Back ground /History: Attached is a resolution approving an update to the Village of Oak Brook's liquor license code. It limits the review of the decision of the local liquor control commissioner to the official record of the proceedings. Recommendation: That the Village Board approve Resolution R -1115 related to the liquor license code. hr— Last saved by DEFAULT C:\Documents and Settings \dbettin\My Documents\AG -Rsltn liquor code 7 -26 -1 Ldoc Last printed 7/2212011 11:35 AM RESOLUTION 2011- LC -AL -R -1115 A RESOLUTION LIMITING REVIEW UNDER 235 ILCS 517 -9 TO THE OFFICIAL RECORD WHEREAS, Section 7 -9 of the Liquor Control Act of 1934 (the "Acf') authorizes a municipality to limit any review of the suspension, revocation, denial, or denial of a renewal of a liquor license to the official record of the proceedings of the local liquor control commissioner; and WHEREAS, the President and Board of Trustees have determined that it is in the best interests of the Village to limit any review of the suspension, revocation, denial, or denial of a renewal of a liquor license to the official record of the proceedings of the local liquor control commissioner as authorized by the Act. NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part of, this Resolution as the findings of the President and Board of Trustees of the Village of Oak Brook. Section 2: Limitation of Aooeals to the Official Record. A full and complete record must be made of all proceedings of the Local Liquor Control Commissioner regarding the suspension, revocation, denial, or denial of a renewal of a liquor license. All appeals of a decision of the Local Liquor Control Commissioner shall be taken to the Illinois Liquor Control Commission in the manner provided by law. All appeals to the Illinois Liquor Control Commission shall be limited to a review of the official record of the proceedings of the Local Liquor Control Commissioner. Section 3: Effective Date.
