RECOMMENDED MOTION: I move that competitive bidding be waived and a sole source contract be executed with Restoric LLC for the Oak Brook Heritage Center West Wing Wall Project in an amount not to exceed $54,875 and that Resolution R -1153, A RESOLUTION APPROVING THE WAIVER OF COMPETITIVE BIDDING AND AUTHORIZING THE EXECUTION OF AN AGREEMENT BY AND BETWEEN THE VILLAGE OF OAK BROOK AND RESTORIC, LLC TO PROVIDE MASONRY RESTORATION AND TUCKPOINTING, be approved. Background/Historv: As part of the ongoing restoration of the Oak Brook Heritage Center the masonry is being either reconstructed or tuck pointed. The work is being done in stages to insure that interior spaces undergoing restoration have a weatherproof building envelope. An ongoing concern of both the Historical Society and Public Works is use of proper materials and methods for the masonry work. Use of "mismatched" mortar in past reconstruction efforts have actually hastened the deterioration of the brick walls. For this reason, staff recommends the use of Restoric LLC to perform the work. Restoric personnel have proven their ability to properly deal with historic masonry rehabilitation. Restoric has performed restoration work on several historic buildings in Northern Illinois including the Peabody Estate. They are listed as approved restoration contractors by Landmark Illinois. Their work to date on the Heritage Center has been outstanding. The attached proposal outlines the scope of work. A standard form Village contract will be used as the acquisition instrument. RESOLUTION 2012- PW- CNTRCT -R -1153 A RESOLUTION APPROVING THE WAIVER OF COMPETITIVE BIDDING AND AUTHORIZING THE EXECUTION OF AN AGREEMENT BY AND BETWEEN THE VILLAGE OF OAK BROOK AND RESTORIC, LLC TO PROVIDE MASONRY RESTORATION AND TUCKPOINTING WHEREAS, the Village is engaged in the ongoing restoration of the Oak Brook Heritage Center ( "Heritage Center'); and WHEREAS, the wall of the west wing of the Heritage Center is in need of masonry reconstruction and tuckpointing ( "Restoration Services "); and WHEREAS, use of the proper materials and expertise in the Restoration Services is important to prevent the deterioration of the Heritage Center; WHEREAS, Restoric, LLC ( "Restoric') has a long record demonstrating their expertise in restoring historical structures, including past work on the Heritage Center; WHEREAS, the Village and Restoric desire to enter into an agreement for Restoric to provide the Restoration Services in an amount not to exceed $54,875 ( "Agreement'), which Agreement is attached to this Resolution as Exhibit A; and WHEREAS, the Director of Public Works recommends that the Village waive competitive bidding and approve the Agreement for the Restoration Services; and WHEREAS, the President and Board of Trustees, being fully advised in the premises, have determined that it is in the best interests of the Village and its residents to so waive competitive bidding and to approve the Agreement for the Restoration; NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part of, this Resolution as the findings of the President and Board of Trustees of the Village of Oak Brook. Section 2: Waiver of Competitive Bidding Requirements. The advertising and bidding requirements for the purchase of Restoration Services shall be, and they are hereby, waived in accordance with the Section 8 -9 -1 of the Illinois Municipal Code and Section 1 -7-4 of the Village Municipal Code. Section 3: Approval of Purchase of Restoration Services. The purchase of Restoration Services from Restoric in a total amount not to exceed $54,875 shall be, and is hereby, approved. Section 4: Approval of the Agreement. The President and Board of Trustees hereby approve the Agreement by and between the Village and Restoric in substantially the same form as attached as Exhibit A and in a final form approved by the Village Attorney. Section 5: Execution of Agreement. The Village President and the Village Clerk shall be, and are hereby, authorized to execute the final Agreement on behalf of the Village. Section 6: Effective Date. This Resolution shall be in full force and effect from and after its passage by two- thirds of the Trustees and its approval in the manner provided by law.
