This amount has been included in Program 421 for Heritage Center improvements in 2013. RECOMMENDED MOTION: I move that the Village Board authorize execution of a change to the contract currently held by Restoric Inc. for the Heritage Center Window Restoration Project at a cost not to exceed $27,000. Background/History: This project is currently underway. The project consists of reconstruction of windows in the Heritage Center. The original contract was let for $78,000 and all of the work included in the contract is being accomplished for that price. The bid specifications did not include storm windows. Since the Heritage Center is being used to display light sensitive materials, it would be advisable to protect them with an ultraviolet (UV) light blocking window system. Storm windows will provide this barrier. Storm windows will also reduce the energy consumption of the building and provide a more controlled and comfortable environment. These funds were originally programmed for painting of exterior portions of the Heritage Center. Staff and the Historical Society have agreed that the installation of storm windows is a higher priority. Recommendation: That the Board approves the motion authorizing execution of a change order to the contract held by Restoric Inc. for the Heritage Center Window Restoration Project at a cost not to exceed $27,000. om RESOLUTION 2013 - BSLMUSEUM- ENG- CHGORD -R -1293 A RESOLUTION AUTHORIZING A CHANGE ORDER FOR THE HERITAGE CENTER WINDOW RESTORATION PROJECT WHEREAS, Pursuant to Resolution 2013 - BSLMUSEUM - CNTRCT -EX -R -1258, the Village approved an agreement ( "Agreement') with Restoric, LLC of Chicago, Illinois ( "Restoric'), for Restoric to replace the windows and a portion of the exterior trim ( "Restoration Project') on the Oak Brook Heritage Center ( "Heritage Center'); and WHEREAS, at the time the Village awarded the Agreement to Restoric, the Village did not realize that the windows provided by Restoric would not provide adequate ultraviolet light protection for the light sensitive materials maintained in the Heritage Center; and WHEREAS, installing storm windows at the Heritage Center will reduce the energy consumed by the Heritage Center; and WHEREAS, the Village staff recommends entering into the change order to the Agreement attached hereto as Exhibit A for an amount not to exceed $27,000; and WHEREAS, the President and the Village Board find that the circumstances requiring a change to the Agreement were not reasonably foreseeable at the time the Restoration Project was bid and the Change Order will be in the best interest of the Village and authorized by law; and NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part of, this Resolution as the findings of the President and Board of Trustees of the Village of Oak Brook. Section 2: Approval of the Change Order. The Village President and Board of Trustees hereby approve the Change Order in substantially the same form as attached as Exhibit A, and in final form approved by the Village Attorney and Village Manager. Section 3: Execution of the Change Order. The Village President and the Village Clerk shall be, and are hereby, authorized to execute the final Change Order on behalf of the Village. Section 4: Determination. This Resolution shall constitute the written determination required by Section 33E -9 of Article 33E of the Criminal Code of 1961. Section 5: Effective Date. This Resolution shall be in full force and effect from and after its passage by two- thirds of the Trustees and its approval in the manner provided by law.
