R-691 - 05/27/1997 - AGREEMENTS - Resolutions Supporting Documents rr i 0.3USOLUTION97-AG-EXI-R-691 RESOLUTION RES.97-AG-=�1- AUTHORIZING THE EXECUTION OF AGREEMENT FOR R-691 PRO IalON OF TRAFFIC AND MUNICIPAL AGREEMENT :V3 PROSEGUTIOX VF ORDINANCE VIOLATIONS: TRAFFIC AND MUNICIPAL The resolution authorizes execution of a new agreement with Linda ORDINANCE Pieczynski to prosecute traffic and municipal ordinance violations. VIOLATIONS -'ITH The Village initially retained Ms. Pieczynski as of March 1, 1995. LINDA PIECZ�.SSKI The arrangement was renewed,%ith a moderate adjustrlent in rates, in 1996. The new agreement would run through April 30, 1999. The new agreement reflects a$2 increase in the charge per court session (from$128 to$130)and a$5 per hour increase (from$90 to$95)for consultation,research and trial preparation,and any field court session exceeding three hours in length. Although the amount of such service can vary widely,the Village uses an average of about 3 hours per month. Ms. Pieczynski has been received extremely well by the Village's police officers. In a survey of police personnel completed during the first year of her service to the Village,it was the unanimous opinion of the respondents that her overall performance as Village prosecutor had been excellent. In addition,she has been complimented consistently on the information,guidance and training she has provided above and beyond her work in court. There has been no sign of any change in the opinions held by the Village's personnel. Financially-, the results have been as anticipated. The incremental cost of Ms. Pieczynski's services (over and above what was previously being paid to the State's Attorney's office) have been more than offset by new revenue resulting from her work. The State's Attorney no longer provides prosecutorial services for local ordinance matters. Motion by Trustee Kenny, seconded by Trustee Bartecki, to pass Resolution 97-AG-EXI-R-691,"Resolution Authorizing The Execution Of Agreement For Prosecution Of Traffic And Municipal Ordinance Violations", as presented and waive the full reading thereof, and authorize the Village President and Clerk to execute a new agreement with Linda S. Pieczynski to prosecute traffic and municipal ordinance violations on behalf of the Village. Trustee Shumate requested the contract be limited to one year with a thirty (30) day notice of cancellation. Fie cited the Village Manager's and Village Attorney's contracts are for ane near, and this would set a p,-redent. Trustee Kenny noted the polo contract was awarded for more than one year and suggested this was a fairly routine service. Iv-,.orola is the sole source for this type of equipment,and has recently released a new model MDT(,"520)which staff feels is more functional. However, the Model#520 is more costly than the earlier model(budget reflected a lower unit cost which would have permitted the Village to purchase three replacement MDT's). It is a better purchasing decision to buy the newer model instead of buying older technology (which is being phased out). As a result of the higher cost, staff would replace two MDT's instead of the three originally budgeted. The two replacement MDT's will be placed in patrol vehicles,with one of the older MDT's shifted to a CSO vehicle (both will then .cave MDT communications),and the other one declared surplus at a future meeting (by Ordinance). In addition to the cost of the MDT's,the Village will incur expenses of approximately SL280(S640 per vehicle) for installation,mounts, and programming- I In summary.the total estimated cost for the replacement of two MDT's is S 1-1,880 (S l 3.600 for the units plus $1,280 for related costs). Funds in the amount of S 16.800 are budgeted in the Police iField Services Program (0 1-620 1) fer this purchase. ! Motion by Trustee Shumate, seconded by Trustee McInerney, to :naive bidding due to sole source,and authorize the issuance of a purchase order to Motorola, Inc.. Schaumburg, for two Mobile Data Terminals (NIDT's) Model 1520, at a unit price of S6.800, for a total price of$11.600. ROLL CALL VOTE: Ayes: 6 - Trustees Bartecki, Caleel.
