The parties hereto agree that the traffic signal maintenance and energy provisions of this Agreement shall remain in effect for a period of twenty(20)years from the date of its execution or so long as the traffic signals covered by the terms of this Agreement or any Amendment hereto remain in place either in their current or some modified configuration, whichever is the shorter period of time. Upon receipt of an invoice for traffic signal maintenance,the VILLAGE shall make payable a certified check in the total of the invoice to the Treasurer,State of Illinois and submit to the Department of Transportation,201 West Center Court,Schaumburg,Illinois,60196. 0gen\wp21#I 3spt I Aoc II 2 I TRA FIC SIGNAL MAINTENANCE PROVISIONS LEVEL II The maintaining agency agrees to: 1. Patrol the traffic control signal system a minimum of once every two (2) weeks and replace burned out lamps or damaged sockets as may be required. The reflector and lens should be cleaned each time a lamp is replaced. 2. Keep signal posts, controller pedestals, and foundations in alignment at all times. 3. Keep signal posts and controller pedestals tight on foundation. 4. Keep signal heads and controller cabinets tight on their pedestals and properly adjusted.. S. Keep detector equipment in proper wnrking order at all times. 6. Check the controllers, relays, and detectors at least once every month to ascertain that they are functioning properly and make all necessary repairs and replacements, i 7 Furnish and install temporary controller whenever necessary. 8. Keep interior of controller cabinets in a neat condition at all times. 9. Remove to clean and overhaul the controllers, relays, special auxiliary control equipment, and time clock once a year or more often if necessary. A record tag shall be attached to each controller on which the date of over_.. i haul or other service work shall be indicated. 10. Replace burned out fuses. I • I 11. Clean reflectors, lenses, and lamps once every six (6) months. !� 12. Repaint all signal components exposed to weather at least once every two 1 (2) years. 13. Group relamp traffic signal heads at the expiration of the average rated lamp life. 14. Repair or replace any and all equipment damaged by any cause whatsoever. 15, Be responsible to make recovery for damage to any part of the installation or systems from the party causing the damage. 16. Place a stop sign on each approach to the intersection as a temporary means of regulating traffic whenever repairs at a signalized intersection require that the controller be disconnected. 1.7. Respond to emergency calls from authorized parties twenty-four (24) hours a day, including Saturdays, Sundays, and holidays. Controller failure, lights out, knockdowns, or two (2) red lights out at an intersection are considered emergencies. 18. Pavement cuts,curb openings,utility frames and municipal frames and grates or covers disturbed by settlenment,constriction or repair under permit are to he restored,repaired,adjusted and maintained by the utility owner or permit holder to the satisfaction of the Department at no expense to the State. The Corporation agrees that,except in extreme emergencies,it will not undertake or authorize repairs not covered by this agreement,at the expense of the State,without sec+iring the approval of the Department. In consideration of the satisfactory maintenance and operation of streets covered by this agreement.:he Department will pay the Corporation 39,156.00,nine thousand,one hundred and eighty-six dollars,forthe first seven month period covered by the agreement,payable as described below. The rate of compensation will be adjusted annually at the time of renewal to reflect changes in miles maintained and costs. The cost adjustment factor used to determine the rates of compensation will be the percent change of the Construction Cost Index published in the Engineering Ness Record for the preceding calendar year. i On or about March 31,June 30,September 30 and December 31 of each year,subject to an inspection by the Department,the Department wilt authorize the Corporation to invoice the Department in an amount equal to approximately one-fourth of the total annual allowance stated above, CORPORATION CERTIFICATIONS • RETENTION OF RECORDS The Corporation shall maintain,for a minimum of 5 years after the completion of the agreement,adequate books,records and supporting documents to verify the amounts,recipients and uses of all disbursements of funds passing in conjunction with the agreement;the agreement and ail books,records and supporting documents related to the agreement shall be available for review and audit by the Auditor General;and the Corporation agrees!o cooperate fully with any audit conducted by the Auditor General and to provide full access to ail relevant materials. The`Local Agency State Agreement for Jurisdictional Transfer"for York Road, 2: The"Local Agency State.Agreement for Jurisdictional Transfer"for 22nd Street, 3. The attached two Village Ordinances regarding same. I I On June 24, 1998,Village Manager Veitch executed the attached Utter of Intent regarding the following: i i 1. Transferring from IDOT to the Village that section of York Road from the south abutment of the first bridge over the Tollway north of 22nd Street to the northern Village limits. i i 2. Transferring from the Village to IDOT that part of 22nd Street from Route 83 to Clearwater Drive. 3. Various other appurtenant provisions. Please also refer to Steve's memo to you regarding the long history of this subject. Since that time, staff has been negotiating with IDOT to generate the necessary agreements in order to consummate the ,jurisdictional transfers and the attached documents are the culmination of those negotiations. These documents are: i York Road Transfer I. "Local Agency State Agreement for Jurisdictional Transfer"which covers item I above. Its attached f map further delineates this area. 2. Village Ordinance providing for the addition of York Road to the municipal street system effective 21 calendar days after execution of the Agreement by the State but not before the State accepts the 22nd/York improvements. The portion of York Road from the south abutment of that structure to 2,278 feet south of the centerline of VQ Street will be transfened to the Village upon completion of the York Road at 22nd Street intersection improvement. • The Village of Oak Brook would be responsible for routine maintenance of 22nd Street east of Illinois Route 83 within the Village limits,under the terms of a Municipal Maintenance Agreement, for the months of April through October. The compensation to the Village would be 35% of the normal s i compensation called for in a twelve (12) month agreement. Veitch,Village Manage* _ i � SUBJECT: 22nd Streett ork Road Jurisdictional Transfer I Some members of the Board will recall that a little over four years ago, the Village proposed a ! jurisdictional "swap„ to IDOT under which IDOT would re-assume jurisdiction and maintenance responsibility for 22nd Street between Route 83 and Clearwater Drive (and retain jurisdiction over j 22' Street from Clearwater east to 1-294) in exchange for the Village's agreement to assume same 1 for York Road from the north end of the 22nd/York intersection project(the Village having already agreed to accept York Road within the project limits) to the north corporate limits just north of j Harger Road. Last June, the Village executed a letter of intent with IDOT, which led to preparation of formal agreements to accomplish the transfer. Earlier this year, we agreed to try to time the transfer to occur concurrent with completion of the intersection project and the transfer of York Road within the project. Since it has been some time since we have reported to the Board on this subject, and since several present Trustees were not serving when this initiative got its start, a review of the background is in order. Our principal motivation when we proposed the exchange early in 1995 was to avoid the costs of adding staff and equipment in the Public Works Department which would result from assuming maintenance responsibility (particularly snow removal) for a significant arterial intersection (22'' and York) and its extended approaches,on top of the long stretch of 22nd Street already maintained by the Village. These costs were estimated in 1.994 at over$80,000 annually. We also believed that through this jurisdictional transfer, snow removal service in the northeast area of the Village would be enhanced, at no additional cost, through more efficient routing of equipment. Village President and Board of Trustees June 3, 1999 i Page 2 IDOT was receptive to our proposal since the only segment of the 22"d Street-Butterfield Road corridor not under State jurisdiction is the Route 83 to Clearwater Drive segment in Oak Brook. However, as we progressed through the McDonald's agreements later in 1995 (which.also committed IDCT to negotiate with the Village toward this jurisdictional transfer) and into the draft letter of agreement stage in the summer of 2995,two critical issues emerged They were: (1) IDOT insisted on having the Village perform at least some of the routine maintenance of 22nd Street even after the transfer, pursuant to an IDOT standard Municipal Maintenance Agreement; and (2) IDOT insisted that the Village remain committed to participate to the extent of 1/3 of the cost of future improvements at the 22nd Street/I-88 structure(estimated total cost at least$12 Million). Recognizing that it would be taking on more than it would give up, and in order to adhere to State- wide IDOT policy, IDOT was firm in its resolve to delegate some routine maintenance to the Village. The standard agreement, used Statewide and negotiated years ago with the Illinois Municipal League, provides limited compensation to the municipality for the services it renders. After further discussion, we reach,-d agreement on the modified approach reflected in the last two bullet points at the bottom of pag 1 of the letter of intent and in the 22n° Street agreement. This arrangement satisfies IDOT's objective of putting a maintenance agreement in place but also meets our primary objective of divesting responsibility for snow and ice removal on 22nd Street. We had always assumed that we would continue to perform right-of-way maintenance and some sweeping along 22nd Street because of its importance to the appearance of the Village, so we do not see this outcome as a significant concession on our part. Initially, we sought to link the 22nd Street/I-88 improvement cost sharing issue to acceptance of the Harger Road bridge over Salt Creek from the Toll Highway Authority. The Village had recently declined to accept ownership of the bridge. Informal conversations then indicated that the Authority was so desirous of divesting such "off system" facilities that it might entertain the idea %if participating in future improvements at the 22nd Street/I-88 structure in exchange for an agreement i with the Village on the Harger bridge. We made that proposal to the Authority's chief engineer,but were not entirely successful. The best indication we were able to obtain was an oral representation that the Authority would probably participate in the improvement when the time came. We kept the door open by negotiating into the letter of intent with IDO'r the right to transfer the local share to another entity. Since the letter of intent was executed last June 24, the Toll Authority has made it very clear that it will not issue a permit to the Village for a bike path on the Harger Road bridge pursuant to a general policy concerning such permits on the tollway "system". The Authority's real desire, of course, is for the bridge to cease to be a part of the system, in which case the owner of the bridge (i.c., the Village) can permit what it wants. Based on a similar"we'll do our job, you do yours"philosophy, we have continued to argue that Toll Authority participation in the 22"' Street/I-88 improvement was appropriate. Village President and Board of Trustees June 3, 1"9 Page 3 Pursuant to the same philosophy, we have continued to argue to MOT that the 22' Streetll-88 structure is not a local facility and is properly a responsibility of the State (with or without participation from the Toll Authority). Perhaps as a result of those efforts, the transfer agreement for 22'Street does not include a provision regarding cost sharing for that project. Finally, Governor Ryan this Spring proposed, and the General Assembly approved, a massive State spending program focussed in part on transportation infrastructure. The Village has strenuously encouraged 'inclusion of the 22ad Street Strategic Regional Arterial project in the program and definition of that project to include the 22'Streetdl-88 structure. It is not yet entirely clear how that j project is treated in the Illinois FIRST program, but we believe it is in the best interests of the Village to complete the jurisdictional transfer agreements as soon as possible and concurrent with the final acceptance of the 22"/York intersection project(expected around the end of this month) in order to reinstate 22'Street as part of the State system. It is important to remember that even if the State (either on its own or together with the Tollway Authority) sloes not ultimately step up to the viaduct improvement in its entirety, this transfer is an extremely advantageous move for the Village. Our major street maintenance responsibilities are reduced very substantially by the exchange especially in terns of snow and ice removal. The Village's future obligations for the costs of major improvements are reduced by many millions of dollars. Accordingly, I recommend that the Village proceed at this time with the jurisdictional transfer agreements. In the near future,we will recommend acceptance of the Harger Road bridge from the Toll Highway Authority in order to move the safety pathway project forward. Inc. The requirement to advertise for competitive sealed bids was waived so that the original manufacturer could perform the proposed repairs, j modifications and paint work. Staff was able to negotiate a better j warranty (three (3) years for both paint and modifications) from the manufacturer than would have been possible from a different company. The total cost to refurbish and repaint Engine 915 will be $36,150, including $4,500 credit for corrosion damage that was out of warranty. The cost exceeds the budgeted amount because the j following two (2) additional items were added after the budget process: A licensed and bonded driver from Mid-America will be provided to deliver the Vi!lage's vehicle to the factory in Ocala, Florida and then to return it after the work is completed. Staff recommends this option in lieu of the more costly alternative of paying overtime and travel expenses for a firefighter to deliver and pick up the vehicle;and The installation of additional warning lights on the rear compartments to enhance emergency scene visibility from the rear of the vehicle. The reflector and lens should be cleaned each time a lamp is replaced. 2. Keep signal posts, controller pedestals, and foundations in alignment at all times. 3. Keep signal posts and controller pedestals tight on foundation. 4. Keep signal heads and controller cabinets tight on their pedestals and properly adjusted. 5. Keep detector equipment in proper working order at all times. 6. Check the controllers, relays, and detectors at least once every mouth to ascertain that they are functioning properly and make all necessary repairs and replacements. f 7. Furnish and install temporary controller whenever necessary. I 8. Keep interior of ,;,ortroller cabinets in a neat condition at all times. 9. Remove to clean and overhaul the controllers, relays, special auxiliary control equipment, and time clock once a year or more often if necessary. A record tag shall be attached to each controller on which the date of over- haul or other service work shall be indicated. 10. Replace burned out fuses. ll.. Clean reflectors, lenses. and lamps once every six (6) months. F 12. Repaint all signal components mponents exposed to weather at least once every two (2) years. i 13. Group relamp traffic signal heads at the expiration of the average rated lamp life. 14. Repair or replace any and all equipment damaged by any cause whatsoever. 15. Be responsible to make recovery for damage to any part of the installation or systems from the party causing the damage. 16. Place a stop sign on each approach to the intersection as a temporary means of regulating traffic whenever repairs at a signalized intersection require that the controller be disconnected. 17. Respond to emergency calls from authorized parties twenty-four (24) .hours a day, including Saturdays, Sundays, and holidays. Controller failure, lights out, knockdowns, or two (2) red lights out at an intersection are considered emergencies. 18.
