RECOMMENDED MOTION: I move that the Village Board award a contract to the
lowest responsive and responsible bidder, James D. Fiala Paving Company, Bolingbrook,
Il., subject to staff review, for the 2011 Miscellaneous Paving Project based on the unit
prices on the attached bid tabulation, for an estimated total project price of $884,719.65.
Additionally, the Village Board adopts Resolution 2011- AG -EXI -R -1111, approving and
authorizing the execution of the 2011 Miscellaneous Paving Contract between the Village of
Oak Brook and James D. Fiala Paving Company.
Background/History:
Six sealed bids were received and opened on Tuesday, July 19, 2011. Bid Packages were picked
up by nine companies. Christopher B. Burke (our consulting engineer) recommends that we
award the contract to the lowest responsive and responsible bidder, James D. Fiala Paving
Company (see attached letter). The bid submitted by James D. Fiala Paving Company in the
amount of $884,719.65 is 10% less than the Engineer's estimate of $981,190.63.

2011 Misc. Paving Project
The Village has worked with James D. Fiala Paving Company for paving projects in 2011, 2004,
and 2000 and they have performed adequately.
Project work involves mostly deep patching, where necessary, followed by resurfacing on
Commerce Drive (Spring Road to just east of McDonald's Drive) and within Trinity Lakes
Subdivision (except Trinity Lane previously done in 2004 and St. Stephens Green to be done
several years later). Only a minor percentage of deep patching will be done on Kensington Road
and Kensington Court instead of doing a maintenance slurry seal called micro - surfacing as
originally programmed. Finally, the entire drainage and concrete at the Trinity Lakes entrance at
31St Street will be redone with a significant stone sewer extension going west along 31 st Street.
Work should commence in mid August and be completed by mid October.
Recommendation:
That the Village Board award a contract to the lowest responsive and responsible bidder, James
D. Fiala Paving Company, Bolingbrook, Il., subject to staff review, for the 2011 Miscellaneous
Paving Project based on the unit prices on the attached bid tabulation, for an estimated total
project price of $884,719.65. Additionally, the Village Board adopts Resolution 2011- AG -EXl-
R -1111, approving and authorizing the execution of the 2011 Miscellaneous Paving Contract

Christopher B. Burke Engineering, Ltd. (CBBEL) has reviewed the six (6) bids that were
opened and read publicly on Tuesday, July 19, 2011 at the Village Hall (bid tabulation
attached). The apparent low bidder is James D. Fiala Paving Co., Inc. with an as read bid
amount of $884,719.65.
CBBEL has reviewed the proposal documents and verified that James D. Fiala Paving Co.,
Inc. is indeed the low bidder. CBBEL recommends award of the 2011 Miscellaneous Paving
Project to:

RESOLUTION 2011 -AG-EX1 -R-1 111
A RESOLUTION APPROVING AND AUTHORIZING THE EXECUTION
OF AN AGREEMENT FOR THE VILLAGE'S 2011 MISCELLANEOUS PAVING PROJECT
BY AND BETWEEN THE VILLAGE OF OAK BROOK AND JAMES D. FIALA PAVING COMPANY
WHEREAS, the Village and the James D. Fiala Paving Company ( "Fiala ") desire to execute an
agreement regarding the Village's 2011 Miscellaneous Paving Project ( "Project "), which concerns the
performance of various paving projects within the Village ( "Agreement "); and
WHEREAS, the President and Board of Trustees have determined that it is in the best interests of
the Village to enter into the Agreement in a final form approved by the Village Manager and the Village
Attorney;
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part
of, this Resolution as the findings of the President and Board of Trustees of the Village of Oak Brook.
Section 2: Approval of the Agreement. The President and Board of Trustees hereby
approve the Agreement by and between the Village and Fiala in a form acceptable to the Village Manager
and the Village Attorney.
Section 3: Authorization and Execution of the Agreement. The Village President and Village
Clerk shall be, and hereby are, authorized to execute the final Agreement on behalf of the Village after
review and approval of the final form of the Agreement by the Village Manager and the Village Attorney.
Section 4: Effective Date. This Resolution shall be in full force and effect upon passage and
approval in the manner provided by law.
