A RESOLUTION AUTHORIZING EXECUTION OF A SECOND
SUPPLEMENTAL AGREEMENT BETWEEN THE VILLAGE OF
OAK BROOK AND THE DUPAGE FOREST PRESERVE DISTRICT,
ADDISON PARK DISTRICT, VILLAGE OF ADDISON, ELMHURST
PARK DISTRICT AND VILLAGE OF VILLA PARK CONCERNING THE
ESTABLISHMENT OF THE SALT CREEK GREENWAY TRAIL AND THE

PERFORMANCE OF PHASE 3 ENGINEERING SERVICES AND CONSTRUCTION
WHEREAS, the Village of Oak Brook is desirous of participating in the establishment of the Salt

Creek Greenway Trail; and
WiI HEREAS, since 1998 the Village of Oak Brook has budgeted funds for the design and
construction of a trail along or in the general vicinity of Salt Creek from the Ned Brown Forest Preserve in
northern Cook County, south through DuPage County, and connecting with the Centennial Trail at the
National Historic Chicago Portage site, and
WHEREAS, on January 27, 1998 the Village Board passed a resolution authorizing the Village
President and Village Clerk to execute an intergovernmental agreement providing for the establishment of
the Salt Creek Greenway Trail and the performance of certain engineering services ("1998 Agreement "),
and
WHEREAS, on May 14, 2002 the Village Board passed Resolution 2002- AG -EX1 -R -807, entitled,
"A Resolution Authorizing Execution of a First Supplemental Agreement Between the Village of Oak Brook
and the DuPage Forest Preserve District Concerning the Establishment of the Salt Creek Green ay Trail
and the Performance of Phase II Engineering Services ", and
WHEREAS, the Village of Oak Brook and other participating entities desire to proceed with the
Phase 3 Engineering Services and Construction and to have the Forest Preserve District of DuPage
County ("Forest Preserve District ") continue to serve as the lead agency to the same extent as provided in
the 1998 Agreement, and
WHEREAS, it is the intent of the Village that this Second Supplemental Agreement is a
continuation of the 1998 Agreement and the First Supplemental Agreement and that all of the terms and
conditions I of the 1998 Agreement and the First Supplemental Agreement remain in full force and effect
except as modified by the Second Supplemental Agreement
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows

Section 1 That the provisions of the preamble hereinabove set forth are hereby adopted as
though fully set forth herein
Section 2. That the Village President and Village Clerk are hereby authorized and directed to
execute a Second Supplemental Agreement concerning the establishment of the Salt Creek Greenway
Trail and the performance of Phase 3 Engineering Services and Construction Said Second Supplemental

Agreement shall conform substantially to the form of agreement attached hereto as Exhibit 1
Section 3. All resolutions or parts of resolutions in conflict with this resolution are hereby repealed
to the extent of the conflict.
Section 4. This resolution shall be in full force and effect from and after Its passage, approval
and publication as required by law
