R-596 - 09/14/1993 - FINAL PLAT - Resolutions ._ � � 1� Sct�A�✓is► onI tAlALpLAT ofResuB C-CW;N1GTT0PJ SW$ 5 - oy -93 J RESOLUTION 93-SD-R- 596 A RESOLUTION APPROVING THE FINAL PLAT OF RESUBDIVISION KNOWN AS COVINGTON SUBDIVISION (Formerly Whitehall Park Subdivision) 1950 W. 35th Street WHEREAS, the Plan Commission of the Village of Oak Brook on June 21, 1993 recommended approval of the Final Plat of Resubdivision of the subdivision entitled, "Covington"; and WHEREAS, the Village President and Board of Trustees considered the recommendation of the Plan Commission and concur with the same, subject to certain conditions; NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the Final Plat of Resubdivision of Covington prepared by Bollinger, Lach & Associates, Inc. and dated as last revised August 13, 1993, be and is hereby approved subject to the conditions enumerated in Section 2 of this resolution. Section 2: That the approval of the Final Plat of Resubdivision of Covington as given in Section 1 hereof be and is hereby expressly made subject to the following conditions: (a) The requirements for street lighting, except at intersections, and public sidewalks, except for the installation of a bike path along the north side of 35th Street, are waived. (b) The parkway trees are to be in place within a five-year period or prior to the developer turning over control to the homeowners association, whichever should occur first, and the developer must provide a letter of credit for one year longer than the said five- year period, and reductions to the letter of credit shall be in accordance with applicable sections of the Subdivision Regulations of the Village of Oak Brook. (c) Declaration of Homeowner Covenants, Conditions and Restrictions shall be in a form acceptable to the Village Attorney. (d) The easement over Lots 24 and 25, designated emergency vehicle access, shall be repaired and maintained by the homeowners association. (e) Written documentation shall be submitted to the Village of Oak Brook that agreement has been reached with Butler School District 53 and Hinsdale School District 86 confirming school contributions prior to final recording. Resolution 93-SD-R-596 Approving Final Plat Covington Page 2 (f) The sum of $18,000 shall be deposited by the developer in escrow pursuant to an agreement acceptable to the Village Attorney, which provides that these funds shall be remitted to the Village of Oak Brook, for 35th Street roadway improvements, specifically from Midwest Road east, at such time as the Village undertakes such roadway improvements, within five years from the date of passage of this resolution. If the Village fails to undertake said roadway improvements within this five-year period, the escrow funds deposited by the developer shall be promptly returned to the developer. Any interest on the escrowed funds shall be for the benefit of the developer. (g) The costs to relocate all overhead utility lines to underground along 35th Street adjacent to the development shall be borne by the developer and the developer shall furnish the Village with a letter of credit in the amount of 110% of the estimated cost and in a form acceptable to the Village Attorney as a guarantee for the relocation of said overhead utility lines. Said relocation of utility lines shall be completed within three years from the date of passage of this resolution. (h) That all other requirements, conditions and standards of the Subdivision Regulations of the Village of Oak Brook, except as waived or limited by this Resolution, shall be applicable to the subdivision and development of said Covington Subdivision.
