TY- (EMpT PRopERTy ' RENIES�atE +A eprr,�sicr�e TO vog SE cep 319*tweyets RESOLUTION AUTHORIZING EXECUTION AND DELIVERY OF ASSIGNMENT AND ACCEPTANCE OF A CERTAIN REAL ESTATE SALE CONTRACT WHEREAS, the Corporate Authorities of the Village of Oak Brook, DuPage and Cook Counties, Illinois, deem it to be in the best interest of the Village for the Village to acquire the property situated at the southeast corner of 31st Street and Meyers Road, Oak Brook, Illinois, for municipal purposes; and WHEREAS, one Frederick A. Bragiel has entered into a contract with the owner of said property, one Nancy Esposito, to purchase said property at a price of One Hundred Thirty Thousand Dollars ($130, Ono. 00) and said Frederick A. Bragiel is willing to assign ail of his right, title, and interest in and to the purchase of said property to the Village of Oak Brook and the Village of Oak Brook is willing to accept the assignment of said rights and interests and to purchase the said property in accordance with the terms and provisions of the aforesaid contract; and WHEREAS, the Corporate Authorities of the Village of Oak Brook deem the passage of this Resolution, the execution and delivery of said assignment and acceptance agreement and the implementation of the purport of this Resolution and the terms and provisions of said Real Estate Sale Contract to be in the best interest of the Village. IIOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE OF OAK BROOK, COUNTIES OF DU PAGE AND COOK, STATE OF ILLINOIS: SECTION 1: The provisions of the preamble hereinabove set forth are hereby restated and incorporated herein as though herein fully set forth. SECTION 2: The President of the Village be and he is hereby empowered and directed for and on behalf of the Village to enter Into, execute, and deliver the assignment and acceptance of that certain Real Estate Sale Contract by and between Frederick A. Bragiel, as Purchaser, and Nancy Esposito, as Seller, relative to the purchase of that certain property situated generally at the southeast corner of 31st Street and Meyers Road, Oak Brook, Illinois, the terms, provisions, and conditions of which shall take substantially the form of the Assignment and Acceptance Agreement and Real Estate Sale Contract annexed hereto and identified as Exhibit A. SECTION 3: The Village Clerk of the Village Is hereby authorized and directed to attest to the execution of said Assignment and Acceptance Agreement, affix the corporate seal thereto, and to certify the passage of this Resolution, all as otherwise provided by the ordinances of the Village of Oak Brook and the laws of the State of Illinois. SECTION 4: The President and Village Clerk be and they are hereby authorised, empowered, and directed for and on behalf of the Village to do all such further acts and things and to execute all such further documents and instruments as the AMIL President of the Village shall deem necessary and prudent in order to carry out the intent and purposes of this Resolution and the terms, provisions, and condition of the aforesaid Assignment and Acceptance Agreement and Real Estate tole Contract. BRAGIEL, as Assignor, and the VILLAGE OF OAK BROOK, a Municipal Corporation of DuPage and Cook Counties, Illinois, as Assignee /Acceptor. WHEREAS, FREDERICK A. BRAGIEL has entered into a certain Real Estate Sale Contract with Nancy Esposito pertaining to the purchase by said FREDERICK A. BRAGIEL of certain property situated at the south- east corner of Slat Street and Meyers Road, Oak Brook, Illinois, for a price of ONE HUNDRED THIRTY THOUSAND DOLLARS ($930, 000.00), a copy of said Real Estate Sale Contract being annexed hereto as Exhibit A; and WHEREAS, said FREDERICK A. BRAGIEL is willing to assign all of his right, title, and interest in and under said Real Estate Sale Contract to the VILLAGE OF OAK BROOK and the VILLAGE OF OAK BROOK is willing to accept the assignment of all said right, title, and interest.
