A RESOLUTION ACCEPTING THE
PRESSURE ADJUSTING STATIONS PA-16A AND 168
WHEREAS, the Water Purchase and Sale Contract between the DuPage Water
Commission (the "Commission") and its Charter Customers (the "Contract")
provides that each Charter Customer is responsible for the siting, design and
construction of pressure increasing/reducing stations (the "Pressure Adjusting
Stations") to convey water from the Commission's Waterworks System into such
Charter Customer's Unit System; and
WHEREAS, the Village of Oak Brook is a Charter Customer of the DuPage
Water Commission; and
WHEREAS, the Commission has paid the Village of Oak Brook 55% of the
estimated construction costs for pressure adjusting stations PA-16A and 16B;
and
WHEREAS, the Commission requires, inter alia, that the Village of Oak
Brook adopt a resolution accepting the pressure adjusting stations for
purposes related solely to establish the full reasonable reimbursement for PA
Station construction due under the Contract before the Commission will
reimburse the Village of Oak Brook for the remaining unreimbursed cost of
construction; and
WHEREAS, the Village of Oak Brook and the Village's engineers, Hama
Environmental Services, Inc. certify that the total reimbursable construction
and engineering cost is $811,615.01; and
WHEREAS, the Village of Oak Brook has followed the procedures established
in "Pressure Adjusting Stations Reimbursement Documentation Requirements"
dated February 15, 1989;
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS in the exercise
of its powers as follows:
Section is The foregoing recitals are incorporated herein and made a
part hereof as findings of the Board of Trustees of the Village of Oak Brook.
Section 2: The Village of Oak Brook hereby accepts pressure adjusting
stations PA-16A and 16B as being fully completed for purposes related solely
to establish the full reasonable reimbursement for PA Station construction due
under the Contract in accordance with the requirements of the Village of
Oak Brook.
Section 3: The Resolution shall be in full force and effect from and
after its adoption.

President and Board of Trustees of the Village of Oak Brook, DuPage and Cook
Counties, Illinois, according to a roll call vote as follows:
