A RESOLUTION AUTHORIZING EXECUTION OF A FIRST SUPPLEMENTAL AGREEMENT
BETWEEN THE VILLAGE OF OAK BROOK AND THE DuPAGE FOREST PRESERVE DISTRICT

CONCERNING THE ESTABLISHMENT OF THE SALT CREEK GREENWAY TRAIL
AND THE PERFORMANCE OF PHASE II ENGINEERING SERVICES
WHEREAS, the Village of Oak Brook is desirous of participating in the establishment of the Salt
Creek Greenway Trail; and
WHEREAS, since 1998 the Village of Oak Brook has budgeted funds for the design and!
construction of a trail along or in the general vicinity of Salt Creek from the Ned Brown Forest Preserve in
northern Cook County, south through DuPage County, and connecting with the Centennial Trail at the
Nationale Historic Chicago Portage site; and
WHEREAS, on January 27, 1998 the Village Board passed a resolution authorizing the Village
President and Village Clerk to execute an intergovernmental agreement providing for the establishment of
the Salt Creek Greenway Trail and the performance of certain engineering services ( "1998 Agreement");
and
WHEREAS, under the 1998 Agreement, the parties agreed to participate in the joint funding of
Phase I i ngineering services associated with the development and construction of the Salt Creek
Greenway Trail; and
WHEREAS, in accordance with the terms of the 1998 Agreement, the contractor has completed
the Phase I engineering work for the project; and

WHEREAS, pursuant to paragraph 13 of the 1998 Agreement, each agency committed to proceed
with the Phase II engineering and construction phase of the project and to enter into appropriate
agreements to implement the Phase 11 engineering and construction phase portions of the project; and
WHEREAS, the Village of Oak Brook and other participating entities desire to proceed with the
Phase II engineering and to have the Forest Preserve District of DuPage County ( "Forest Preserve
District") continue to serve as the lead agency to the same extent as provided in the 1998 Agreement; and
WHEREAS, it is the intent of the Village that this First Supplemental Agreement is a continuation
of the 1998 Agreement and that all of the terms and conditions of the 1998 Agreement remain in full force
and effect except as modified by the First Supplemental Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as
though fully set forth herein.
Section 2: That the Village President and Village Clerk are hereby authorized to directed to
execute a First Supplemental Agreement concerning the establishment of the Salt Creek Greenway Trail

and the performance of Phase II engineering services. Said First Supplemental Agreement shall1 conform
substantially to the form of agreement attached hereto as Exhibit 1.
Section 3: This resolution shall be in full force and effect from and after its passage and approval
as provided by law.
PASSED AND APPROVED this 14th day of May, 2002, by the President and Board !of
Trustees of the Village of Oak Brook, DuPage and Cook Counties, Illinois, according to a roll call 1vote as
follows:
