President Bushy publicly commended staff for their efforts in recodification of the Public Works Construction Standards. Trustee Savino noted that the Village Board received a letter from William Lindeman, President of the Brook Forest Homeowners VILLAGE OF OAK BROOK Minutes 4 of 12 July 13, 1999 The Village Board of Trustees concurred with the Village President's recommendation that the Presidents of the Homeowners Associations be the Complete Count Committee. President Bushy further indicated that the Conference dealt with the issues of drug control, violence, guns and violence in schools. She will meet with the Village Manager and Police Chief to address these issues and will present some suggestions to the Village Board of Trustees. She thanked the Board for their support in her attendance of these meetings. B. VILLAGE MANAGER: VILLAGE MANAGER Village Manager Veitch explained that Senator Walsh and Representative Durkin have been invited to attend a Village Board meeting to address the results of the recently concluded legislative session in Springfield. They may be addressing the Board July 12, 13, or 27, 1999. The Tennis Dome was dismantled for summer storage, since it is a temporary structure that requires it to be dismantled otherwise it would have to have a fire suppression system as a permanent structure. 9. DEPARTMENTAL REPORTS: No Business. 10. UNFINISHED AND NEW BUSINESS (Final Action Not Anticipated): A. RECOMMENDATION - VILLAGE OF OAK BROOK - 600 OAK VILLAGE OF OAK BROOK ROAD - SPECIAL USE - LIBRARY: BROOK - SPECIAL USE - LIBRARY The Village of Oak Brook proposes to construct_a 24,000 square foot (600 Oak Brook public library, together with associated parking and enclosed garden Road) spaces on a site approximately three (3) acres in size on the 270-acre Oak Brook Sports Core. The site is located approximately 140 feet north of Oak Brook Road (31st Street) and 800 feet west of Grant Street along the south edge of the Sports Core property. The site includes the area formerly occupied by horse stables. The site was selected after a lengthy process that considered sites on public property owned by the Oak Brook Park District, School District 53 and the Village. The voters authorized location of the Library on the Sports Core by referendum in November 1996. Subsequently, the sufficiency of the referendum process was litigated through the appellate level with the Village ultimately prevailing. VILLAGE OF OAK BROOK Minutes 20 of 33 June 22, 1999 • i The proposed building is positioned on the site to maximize views across the Sports Core open fields and to avoid soils less suitable for building construction toward the western side of the site. The building essentially straddles existing Polo Road as it turns north along the west side of the open fields. The entrance to Polo Road would be relocated approximately 1,000 feet west of its current location and meander north to rejoin existing Polo Road north of the site. The property on which the Library is to be located is zoned CR Conservation/Recreation. Libraries are provided for as special uses in the CR District pursuant to Section VI-A 2(f) of the Zoning Ordinance. The extremely large size of the zoning lot in question renders most of the applicable bulk regulations moot in this case, with the exception of front yard setback and structure height. Section VI-A 7 (a) (2) of the Zoning Ordinance requires a 100-foot setback from Oak Brook Road. The site plan as drawn indicates a setback of 146 feet to the edge of the parking area south of the building. This setback was determined based on the anticipated transfer or right-of-way to DuPage County by the Village of Oak Brook in connection with the County project to improve Oak Brook Road between York Road and Jorie Boulevard. Although the Ordinance provides that no yard or density penalty would result from this conveyance of right-of-way for road widening, the Village desires that the setback that remains after the improvement be substantial and in conformity with CR District requirements. Approximately 42 feet of right-of-way will be conveyed in this particular location. With respect to structure height, Section VI-A 6 of the Zoning Ordinance limits structure height for special uses in the CR District to 40 feet. The elevation drawings indicate a structure height of approximately 36 feet 4 inches. The Zoning Ordinance requires one (1) off-street parking space per 500 feet of floor area for libraries, museums and art galleries. The site plan provides 94 spaces, nearly double the 48 required. This has been done in order to comfortably accommodate users of the public meeting rooms and Library staff simultaneously with Library patrons. Section 7.2 of the Rules of Procedure of the Oak Brook Plan Commission provides that the Commission shall consider certain factors in its review of applications for special use permits. The VILLAGE OF OAK BROOK Minutes 21 of 33 June 22, 1999 Village's assertions relative to the Section 7.2 factors, and suggested findings pertaining to same, are as follows: (a) For proposed uses operated by a public agency or proposed uses traditionally affected with the public interest, the proposed building or use at the particular location requested is necessary or desirable to provide a service or a facility which is in the interest of the public convenience. The proposed use at this particular location is desirable to provide a service (i.e., an adequate public library for Oak Brook) which is in the interest of the public convenience. The site is located on a major thoroughfare, near community recreation facilities, adjacent to a major link to the community's safety pathway system, and convenient to Butler Junior High School. The site is already owned by the public, obviating the need to acquire land for the project at a very substantial cost. Furthermore, use of the Sports Core property for cultural pursuits is consistent with the wishes of the former owner of the property, community founder Paul Butler, as expressed in a letter addressed to the residents of the Village of Oak Brook dated June 3, 1977. (b) The proposed building or use will not cause substantial injury to the value of other property in the neighborhood in which it is located. The Library will enhance the area of the Sports Core in which it will be located, as well as the larger neighborhood. Indeed, a state-of-the- art library will enhance the value of property throughout the Village. There will be no detrimental impacts on adjacent property; the Library will be located more than 800 feet from the nearest occupied structures (the homes on Grant Street). (c) The proposed building or use will be so designed, located and operated that the public health, safety and welfare will be protected. The building and site plan have been designed as to provide a facility that takes advantage of the natural beauty of the Sports Core while remaining safe and accessible to vehicles, bicycles and pedestrians. It will conform to all applicable accessibility codes. The Library will be extremely distant from neighboring property, but will be adjacent to and quite visible from a major traffic artery. VILLAGE OF OAK BROOK Minutes 22 of 33 June 22, 1999 4; /s.� In summary, the Village of Oak Brook seeks approval of a special use permit to locate the Oak Brook Public Library on a portion of the Oak Brook Sports Core pursuant to the applicable provisions of the Zoning Ordinance. No variations are being sought and the project has been sited and designed so as to have no material impact at all on any adjacent property. The Plan Commission, on May 17, 1999, held the required hearing for the Village's petition for Special Use approval for the Library to be located on the Sports Core property. During public testimony, one (1)resident raised questions regarding the location of the building and expressed the opinion that the building should be relocated to the west of the proposed location regardless of the soil conditions. It was argued that this location would avoid the loss of open space that is used for soccer, parking and special events. The Plan Commission, by a vote of 6 to 0, passed a motion recommending approval of the Library Special Use on the basis that the proposal satisfied the standards for Special Use as stipulated in the Zoning Ordinance and including the following conditional elements: 1) 'Parking lot lighting will be turned off within thirty (30) minutes after the library closes for the night with the exception of lighting necessary to provide for effective security of the facilities. 2) Exterior lighting will be so designed to avoid visibility of light sources and spillage onto adjacent properties. 3) Prior to the Zoning Board of Appeals public hearing, staff in conjunction with the design architect will develop cost estimates for construction west of the proposed location taking into account the poor soil bearing conditions. Such information will then allow the best-informed decision regarding the building location. Library Architect Carow indicated in a letter to Village Manager Veitch dated May 26, 1999 that to relocate the Library approximately fifty (50') to sixty (60') feet west the following costs would be incurred: 1) Bad soils are found in this area to the west requiring deeper foundations and footings. The estimated additional cost to the project is $70,000. VILLAGE OF OAK BROOK Minutes 23 of 33 June 22, 1999 0 • 2) Moving parking further west will destroy an existing grove of trees, thirty (30) of which are identified as having value. To replace all of them is estimated to be $300 per tree or $9,000 total. Obviously not each tree needs to be replaced. 3) The land pitches sharply downward just west of Carow's proposed access road. To move the road requires major filling, a new culvert, and retainage of the slopes estimated to cost another $70,000. The road can be left where it is but it will be atop the space allocated for future parking. Any expansion or addition to the building will be without convenient parking. The Zoning Board of Appeals, on June 1, 1999, held the required public hearing regarding the Village's petition for Special Use to locate the new Public Library at the Sports Core. The Board was in receipt of the Plan Commission recommendation for approval. One (1) resident spoke in support of the Library and another, was in support, but objected to the location of the facility stating that he thought it should be located further west as originally planned. He felt the impact of the loss of open field space at the proposed location was more than enough to offset the increased costs relating to the bad soil conditions at the original location. It was the consensus of the Zoning Board of Appeals members that the Standards for Special Use specified within the Zoning Ordinance were satisfied and a motion was passed by a vote of 4 to 0 recommending approval of the Special Use for the Library. The motion included the following conditions: 1) The development shall be in substantial conformity with the plans as submitted. 2) All parking lot and exterior building lighting shall be designed to minimize visibility of light sources and spillage affecting the homes to the east. 3) Parking lot lighting shall be turned off within 30 minutes after the library closes for the night except for necessary security lighting. CODE REVIEW PROJECT - CHAPTER 12 AND PUBLIC WORKS CODE REVIEW — CONSTRUCTION STANDARDS: CHAPTER 12 AND PUBLIC WORKS Final substantive drafts of the comprehensive amendments to Chapter CONSTRUCTION 12 of the Code of Ordinances (Public Works) and of the associated STANDARDS Public Works Construction Standards were distributed to the Village Board on June 11, 1999. At the Board meeting of June 8, 1999 and again in the memorandum that covered the documents last week, Village Manager Veitch suggested the following schedule for consideration: June 11, 1999 - Substantive documents distributed to Village Board; June 22, 1999 - Ordinances introduced as New Business and placed on file for public review; July 13, 1999 - Ordinances considered for adoption on Active Agenda. The ordinances that are involved in adoption of these new provisions: 1) An ordinance adopting the comprehensive amendment to Chapter 12; 2) A policy ordinance adopting the Public Works Construction Standards (by reference); and 3) An ordinance amending Chapter 2 of the Code to: a) Establish the office of Village Engineer (moved from Chapter 12), b) Establish the office of Public Works Director, c) Eliminate the office of Commissioner of Noxious Weeds. COMPREHENSIVE AMENDMENT TO CHAPTER 12 The Comprehensive Amendment to Chapter 12 incorporates relevant provisions of existing Chapter 12, appropriate provisions that more accurately reflect the Village's current practices, and several new provisions. Highlights of the new chapter are described in the following paragraphs. Both bodies felt that the request satisfied the appropriate Standards and included the following conditions as part of their motions: • The development shall be in substantial conformity with the plans as submitted. • All parking lot and exterior building lighting shall be designed to minimize visibility of light sources and spillage affecting the homes to the east. • Parking lot lighting shall be turned off within 30 minutes after the library closes for the night except for necessary security lighting. In addition, the Plan Commission thought that the Village Board may want to consider relocating the building further west if the increased costs of dealing with the poor soil conditions are manageable and requested staff to have the architect develop cost estimates. Please see Architect Carow's May 26, 1999 letter for his cost figures (page 10 of this file). If it is your wish to move toward approval of this request, it would be appropriate to pass a voice motion authorizing Attorney Martens to draft the necessary ordinance for consideration at your July 13, 1999 meeting. Please include the above conditions and your decision regarding the location of the building. Background Please see Manager Veitch's May 7, 1999 letter for an overview of this proposal (see page D- D4 of this file). Comment The only issued raised to any extent during the hearing process was whether the facility should be relocated to the original planned location in spite of the increased costs due to the poor soil conditions at that location. The increased costs as described by Architect Carow are, in my estimate, probably conservative and would represent a considerable cost increase to the overall project. He briefly reviewed the background of the appeal stating that the fence/wall was built in conflict with the Zoning Ordinance. However, modifications had been made which now bring the structure into compliance. IV VILLAGE OF OAK BROOK- LIBRARY- 600 OAK BROOK ROAD- SPECIAL USE Stephen Veitch, Village Manager represented the Village in its petition. He said that the Village proposes to construct a 24,000 square foot public library, together with associated parking and enclosed garden spaces on a site approximately 3 acres in size on the 270 acre Sports Core. He described the selection of the site, the proposed project and addressed the standards relevant to Special Use petitions. The site was selected after a lengthy process and the voters authorized the location of the Library on the Sports Core property by referendum in November 1996. Subsequently, ZONING BOARD OF APPEALS Minutes June 1,1999 • • the sufficiency of the referendum process was challenged and resolved through the courts with the Village ultimately prevailing. The proposed building is positioned on the site to maximize views across the Sports Core open space and to avoid soils less suitable for building construction toward the western side of the site. The building essentially straddles the existing Polo Road as it turns north along the west side of the open fields. The entrance to Polo Road would be relocated approximately 900 feet west of its current location and meander north to rejoin existing Polo Road north of the site. The property on which the proposed Library is to be located is zoned CR Conservation/Recreation. Libraries are provided for as special uses in the CR District. The Zoning Ordinance requires a 100- foot setback from Oak Brook Road. The site plan as drawn indicates a setback of 146 feet to the edge of the parking area south of the building. The setback was determined based on the anticipated transfer of right-of-way to DuPage County by the Village in connection with the County project to improve Oak Brook Road between York Road and Jorie Blvd. The Ordinance provides that no yard or density penalty would result from this conveyance of right-of-way for road widening, however, the Village desires that the setback that remains after the improvement be in substantial conformity with the CR District requirements. Approximately 42 feet of right-of-way will be conveyed in this particular location. • The elevation drawings indicate a structure height of approximately 36 feet which is less than the maximum structure height for special uses in the CR District of 40 feet. • The site plan provides 94 parking spaces, nearly double the 48 required. The relevant standards required for the granting of a Special Use were addressed by Village Manager Veitch (see pages D-1 and D-2 of the petition file). 1. There will be no detrimental impacts on adjacent property and the Village believes the library will enhance the value of property in the Village. The use of the Sports Core property for cultural pursuits is consistent with the wishes of the former owner of the property, community founder Paul Butler as expressed in his letter dated June 3, 1977 (see copy of letter on pages D-3 and D-4 of the petition file). 2. The library will be located more than 800 feet from the nearest home. 3. The building and site plan have been designed to provide a facility that takes advantage of the natural beauty of the Sports Core while remaining safe and accessible to vehicles, bicycles and pedestrians. It will conform to all applicable accessibility codes. 4. The Library will be extremely distant from neighboring property, but will be quite visible from Oak Brook Road, but not right on it. Village Manager Veitch summarized that the Village of Oak Brook seeks approval of a special use permit to locate the Oak Brook Public Library on a portion of the Sports Core pursuant to the applicable provisions of the Zoning Ordinance. No variations are being sought and the project has been sited and designed so as to have no material impact on any adjacent property. Chairman Davis noted that there was an issue raised during the Plan Commission hearing with respect to the effect of the Library on the use of the adjacent fields. Village Manager Veitch, said that approximately 15,000 square feet of the building would sit on the area known as Field 3 which is nearly 20 acres in size. The impact would be so negligible as to be non existent. The architect said in his letter that to move the entire site to the west not only is there a problem with the soils being able to carry the load of the building, but also problems start with having to do more earthwork. Jerome Kochka, 3001 Grant Street referred to his letter previously submitted to the Plan Commission. He complained that markers were not placed showing where the Library was to be located. If it cannot be shown as an impact somehow on the public, the decision as to the site of the Library falls essentially to the property owner, in this case the Village. The Village Board is going to make the final decision on this issue, both to build the Library and the approval of the Special Use. Providing them with the cost was to provide them with all the elements necessary to make an informed decision. Member Ascher moved, seconded by Member Shah that the petitioner has satisfied the standards for recommendation of a Special Use by a public agency as required by the Zoning Ordinance and to recommend for approval the Special Use as requested. 1. The development shall be in substantial conformity with the plans as submitted. 2. All parking lot and exterior building lighting shall be designed to minimize visibility of light sources and spillage affecting the homes to the east. 3. Member Girgis noted that turning left off of Oak Brook Road is very difficult now, and questioned if a stoplight was being planned as a safety issue. Village Manager Veitch said that you need various statistical standards to warrant a stoplight. Although the traffic volume on Oak Brook Road is sufficient, the key variable would be how much traffic goes in and out of the library. The profile for Oak Brook Road, is two lanes in each direction, and left turn lanes at all necessary points. Chairman Aktipis questioned when a determination could be made. Village Manager Veitch said that a determination cannot be made until after the Library is built to see what the traffic load will be. He also noted that signal warrants are very marginally met at Spring Road, but the County did indicate that they would permit a signal to be installed there if the Village would be desirous to do that. The Village does have an arrangement with the County that provides for signalization of Spring and 31St at the Villages request. The agreement with the County at that intersection is to split the cost of a signal within a limited period of time after the completion of the road. If the Village asked for a signal at the site for the Library, the County would probably not participate in the cost and it would probably be a Village expense. Member Tappin asked about the replacement and widening of the horse path. Veitch said that it will be rebuilt at about the same width and it is part of the area in the pathway system that remains unsurfaced, it is intentionally in stone screenings. The Pathway Committee recommended that the unpaved rings around the Sports Core remain unpaved, which is the preference of runners who prefer the softer surface. There was no public testimony in support of the request. Jerome Kochka, 3001 Grant Street referred to a letter that he sent to the Plan Commission, a copy of which was submitted for the official file. He believes the new Library will encroach upon the existing athletic field. It is also his belief that moving the building further west would not be a problem and that a flat slab foundation can be built anywhere in that area. He also noted that he is not against the Library, just the proposed site. If there is so much land available, why can't the Library be moved further west. Village Manager Veitch said that the placement of the building was due to soil conditions. The construction is to be built using public dollars and he will not recommend using more than absolutely necessary. The stables do not serve a useful purpose and have been gone for four years. It is the Village's position that the proposed site does not encroach onto the fields or in any way impede the current or future uses of the field. They did not look further north because they do not want the building located too close to Oak Brook Road for safety reasons. Member Allen asked if the Library site were moved further west would the cost increase much. Village Manger Veitch said that it would have created extraordinary foundation work. Originally, they wanted the building further west, but the proposed site is as far west as it can go without incurring extraordinary costs. Member Goel said that as an engineer, if the soil borings show that it cannot support the weight of the building, then it will be extremely costly to design the foundations. PLAN COMMISSION Minutes May 17, 1999 4 61?C4-011 Member Girgis noted that Oak Brook has some of the best soccer fields in DuPage County and anything that compromises that should be seriously reviewed. The Village should be sure that the selected site is as far west as it can be located. He questioned what the additional cost would be to build a stronger foundation to be placed on the poorer soil. Village Manager Veitch said that they have not designed that foundation to know the potential cost. The building as last estimated, without extraordinary features in terms of the foundation, is about one million more than they wanted to pay. They are working hard on trying to keep engineering cost down, even as it is designed now. It would not be his recommendation to the Village Board that the public incur even more cost to provide those foundations. With respect to soccer, there is quite a bit of flexibility in the way the land can be used. Part of the Village's agreement with the County with respect to the 31 st right-of-way improvement provides for the flood plain compensatory storage that has to be provided. The old show fields will be regraded and lowered a little. It will be constructed by the County for the Village as two new soccer fields and the County will also reconstruct Bath and Tennis Drive when the road is widened. Member Pequet said that in light of the sensitivities to the open space issue that perhaps they should at least take the time to explore the cost of an alternate foundation system. Additional engineering and spread footings might be $50,000-100,000 or$500,000. We should look at the numbers and then make a better decision as to how much additional work would be necessary. We should develop preliminary cost estimates for the added foundation cost if the site is moved to the west. Member Girgis said that the Plan Commission's focus is to do what is best for the Village now and 10-30 years from now. Is it better to preserve a field as open as possible if the cost is not huge. Village Manager Veitch noted that when you move the building, the parking area also moves that way. As you get further into the woods, the quality of trees improves. The amount of tree loss with the project would increase accordingly. Member Allen questioned if the soccer fields and play areas are reconfigured, how much is really being lost, especially if two additional soccer fields are added. Member Goel said that he walked the site. There was activity going on and it seemed pretty far from the proposed site. There is no doubt there is encroachment into the field, but the real activity was not effected. Village Manger Veitch said that the building is 24,000 feet, slightly more than half of the building is east of the road. 15,000 feet of what is now the unused edge of the field, is involved in this. There are no outdoor activities planned east of the Library. It is the Village's intention to have people look at the Library, as a tribute to the community that built it. i Mr. Kochka said that cutting the trees down is not a major factor. If the building is going to be on a slab, the ground conditions are not that critical. Ruth Martin, Library Director, said that visibility, accessibility, and proximity were the considerations of the Board of Trustees. Proximity is to be near the road and near places that people congregate. Accessibility is building a road to it and having adequate parking and handicapped accessible. Visibility is having it fairly close to 31 st Street without making it dangerous for any child who might run out into the parking lot. PLAN COMMISSION Minutes May 17, 1999 daz 5 Member Pequet said that he believes the Plan Commission is trying to make a judgment call, without having all the facts for the actual costs and he believes that is an issue. Chairman Aktipis said that Mr. Kochka's point of view is to move the Library to maintain the open field. The consideration is the soccer fields, versus the additional cost. Trustee Savino said that at the Antique Show he took tickets from people coming into the event at the Sports Core and while this was going on there were two soccer games being played. He does not see how the Library will impede on the fields at all. Member Goel noted that besides the extra cost of the foundation, then the building will encroach on and destroy additional vegetation rather than using part of an open field. Village Manager Veitch noted that as you go farther west the topography starts to slope off. He added that he did speak with the architect prior to the meeting and the specific location of the building was driven entirely by the soil sample. Member Tappin said that there is a trade off. Two new soccer fields are gained up north and the Village is not giving up too much by placing the Library at this location. The key issue is what is really the expense of placing it further west, and that cannot be answered at this meeting. A conditional approval may be the way to go. Village Manager Veitch said that the project is being estimated out at a substantially higher cost than the Village estimated. He felt he had a responsibility to do whatever he could to minimize cost and still deliver the facility the community wants. He advised the architect to stay on good soil. Village Manager Veitch said that the impact would be significant if it meant redesigning the building. The Village would incur substantial additional costs as well as time to go back and redesign the foundation system to move it seventy-five feet. The project is estimated at 5.2 million, one million higher than anticipated. Adding another 50 to 200 thousand dollars to the cost of the project is too much. Trustee Savino said that the Board of Trustees is now 100% in support of this design and would not want to change it. However, if it could be moved back without any additional cost he would concur with Tom Hawk's suggestion to condition the approval on the Zoning Board of Appeals review of the costs. Member Girgis said that the concept is fine. When you build a building it is an irreversible change to the area that you have to live with. There is a cost benefit balance and sometimes there is a little bit extra cost but you get a benefit long term and you get what you really want. If the cost is little and it was never explored then we are not doing justice long term if we do not entertain that possibility. Tom Hawk indicated that a motion to recommend approval could include a condition that increased foundation cost estimates be developed prior to the Zoning Board of Appeals public hearing. This will then allow this petition process to move forward without penalizing the planned time schedule. The Board of Trustees will then have the information they need to make an informed decision. Village Manager Veitch said that he should be able to get an estimate prior to the Zoning Board of Appeals meeting. This letter will describe the project and address the standards relevant to special use petitions. DESCRIPTION OF THE PROJECT The Village of Oak Brook proposes to construct a 24,000 square foot public library, together with associated parking and enclosed garden spaces on a site approximately 3 acres in size on the 270 acre Oak Brook Sports Core. The site is located approximately 140 feet north of Oak Brook Road(31" Street) and 800 feet west of Grant Street along the south edge of the Sports Core property. The site includes the area formerly occupied by horse stables. The site was selected after a lengthy process that considered sites on public property owned by the Oak Brook Park District, School District 53, and the Village. The voters authorized location of the Library on the Sports Core by referendum in November 1996. Subsequently,the sufficiency of the referendum process was litigated through the appellate level with the Village ultimately prevailing. The proposed building is positioned on the site to maximize views across the Sports Core open fields and to avoid soils less suitable for building construction toward the western side of the site. The building essentially straddles existing Polo Road as it turns north along the west side of the open fields. The entrance to Polo Road would be relocated approximately 1,000 feet west of its current location and meander north to rejoin existing Polo Road north of the site. PETITION FOR SPECIAL USE The property on which the Library is to be located is zoned CR Conservation/Recreation. Libraries are provided for as special uses in the CR District pursuant to Section VI-A 2(f) of the Zoning Ordinance. The f Oak Brook Plan Commis* Oak Brook Zoning Board of Appeals May 7, 1999 Page 2 extremely large size of the zoning lot in question renders most of the applicable bulk regulations moot in this case, with the exception of front yard setback and structure height. Section VI-A 7 (a) (2)of the Zoning Ordinance requires a 100-foot setback from Oak Brook Road. The site plan as drawn indicates a setback of 146 feet to the edge of the parking area south of the building. This setback was determined based on the anticipated transfer or right-of-way to DuPage County by the Village of Oak Brook in connection with the County project to improve Oak Brook Road between York Road and Jorie Boulevard. Although the Ordinance provides that no yard or density penalty would result from this conveyance of right-of-way for road widening, the Village desires that the setback that remains after the improvement be substantial and in conformity with CR District requirements. Approximately 42 feet of right-of-way will be conveyed in this particular location. With respect to structure height, Section VI-A 6 of the Zoning Ordinance limits structure height for special uses in the CR District to 40 feet. The elevation drawings indicate a structure height of approximately 36 feet 4 inches. The Zoning Ordinance requires one off-street parking space per 500 feet of floor area for libraries, museums and art galleries. The site plan provides 94 spaces,nearly double the 48 required. This has been done in order to comfortably accommodate users of the public meeting rooms and Library staff simultaneously with Library patrons. Section 7.2 Factors. Section 7.2 of the Rules of Procedure of the Oak Brook Plan Commission provides that the Commission shall consider certain factors in its review of applications for special use permits. The Village's assertions relative to the Section 7.2 factors, and suggested findings pertaining to same, are as follows: (a) F osed uses operated by a public agency or proposed uses traditionally affected with the public inte st,the proposed building or use at the particular location requested is necessary or desirable to rovide a service or a facility which is in the interest of the public convenience. The pr�use s part icular location is desirable to provide a service (i.e., an adequate public library for Oak Brook)which is in the interest of the public convenience. The site is located on a major thoroughfare, near community recreation facilities, adjacent to a major link the community's safety pathway system, and convenient to Butler Junior High School. The site is already owned by the public, obviating the need to acquire land for the project at a very substantial cost. Furthermore, use of the Sports Core property for cultural pursuits is consistent with the wishes of the former owner of the property, community founder Paul Butler, as expressed in the attached letter addressed to the residents of the Village of Oak Brook dated June 3, 1977. (b) The proposed building or use will not cause substantial injury to the value of other property in the neighborhood in which it is located. The Library will enhance the area of the Sports Core in which it will be located, as well as the larger neighborhood. Indeed, a state-of-the-art library will enhance the value of property throughout the Village. There will be no detrimental impacts on adjacent property; the Library will be located more than 800 feet from the nearest occupied structures(the homes on Grant Street). f Oak Brook Plan Commissf is Oak Brook Zoning Board of Appeals May 7, 1999 Page 3 (c) The proposed building or use will be so designed,located and operated that the public health, safety and welfare will be protected. It will conform to all applicable accessibility codes. The Library will be extremely distant from neighboring property,but will be adjacent to and quite visible from a major traffic artery. SUMMARY AND CONCLUSION In summary,the Village of Oak Brook seeks approval of a special use permit to locate the Oak Brook Public Library on a portion of the Oak Brook Sports Core pursuant to the applicable provisions of the Zoning Ordinance. No variations are being sought and the project has been sited and designed so as to have no material impact at all on any adjacent property. The last of these was several years ago when I brought to the attention of all residents that we were at about the half-way mark on resident population that had been planned and that along with this we had used up half the land intended for residential development and still had available the other half. Should we, I asked, continue on as we had been going or make changes? Your reply, which favored continuing on the same plan that we'd been follow- ing, was an important guide to us at that moment. I am now writing you about the future of the Sports Core and what should be done about it. Going back many years, and while we were still engaged in gathering and acquiring all the land which we subsequently used in incorporating the Vil- lage of Oak Brook, the first piece I developed in its' present high state of perfection was the Sports Core. This took place before any of the residen- tial, commercial or industrial and played an important part in attracting the best of these developments as they came about, including our regional shop- ping center and saving its' income for the Village which has since Contributed so greatly to Oak Brook's coming to be a handsome and wealthy town. During all this period Butler Company has maintained the Sports Core at its' own expense, without calling on the Village Board of Trustees or the Park Board for any help. In some respects I wish this could continue forever, but since that might not be possible to count on, I am taking you into consultation with me to see what can be done about it. It may be that the Sports Core has already served its' most useful purpose for the Village on matters such as increasing residential values. However, it would be safer and much more valuable to continue the Sports Core and maintain it in its' present form, hopefully for a long time into the future. Butler Company has agreed with the Village President and Board of Trustees that it is willing to sell the Sports Core to the Village, providing that it' s reasonably unanimous that the Village wants it. Residents of Oak Broo6 • June 3, 1977 Page Two. If, for the economics of the Butler Company, as present owner, or the Village, if it comes to be the owner, or both, it should become necessary or even ad- visable that there be some kind of development in the Sports Core, a part of it could be set aside for such a development and all the balance kept and continued as the Sports Core itself. A safe way for the Village to participate in this, if acquiring the Sports Core at the price put on it by the appraisers, would be to market this set-aside portion for the use of something they would be pleased to have, such as a campus/park, and sell it for the original cost of the whole. For example, at current value of ORA property in Oak Brook of $125, 000 per acre, 80 acres developed in this way would yield $10, 000, 000, the entire value of the Village's purchase. This would be marketing and using in this way less than 201,'0 of the land in the Sports Core when including the Butler National Golf Club, which is an important part of the Sports Core. Also, the Sports Core is already surrounded on three sides by commercial and industrial; on the east by the Drake Oak Brook, on the north by commercial, on the west by industrial and on the south by the forests; actual residential frontage being only one-fifth of the total of the four sides, so using a relatively small part to finance perpetuating the balance might not seem too out of place and this was actually in mind originally when the Sports Core was put together tying up such a large piece of land. Regarding the Sports Core and its' future, I feel exactly as has been expressed time after time by our Chief Executive Officers in the Village starting with Sam Dean and continued even more strongly by George Howell, and I would like to include Ted Mohlman, since he helped me put it together originally, which is that we would all feel askance to have the Sports Core developed either in resi- dential or commercial, or probably in any way whatsoever except sports, re- creational or cultural and I think that these Village Presidents, respectively, have felt that their Boards of Trustees have felt the same way as they have about this. For my part, I feel that most of the residents feel the same way as I do on this matter.
