R-948 - 08/22/2006 - ZONING - ResolutionsRESOLUTION 2006— SD -FP -R -948 A RESOLUTION APPROVING THE FINAL PLAT KNOWN AS ASHLEY CHASE RESUBDIVISION AND GRANTING CERTAIN WAIVERS FROM THE PROVISIONS OF SECTION 14 -6 -3 OF TITLE 14 ( "SUBDIVISION REGULATIONS ") OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK RELATIVE TO SIDEWALKS AND STREET LIGHTING (4 and 5 Oak Court, P I N # 06 -36- 404 -056, 06 -36 -404 -057) WHEREAS, the Plan Commission of the Village of Oak Brook, on July 17, 2006, recommended the approval of the proposed Ashley Chase Resubdivision (4 and 5 Oak Court), and WHEREAS, the property at 4 and 5 Oak Court is legally described as follows Lot 3 in the Amended and Restated Plat of Subdivision of Oak Brook Lakes Subdivision, being a Subdivision of part of Lot 1 of Graue's Assessment Plat No 1, being a Subdivision in the West Half of the Southeast Quarter of Section 36, Township 39 North, Range 11, East of the Third Principal Meridian, according to the Plat thereof recorded August 30, 1996, as Document R96- 143334, in DuPage County, Illinois Lot 4 in the Amended and Restated Plat of Subdivision of Oak Brook Lakes Subdivision, being a Subdivision of part of Lot 1 of Graue's Assessment Plat No 1, being a Subdivision in the West Half of the Southeast Quarter of Section 36, Township 39 North, Range 11, East of the Third Principal Meridian, according to the Plat thereof recorded August 30, 1996, as Document R96- 143334, in DuPage County, Illinois, and WHEREAS, the Village of Oak Brook has heretofore adopted an ordinance setting forth the Subdivision Regulations for the Village of Oak Brook in Title 14 of the Village Code; and WHEREAS, the owners of the property at 4 and 5 Oak Court, David C and Suzanne C Arch, have submitted a petition for waivers of the requirements of Section 14 -6 -3E and F of the Subdivision Regulations relative to the requirement to install sidewalks and the requirement to install a street lighting system meeting Village standards, and WHEREAS, Section 14 -6 -3E and F sets forth the authority to waive sidewalk and street lighting installation, and WHEREAS, in making its recommendation, the Plan Commission found that the applicant had shown good cause for the requested waivers, and WHEREAS, the Plan Commission made the following specific finding with respect to the waivers these requirements were waived as part of the original approval of the Oak Brook Lakes Subdivision of which this resubdivision is a part, and a waiver of sidewalks and street lights is appropriate, and WHEREAS, the Village President and Board of Trustees have considered the recommendation's and findings of the Plan Commission and concur with same, and NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows Section 1 That the Final Plat of Resubdivision known as Ashley Chase Resubdivision, prepared by Bollinger, Lach & Associates, Inc, last revised May 23, 2006, be and is hereby approved Resolution 2006- SD -FP -R -948 'Y Approving Final Plat Ashley Chase Resubdivision (4 and 5 Oak Court) P I N # 06 -36- 404 -056, 06 -36- 404 -057 Page 2 of 2 Section 2 All requirements, conditions and standards of the Subdivision Regulations of the Village of Oak Brook shall be applicable to the subdivision and development of said Ashley Chase Resubdivision, except as waived or varied by this Resolution Section 3 Waivers to Section 14 -6 -3E and F of the Subdivision Regulations are hereby granted, waiving the requirement to install sidewalks and the requirement to install a street lighting system meeting Village standards Section 4 This resolution shall be in full force and effect from and after its passage, approval and publication as required by law Section 5 All resolutions or parts thereof in conflict with the provisions of this resolution be and the same are hereby repealed to the extent of such conflict APPROVED THIS 22nd day of August, 2006 Kevin uinlan Villa e President PASSED THIS 22nd day of August, 2006 9 Ayes Trustees Aktipis Craig Kennedy, Manofsky, Sanford and Yusuf Nays None Absent None St An ATTEST 164�4 C9l1 �%e%�4 IS Linda K Gonnella, CMC�� Village Clerk �7 '
