WHIUAS, a certain garbage dump operation is being
conducted on the easterly boundary of Oakbrook, Illinois, by
the John Sexton Company or its successors or by others; and
WkZRWp it has been found and determined that said
garbage dump is used as a public dump and is within approxi-
mately eight hundred feet of single - family residences in the
Village of Oakbrook, and that approximately three hundred twenty
acres are being used by said dump, and that raw and untreated
garbage and refuse and other organic matter are dumped daily in
large quantities; and
WBMLRAS, it has been further found and determined that
the dump creates a serious hazard to the health an: welfare of
the inhabitants of this Village who era perpetually disturbed by
the odors, flies, dust and particles, fumes and insects, vermin
and pests that =wsnate from that dump and which permeate the entire
easterly portion of this Village adjoining said dump, and the said
dump has now boon elevated approximately ninety feet above the
average elevation of said easterly portion of the Village and
the original terrain and elevation of said dump before these dump
operations were commenced; and
WhtBhZASp it has been further found and determined that:
a. The property used for the dump is Saved under the
:.auk County Zoning Ordinance for single - family use at the
present time and has been so soned since 1940,, and that
at no time tuffs it beep soned or is it now gonad to permit
the garbage dump operation now being operated on that
property.

matter of law by state statute and that there is no

Board of Trusteat_ of the Village of Oakbroo&s Illinois:

9ection:2. That the Village Attorneys Jack S. Bowers,
and Nicholas T. Kitsos as Special Assistant Village Attorney four

institute logal "proceedings of whatever nature and kind necessary
to abate said nuisances and to ultimately terminate and bring to

property; that for these purposes the said Nicholas To Mass is
hereby aaaployed and retained as Special Assistant Village Attorney
for the VilLsge of Oakbrook.
