SUBJECT: 2010/2011 Permit Resolution— IDOT

RECOMMENDED MOTION: I move that the Village Board approve the attached
resolution to be in lieu of a permit bond for permit work
within State rights -of -way by Village employees.
Backeround/Historv:
Attached please find a letter dated March 15, 2010 from Thomas Gallenbach of IDOT requesting
that Oak Brook adopt a resolution that would be used in lieu of a permit bond when work is
performed by Village employees on state rights -of -way, including emergency work. This is in
keeping with past practice.
The attached Resolution has been drafted by the Village's Legal Department.
Recommendation:
I recommend that the Village Board approve the attached resolution.

RESOLUTION 2010 - IDOT -R -1074
A RESOLUTION ACCEPTING TERMS FOR A PERMIT
FROM THE ILLINOIS DEPARTMENT OF TRANSPORTATION
FOR WORK PERFORMED IN 2010 AND 2011
BY THE VILLAGE OF OAK BROOK, ILLINOIS
WHEREAS, the Village of Oak Brook, a municipal corporation, hereinafter referred to as the
"VILLAGE ", located in the counties of Cook and DuPage, State of Illinois, desires to undertake, in the
years 2010 and 2011, the location, construction, operation and maintenance of driveways and street
returns, water mains, sanitary and storm sewers, street lights, traffic signals, sidewalks, landscaping, etc.,
on State highways with said VILLAGE which by law and /or agreement come under the jurisdiction and
control of the Department of Transportation of the State of Illinois, hereinafter referred to as
"DEPARTMENT "; and
WHEREAS, an individual working permit must be obtained from the DEPARTMENT prior to any
of the aforesaid installations being constructed either by the VILLAGE or by a private person or firm under
contract and supervision of the VILLAGE.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the VILLAGE hereby pledges its good faith that all work shall be performed in
accordance with the conditions of the permit to be granted by the DEPARTMENT, and to hold the State of
Illinois harmless on account of any damages that may occur to persons or property during the prosecution
of such work, and assume all liability for damages to persons or property due to accidents or otherwise by
reason of the work which is to be performed under provisions of said permit.
Section 2: That all authorized officials of the VILLAGE are hereby instructed and authorized to sign
said working permit on behalf of the VILLAGE.
Section 3: This resolution shall be in full force and effect from and after its passage and approval
as provided by law.
