure a smooth, rideable surface. In cases where a trench edge is within 5 feet of an existing patched area,the Village may require the entire 5 foot area to also be removed and replaced. Directional Borings:-Borings over 4"(100 mm) in diameter shall be accomplished with an auger and following pipe and the diameter of the auger shall not exceed the outside diameter of the proposed conduit by more than 1" (25 mm). - Borings of 4 (100 mm) or less in diameter may be accomplished by either augering,jacking, or directional bore. Arterial and Collector Streets Arterial and collector streets require stricter regulation to maintain the orderly and safe flow of traffic. Therefore, no work, except emergency work to restore services, will be performed on the following street pavements during the peak traffic hours of 7:00 a.m. - 4:00 a.m. and 4:30 p.m. - 6:00 p.m. Monday through Friday unless written permission is received from the Village Engineer: 1. 16`h Street between Route 83 and Spring Road 2 22"d Street between Route 83 and Clearwater Drive 3. Jorie Boulevard 4. Spring Road between 22"d Street and the northerly Village limits 5. Windsor Drive between 22"d Street and Swift Drive 6. York Road between Golf Drive and the northerly Village limits Lane closures will be restricted to the working lane only and two way traffic will be maintained at all times. I Section P&S, Page 2 of 5 Arterial and collector streets shall be opened to traffic during the above stated rush hours with all openings covered by a road plate or an asphalt patch. The permanent patch shall be placed as soon as possible but not later than 3 calendar days after backfilling. CHECK WITH MM & SV When notified by the Village of an unsafe opening, the responsible party (usually a permittee) shall respond and repair said opening within 12 hours. Failure to do so may cause the Village to undertake such repairs as is necessary and bill the responsible party for its expenses. Other Streets Being less traveled, work generally can be performed on these street pavements during the peak traffic hours. However, two way traffic shall be maintained at all times by either keeping two lanes open or by flagmen controlling one lane. Excavations shall be protected each night; this may be achieved by 1) backfilling to grade and installing a temporary asphalt patch, or 2) lighted barricades and fencing. The permanent patch shall be placed as soon as possible but not later than 7 calendar days after backfilling. When notified by the Village of an unsafe opening, the responsible party (usually a permittee) shall respond and repair said opening within 12 hours. Failure to do so may cause the Village to undertake such repairs as is necessary and bill the responsible party for its expenses. STREETS Design Period The design period for all pavements shall be 20 years. A soil support CBR value of two and one- half(2-1/2) may be assumed. Higher CBR values must be verified by laboratory analysis. Residential traffic volumes may be computed by assuming 12 trips per dwelling unit per day for R-1, R-2, R-3, and R-4 zoning districts. Combination concrete curb and gutter shall be M-6.12 (M-15.30). All curbs shall either be depressed across driveways during construction or shall be saw cut from the house side as a depressed section at the time of driveway construction. SIDEWALKS Sidewalks shall be constructed of portland cement concrete. The minimum thickness shall be 5" (125 mm) except across driveways where the thickness shall be 7" (175 mm). The minimum width shall be 5' (1.5 m). Light shall not spill over onto residences. Commercial area street lighting, including commercial driveways and parking areas, shall be approved by the Village on a case by case basis. In commercial lots, light shall not spill over onto residential areas. 'Locust(Thornless Honey) Trees proposed to be installed within other areas of public ways (such as cul-de-sac islands or entrance landscape areas) shall be submitted for review. Items of concern include hardiness in a public way environment (e.g., salt tolerant), sight lines, and other pertinent issues of the specific circumstance. If an applicant wishes to install trees within a parkway other than those listed, he/she shall submit a request which will be reviewed. Minimum diameter of trees planted within public ways shall be 2-1/2" (65 mm) measured 4' (1.2 m)above the ground. The minimum distance between edge of roadway and trees is as follows: Roadway without curb (measured from edge of pavement) = 10' (3.0 m) Roadway with curb (measured from back of curb) = 5' (1.5 m) In the erection, alteration or repair of any building or structure, a guard shall be placed and maintained around all trees within the public way to prevent injury to them. Trees shall be planted 40' (12 m) apart and 10' (3 m) from b-boxes, hydrants, inlets, and manholes. In a subdivision, a mixture of species shall be planted as approved by the Village. Trees shall be planted to the proper depth so the root collar is level with the surrounding soil grade. No part of a wire basket shall remain in the upper 6" (150 mm) of soil. i Section TREES, Page 1 of 2 Trees shall be mulched with 4" (100 mm) of wood chips. The permit applicant shall provide any landscape watering necessary. Trees shall be free of infectious diseases or insect infestation and shall be first class nursery grown. Thin,weak trees will not be accepted. Placement of trees shall be limited to areas that do not impede or interfere with the sight lines of pedestrians or operators of vehicles. Placement shall also be coordinated to avoid or minimize conflicts with utilities. i Section TREES, Page 2 of 2 !P W STD GEN-TREES PUBLIC WORKS CONSTRUCTION STANDARDS TRAFFIC SIGNALS GENERAL STANDARDS Opticom traffic pre-emption equipment, meeting the current requirements of the Fire Department at the time of installation, shall be installed in all proposed traffic signals. Each proposed traffic signal will be reviewed by the Village on a case by case basis depending upon its individual circumstances and conditions. Section TS, Page 1 of 1 i \PW STD GEN-TS PUBLIC WORKS CONSTRUCTION STANDARDS UTILITIES PURPOSE AND OBJECTIVES It makes sense to use established transportation corridors and their rights-of-way to locate the many utility services necessary to modern life. The public rights-of-way should be used for the public good. Providing reasonable access for utilities used by the public, while not lessening the safety of the traveling public, is certainly a public good. Use of the right-of-way for purposes besides vehicular and pedestrian traffic, however, must be controlled in the public interest. Public right-of-way is a community resource, a part of the infrastructure which links activities and places. The Village of Oak Brook is responsible for its streets and must establish control of the public ways to ensure that a safe travel environment is maintained, that other facilities in the public ways are not abused, and that best use is made of this resource. When work in the public ways is not controlled adequately,the likely results are: • Excavation made with no notice to the regulating agency. • Excavation and restoration work done without regard to community specifications and standards. • Use of improper materials and methods for restoring a utility cut. Slow repairs that create inconvenience to the public with extended lane closures. Y Poor workmanship in trench reinstatement and pavement restoration. - • Public dissatisfaction with traffic delays and interrupted services. • Disruption of adjoining public facilities, such as undercutting gutters and sidewalks. • Damage to adjoining utility facilities disturbed by improper excavation. • Increased maintenance costs form pavements which are cut repeatedly to access utilities. • Increased danger for the public and excavators. i Section UTILITY, Page 1 of 3 Therefore, it is recognized that there is a need to accommodate public or private utility companies in the providing of public or private services; however, the Village must insure that the primary purpose of the roadway, that being the passage of vehicular traffic, is maintained to the greatest extent possible. The use of the roadway corridors by utility companies is secondary to the movement of traffic. This policy strikes a balance between the public need for efficient, safe transportation routes and utility services within these routes. This utility policy has three primary objectives: 1. The Village must insure that the public safety is maintained and that public inconvenience is minimized by establishing time constraints for utility work, response time for utility repairs within public ways and specifically to the pavements, and standards for work zone safety. 2. Protect the Village's infrastructure investment by establishing repair standards for the pavement when utility cuts are made. 3. Effectively and efficiently manage all uses within the public ways. This policy has been prepared as a part of the Public Works Construction Standards to guide the staff and utility companies in achieving the above stated objectives. The policy is intended to provide general guidance only. Specific requirements will be developed based on site-specific conditions. Also, as with any policy, exceptions may be granted as deemed necessary by the Village. The Village will conduct periodic reviews of this policy and invites utility companies' input in order to make this policy an effective tool for the conduct of our mutual responsibilities to serve our respective"customers". GENERAL STANDARDS Any utility proposed to be located within or go through the drip line of any tree designated by the Village to be preserved shall be bored under or around the root system; trenching is not permitted. The utility company receiving a permit is held responsible for the work performed and the Village will contact the utility company for required adjustments or corrections regardless of whether the utility company performed the work itself or subcontracted and assigned the work. The permit is issued to the utility company and it is solely responsible for any work performed. Design and .construction shall comply with the latest "Standard Specifications for Water and Sewer Main Construction in Illinois", except as modified herein, and other pertinent Village ordinances, requirements, and policies. Water system work shall also comply with the requirements of the Subdivision Water Main Construction section of the Public Works Construction Standards. SPECIFIC STANDARDS Water distribution mains shall be designed and constructed to conform with the long range water plans of the Village with respect to size and general location. Dead-end water mains should not be constructed unless plans call for the main to be a part of a future loop system and an approved flushing device installed at the dead-end. All water mains shall have a minimum diameter of 6" (150 mm). Minimum depth of bury (cover) shall be 5'-6" (1.7 m). Water main valves should be placed at intervals not exceeding 1,200' (350 m) to provide for isolating small sections of main and on as many legs of a"cross" or "tee" as deemed appropriate by the Village Engineer. All valves in existing or proposed pavement or sidewalk areas shall be in valve vaults as approved by the Village Engineer. Valves in grassy or unpaved areas may be installed with valve boxes as approved by the Village Engineer. Water mains and water services shall be installed in separate trenches and at least 10' (3.0 m) horizontal away from storm sewers and storm services and from sanitary sewers and sanitary services unless otherwise approved by the Village in writing. The service valve or curb stop shall be located 2' (0.5 m) from the property line (if within ROW) or easement line (if within easement). For single family residential use, valve boxes (b-boxes) will be permitted on these valves in any location. For all other use, valve boxes (b-boxes) will be permitted on these valves provided they do not fall within pavement or sidewalk in which case valve vaults will be required. Section WATER, Page 1 of 2 All water services shall be laid in public ways or easements to the premises so as to enter the building to be served by the most direct route from the water main. A metered check valve shall be installed on all fire lines at the owner's expense and shall be located inside the building as approved by the Public Works Director. Each service extension shall be tested prior to backfilling in the presence of a Water Division inspector and shall show no leakage under full water pressure. Easements shall be a minimum of 20' (6.0 m) in width for water mains that are 10" (250 mm) in diameter or less and`a minimum of 25' (7.5 m) in width for water mains that are 12" (3 00 mm) in diameter or more. No water main or water service shall be backfilled until approved to do so by the Engineering Department or Water Division. Section WATER, Page 2 of 2 /PW STD GEN-WATER PUBLIC WORKS CONSTRUCTION STANDARDS ENGINEERING PERMITS GENERAL INSTRUCTIONS 1. Generally These instructions have been prepared as a guideline to assist the permit applicant. Section 12-11 of the Code of Ordinances of the Village of Oak Brook: "It shall be unlawful to proceed with any work within public ways and public utility easements or with any water service extension construction without first having secured a permit therefor from the Village." Section 15-146.1 of the DuPage County Countywide Stormwater and Flood Plain Ordinance (adopted by the Village): "Any person proposing a development shall obtain a Stormwater Management Permit prior to development." Lettering on plans must be of sufficient size to be legible as determined by the Village. It is recommended that the minimum size for either typed or hand-printed lettering shall be no smaller than 0.10"(2.5 mm) in height. 2. Building Permit/Engineering Permit/Stormwater Management Permit/Water Permit One or all of the above permits shall be required for any work. For specific details refer to the Village Code. Typical examples of permit work are as follows: A. Commercial Development -Any new building -All remodeling -All additions - Demolition B. Water Main Tap(commercial or residential) E. Storm Sewer/Sump Pump Work(commercial or residential) Section ENG PERMITS-Gl, Page I of 3 F. Sanitary Sewer Work(commercial or residential) G. Any Electric,Telephone,Gas,and Cable Installation - Shall be augered under existing roadways - For parallel installations,maintain a minimum horizontal 5'(1.5 m)separation between proposed utility and existing water main - For crossings,maintain a minimum 18"(0.5 m)of vertical separation(clear)between proposed utility and existing water main - For crossings, provide and install on proposed utility a 5'(1.5 m)minimum length casing pipe of either ductile iron pipe or Schedule 40 PVC pipe. -Site plan shall show the location of all topographical items that are in the vicinity of the work which would present an obstacle and which must be designed around. H. Any work within public ways. 3. Permit Application Forms Applications for all permits shall be on forms furnished by the Village for this purpose and are available from the Community Development Division of the Fire Department. All applications and payment of all permit fees shall be submitted to the Community Development Division;except, however,all permit applications by a public utility shall be submitted to the Engineering Department. Contact the Engineering Department for specific processing questions regarding work within public ways. For specific processing questions concerning water service applications, contact both the Engineering Department and the Water Division. All water service applications, however, shall be accompanied by four(4)such plans and specifications. The Site Plan shall include such detailed information as may be required by the Village to ascertain what work is being proposed in relation to existing conditions and to ascertain compliance with Village requirements. Additionally, if the changing of surface grades on the property are involved,the Site Plan shall accurately show existing and proposed ground elevations and 1'(0.25 m) interval contours. 4. Benchmark All plans must use the Village elevation system. The plans must state at least two Village benchmarks from which all topographic and elevation information is derived. Contact the Engineering Department for benchmark data. 5. Easements All easements must be shown on all plan sheets. Section ENG PERMITS-GI, Page 2 of 3 6. Construction Schedule Erosion Control and Traffic Control Plans A construction schedule,erosion control plan and traffic control plan shall be submitted with the permit application. Tile erosion control plan shall contain both temporary and permanent control measures. The traffic control plan shall demonstrate the protective measures and devices that will be employed to prevent injury or damage to persons or property and to minimize disruptions to efficient pedestrian and vehicular traffic. 7. Inspection Notifications The permittee shall give twenty-four(24) hour advance notice to the Engineering Department prior to starting work or any phase of the work; except in the case of a water service item, such notice will be given to both the Engineering Department and Water Department. If advance notice is not supplied as stipulated above for any or all construction activities, the permittee hereby agrees and allows the Village to stop any and all such unnotified construction activities until the proper advance notice is given. 8. Sanitary Sewer Construction All sanitary sewer construction shall be in accordance with the "Standard Specifications for Water and Sewer Main Construction in Illinois,". Fifth Edition, Dated May 1996 and all revisions thereto; the Sanitary District ordinances, requirements and policies; and all Village of Oak Brook ordinances, requirements and policies. The Village of Oak Brook is not responsible for either the construction inspections of the sanitary sewer or the maintenance of the sanitary sewer. The Village will, however, inspect backf►lling operations and surface restorations for installations,across an existing or proposed roadway, shoulder or sidewalk or at any other location deemed necessary by the Village. Therefore, it is the responsibility of the permittee to contact the appropriate sanitary district for the required work permit regarding the proposed sewer. Additionally, it is the responsibility of the permittee to obtain a"Construction Permit" from the Village of Oak Brook for said sanitary sewer work within public ways or easements granted to the Village. General Permit Conditions The attached "General Pen-nit Conditions - Engineering Permits Only" will be made a part of all permits approved by the Engineering Department. Section ENG PERMITS-Gl, Page 3 of 3 \PW STD PER-GEN INST GENERAL PERMIT CONDITIONS ENGINEERING PERMITS ONLY 1. All work shall comply with all applicable sections of the Village Code of Ordinances and the Public Works Construction Standards which are incorporated herein by reference. 2. All permittees working within public ways or public utility easements must obtain insurance which complies with sections 2-230 through 2-236 of the Code of Ordinances of the Village. Any permittee shall not commence work until he/she has obtained all insurance required. 3. One copy of the approved permit is to be kept on the job site at all times during construction. 4. The permittee shall give twenty-four (24) hour advance notice to the Engineering Department and/or the Community Development Division prior to starting work or any phase of the work. The Engineering Department and Community Development Division conduct inspections only on Monday through Friday; therefore, all Monday inspections must be scheduled on the Friday before or sooner. Other affected governmental and utility agencies must be notified in accordance with their notification procedures. If twenty-four(24) hour advance notice is not supplied to the Village for any or all construction activities,the permittee hereby agrees and allows the Village to stop any and all such unnotified construction activities until the proper 24 hour advance notice is given. 5. All penmittees shall keep access available at all times to residences and for emergency vehicles. At no time shall access be denied to homes surrounding the work site, except for any minor amount of time caused by construction in that immediate area. 6. The permittee shall be responsible for obtaining all required permits for construction along or across existing streets or highways. He/she shall make arrangements for the proper bracing, shoring and other required protection of all roadways before construction begins. He/she shall be responsible for any damage to the roadways and associated structures and shall make repairs as necessary to the satisfaction of the Village at his/her own expense. 7. Permittee shall be solely responsible for informing utilities of proposed work and obtaining the location of utilities. The permittee shall be responsible for the protection of all private and public utilities shown on the plans or located on-site. Any such utility that is damaged during construction shall be repaired or replaced, to the satisfaction of the Village and the utility company,by the permittee at his/her own expense. 8. Whenever during construction operations any loose material is deposited in the flow line of gutters,drainage structures, or ditches such that the natural flow line of water is obstructed, the loose material shall be removed at the close of each working day. 9. All road signs, street signs, and traffic signs which need to be relocated or moved due to construction shall be taken down and stored by the permittee except those which the Village Section ENG PERMITS-GC, Page 1 of 2 deems necessary for proper traffic control which shall be temporarily reset until completion of construction operations. After completion of the work, the permittee shall reset all said signs at the locations designated by the Village. Any signs not required to be reset shall be delivered by the permittee to either the respective Village,County or State maintenance yard. 10. The permittee is solely responsible for any and all safety and traffic control measures. To help maintain uniformity of said traffic control measures and minimize confusion, traffic control devices in conformance with the Illinois Manual of Uniform Traffic Control Devices, Illinois Department of Transportation standards and Village requirements shall be provided, installed and maintained by the permittee whenever construction activities are within or adjacent to public ways or public utility easements. Also, ordinances of the Village, County or State shall govern the traffic control. If during an inspection the Village determines that proper traffic control devices are not being used, the permittee hereby agrees and allows the Village to stop any and all such work until proper devices are installed. 11. All pits/trenches remaining open overnight shall be barricaded and fenced on all sides for pedestrian safety. 12. The permittee shall provide for the immediate removal of any mud and debris that is deposited onto the roadways/pathways/driveways which was caused by the construction. The permittee shall furnish, when directed by the Village and as often as directed by the Village, all equipment, water and labor necessary to clean the roadway of all dust,dirt and debris caused by the permittee's work activities. The cost of this work shall be bome by the permittee. 13. Any soil erosion control measures which are deemed necessary by the Village shall be implemented immediately by the permittee. 14. In the erection, alteration or repair of any building or structure, a guard shall be placed and maintained around all trees within the public way to effectively prevent injury to them. 15. It is the permittee's responsibility to determine the true owners of property on which construction is to take place and obtain the necessary rights for the improvement prior to beginning construction. 16. A permit from the Village authorizes a permittee to undertake only certain activities and does not create a property right nor grant authority to the permittee to impinge upon the rights of others who may have an interest in the public ways. 17. The issuance of this pen-nit does not excuse the permittee from complying with other requirements of the Village and all applicable statutes, laws, ordinances, rules, and regulations. 18. No permit shall be released until all pavements/pathways/driveways are properly restored and until sod is knitted or seeded areas show a growing and thriving stand of grass. Section ENG PERMITS-GC, Page 2 of 2 \P W STD PER-GEN COND PUBLIC WORKS CONSTRUCTION STANDARDS SUBDIVISIONS GENERAL INSTRUCTIONS 1. Generally Refer to the Code of Ordinances of the Village of Oak Brook, Appendix B, "Subdivision Regulations" and the current "DuPage County Countywide Stormwater and Floodplain Ordinance" for regulations, procedures, requirements and general design and development standards. Obtain a letter of tentative service from the appropriate Sanitary District. Additionally, in order to insure legible prints of the subdivision plat and improvement plans, the minimum size for either typed gr hand-printed lettering for all plats, specifications, construction plan notes and all general plan notes shall be no smaller than 0.10"(2.5 mm) in height. The letters shall be always open and formed with a dense,but not wide, line width. Also,the plan sheets shall be of cloth or mylar reproducible material and shall be 24"x 36"(594 mm x 841 mm)with border lines 1-1/2"(38 mm)from the left edge and 1/2"(13 mm)from the top,right,and bottom edges. 2. Benchmark All plans must use the Village elevation system. The plans must state at least two (2) Village benchmarks from which all topographic and elevation information is derived. Contact the Engineering Department for benchmark data. 3. Easements All easements must be shown on all plan sheets. A 20' (6 m) minimum width shall be utilized when a utility is proposed/present; a 25' (7.5 m) minimum width shall be used with a 12" (300 mm)or greater water main. 4. Insurance A sample Certificate of Insurance is in the"GENERAL ITEMS"section of the Public Works Standards that meets the Village's requirements. Certificates that do not meet its guidelines will not be accepted. 5. Inspection Notification The developers)/contractor(s) shall give twenty-four (24) hour advance notice to the Village Engineering Department prior to starting work or any phase of the work. If advance notice is not supplied as stipulated above for any or all construction activities,the developer and/or contractor hereby agrees and allows the Village to stop any and all such unnotified construction activities until the proper advance notice is given. Use of these Special Provisions Developer's Engineer will utilize the following Special Provisions verbatim (copy and use, do not re- type) within the development's engineering plans and specifications (do not reduce, these meet the 0.10"(2.5 mm)requirement). If some do not apply,they may be lined out. If an entire section does not apply, it need not be included. If the developer's Engineer wants to revise some and receives permission from the Village on the revision, the particular words may be lined out and the new words added in. THE CODES AND ORDINANCES OF THE VILLAGE OF OAK BROOK, THE HINSDALE OR THE DOWNERS GROVE SANITARY DISTRICT, THE ILLINOIS ENVIRONMENTAL PROTECTION AGENCY, AND O.S.H.A SHALL ALSO BE ADHERED TO FOR THE CONSTRUCTION OF THIS PROJECT. 3. THE DEVELOPER SHALL PROVIDE THE VILLAGE WITH THE NAME AND TELEPHONE NUMBER OF AN INDIVIDUAL WHO WILL BE AVAILABLE TWENTY- FOUR (24) HOURS A DAY, SEVEN (7) DAYS A WEEK, TO RECEIVE NOTIFICATION OF ANY EMERGENCY AND NON-EMERGENCY DEFICIENCIES. THIS INDIVIDUAL SHALL DISPATCH MEN, MATERIALS AND EQUIPMENT TO CORRECT ANY SUCH DEFICIENCIES. 4. ALL CONTRACTOR'S MUST OBTAIN INSURANCE WHICH COMPLIES WITH THE CODE OF ORDINANCES OF THE VILLAGE SECTIONS 2-230 THROUGH 2-236. ANY CONTRACTOR SHALL NOT COMMENCE WORK UNDER HIS CONTRACT UNTIL HE HAS OBTAINED ALL INSURANCE REQUIRED, AND SUCH INSURANCE HAS BEEN APPROVED BY THE VILLAGE AND ALL OTHER AGENCIES IMPACTED BY THE PENDING PROJECT. 5. THE DEVELOPER/CONTRACTOR(S) SHALL GIVE TWENTY-FOUR (24) HOUR ADVANCE NOTICE TO THE VILLAGE ENGINEERING DEPARTMENT PRIOR TO STARTING WORK OR ANY PHASE OF THE WORK. OTHER AFFECTED GOVERN- MENTAL AND UTILITY AGENCIES MUST BE NOTIFIED IN ACCORDANCE WITH THEIR NOTIFICATION PROCEDURES. Section SUBD GN, Page I of 7 IF TWENTY-FOUR (24) HOUR ADVANCE NOTICE IS NOT SUPPLIED TO THE VILLAGE FOR ANY OR ALL CONSTRUCTION ACTIVITIES, THE DEVELOPER AND/OR CONTRACTOR HEREBY AGREES AND ALLOWS THE VILLAGE TO STOP ANY AND ALL SUCH UNNOTIFIED CONSTRUCTION ACTIVITIES UNTIL THE PROPER 24 HOUR ADVANCE NOTICE IS GIVEN. 6. THE DEVELOPER OR CONTRACTOR SHALL NOTIFY, AS NECESSARY, ALL TESTING AGENCIES IN ACCORDANCE WITH THEIR NOTIFICATION PROCEDURES. THE CONTRACTOR HEREBY AGREES THAT FAILURE OF THE CONTRACTOR TO ALLOW PROPER NOTIFICATION TIME WHICH RESULTS IN THE TESTING AGENCY NOT BEING AVAILABLE TO VISIT THE SITE AND PERFORM TESTING AS NECESSARY WILL CAUSE THE CONTRACTOR TO SUSPEND OPERATIONS (PERTAINING TO TESTING) UNTIL THE TESTING AGENCY CAN SCHEDULE ITS TESTING OPERATIONS. ALL COSTS OF SUSPENSION OF WORK ARE TO BE BORNE BY THE CONTRACTOR. 7. IN THE EVENT OF A CONFLICT, CALCULATED DIMENSIONS SHALL GOVERN OVER SCALED DIMENSIONS. 8. THE VILLAGE RESERVES THE RIGHT TO SELECT A QUALIFIED TESTING FIRM TO PERFORM ANY AND ALL REQUIRED TESTING. ALL SAID TESTING COSTS SHALL BE AT THE DEVELOPER'S OR CONTRACTOR'S EXPENSE. . 9. ALL CONTRACTORS SHALL KEEP ACCESS -AVAILABLE AT ALL TIMES TO RESIDENCES AND FOR EMERGENCY VEHICLES.
