R-99 - 06/10/1969 - ZONING - Resolutions® ® zowlJ& : fka one ;i #J6_ (� _ cic a� i +eat- fte4EST by �An4E Cep;Jf�/ STATE OF ILLINOIS ) PgTiT;*o4.aa70 COUNTY OF DU PAGE ) SS MgySLAKE— VILLAGE OF OAKBROOK R E S O L U T I O N OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAKBROOK, DU PAGE COUNTY, ILLINOIS, PROTESTING OF DU PAGE COUNTY ZONING PETITION NO. 2070 Whereas, Section VIII, G, of the DuPage County Zoning ordi- nance, adopted on December 10, 1935, as subsequently amended in its entirety effective May 1, 1957, and again revised effective February 27, 1968, as further amended, provides that upon written protest against any proposed amendment to the aforesaid ordinance by the President and Board of Trustees of a municipality where the land effected lies within one and one -half (1 -1/2) miles of the limits of a zoned municipality, filed with the County Clerk, such amendment shall not be passed except by the favorable vote of three - fourths (3/4) of all members of the County Board; and Whereas, Petition No. 2070 by James D. Murphy, Attorney, was filed with the DuPage County Building and Zoning Department making application for rezoning from R -1 Single - Family Residence District to R -2 Single - Family Residence District on the property hereinafter described: All of that part of the South Half of Section 34 and the South Half of Section 35, lying West of Illinois State Route 83 and East of Cass Avenue, all in Town- ship 39 North, Range 11, East of the Third Principal Meridian, in DuPage County, Illinois. This property being situated on the south side of 35th Street be- tween Cass Avenue and State Highway Route 83. Whereas, the Zoning Board of Appeals of DuPage County held and conducted a public hearing on the aforesaid application on May 29, 1969; and Whereas, the aforesaid application concerns land located within one and one -half (1 -1/2) miles of the corporate limits of the Vil- lage of Oakbrook, a municipal corporation in DuPage County, Illinois, and the Village of Oakbrook is the municipality with limits nearest adjacent; and whereas, it is the opinion of the President and Board of Trustees of the Village of Oakbrook that the application by James D. Murphy for rezoning from R -1 Single - Family Residence District to R -2 Single - Family Residence District at the location and on .the property described above, is not desirable for the public welfare and is contrary to the public interest and that the same would be incompatible with land uses now Vowail of in said area and would be incompatible with land uses eotu#&1y;exLatin9 in said area and that the granting of the rezoning request would be deleterious of property values and would place an extra- ordinary burden on governmental services in the terri- tory effected and that rezoning of the property would be spot zoning inconsistent with the long range planning goals of the County of DuPage and the Village of oakbrookl and -2- whereas, it is the opinion of the President and Hoard of Trustees of the Village of Oakbrook that the petitioner is not now denied the enjoyment and benefit of the property under the present roperty isimarchantibleaan now fzoned Ca d eclassified; andoe the Whereas, it is further the opinion of the President and Board of Trustees of the Village of Oakbrook that the petition is not proper for rezoning the subject property in that the petitioner acquired a.Special Use Permit for part of the property involved in this application under Petition No- 1471, issued February 19, 1963, covering..33 acres in the south quarter of Section 34 and constructed buildings pursuant to that Special Use and that to subsequently r®sone the property would have the effect of termin- sting the 'Special_USe- NOW, ITHEREFORB, BE IT AND IT. IS HEREBY RESOLVED by the President and Board of Trustees of the Village of.Oakbrook, DuPage County, Illinois, that the said Village of.0akbrook does protest the grant - ing of the rezoning requested by Petition No. 2070 applied for by James D. Murphy, and that the Village Clerk is directed to communi- Cate this p3COtept to the Board of Supervisors of DuPage County and the DuPage County Building and Zoning Department and the DuPage County Zoning Board of Appeals.
