R-715 - 12/08/1998 - SUBDIVISIONS- FINAL PLAT - Resolutions RESOLUTION 98-SD-FP-EX1-R-715 A RESOLUTION AMENDING 9,5-SD-R-658 TO CHANGE THE NAME OF A SUBDIVISION FROM JOHN R.MITCHELL SUBDIVISION TO MICHAEL E.SCHEID SUBDIVISION AND APPROVING AN AMENDED FINAL PLAT i 0601 Adams Road,Oak Brook,IL 60523) WHEREAS, Resolution 95-SD-R-658 was approved on November 28, 1995 for the John R. Mitchell Subdivision, a two-lot subdivision located at 3601 Adams Road, Oak Brook, Illinois; and WHEREAS, Michael E. Scheid has assumed the Mitchell Subdivision Final Plat application and acquired interest in all of the engineering and plat plans heretofore developed; and WHEREAS, Michael E. Scheid wishes to change the name of the subdivision to the Michael E. Scheid Subdivision and to adjust the lot lines between the two lots to a minor extent; and WHEREAS,the Village President and Board of Tiustees considered the recommendati_°.of staff and concur with the same, subject to certain conditions; NOW,THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the Michael E. Scheid Subdivision Final Plat consisting of two sheets and prepared by Bollinger, Lach &Associates, Inc., dated as last revised November 1, 1998, be and is hereby approved subject to the conditions enumerated in Section 2 of this Resolution. Section 2i That the approval of the Final Plat of Michael E. Scheid Subdivision as given in Sectior. 1 hereof be and is hereby expressly made subject to he following conditions: (a) That the requirements for sidewalks, curb and gutters, street lights and street trees be waived. (b) That the final plat and final engineering be revised and approved by the Village Engineer. (c) That all plat requirements be completed within a period of six months from the passage of this resolution. Section 3: That this Resolution is limited and restricted to the property located at 3601 Adams Road, Oak Brook, Illinois,which property is legally described in Exhibit A attached. Illinois 6052 k Name &Address of Recipient j of Consideration (when applicable): N/A G/L Account#to be Charged _ -— ORDINANCE 95-ZO-V-Du-SWM+FP-S-$33 AN ORDINANCE GRANTING A VARIANCE FROM THE DU PAGE COUNTY COUNTYWIDE STORMWATER AND FLOOD PLAIN ORDINANCE (3601 ADAMS ROAD) WHEREAS, as a result of the flooding that occurred in DuPage County during the mid to late 19f,0's, DuPage County and all DuPage municipalities created the DuPace County Countywide Stormwater and Flood Plain Ordinance (the "Ordinance,,) ; and WHEREAS, the Ordinance was adopted by DuPace County in 1991 and subsequently by the Village of Oak Brook, as a full waiver c^mmuni.ty; and WHEREAS, as a full waiver community, the Village has the responsibility for administration of the Ordinance within its corporate limits; and WHEREAS, an application has been filed requesting a variance from the provisions of Article 9 of the DuPage County Countywide Stormwater and Flood Plain Ordinance, to exempt the applicant's property from the requirements for stormwater detention; and WHEREAS, 'a public hearing on such application has been conducted on August 1, 1995 by the Zoning Board of Appeals of the Village sitting as the Village's Oversight Committee to oversee the implementation and enforcement of the Ordinance, pursuant to due and appropriate legal notice; and WHEREAS, ;- its report dated August 3, 1995, the Zoning Board of Appeals made its findings and recommendation to approve the petition; the applicant's professional engineer testified that in his opinion, the omission of detention on this property would not increase flood risk for downstream properties to any appreciable extent; rather the abundance of tree=_ on the property provides natural storace t`.rouch absorution rather than run off; and WHEREAS, the requested variance allows the preservation of the forested character of the subject property and strict enforcement of the DuPage Crdinnance will create an undue hardship on the owner and would, according to t_^.e applicant's professional engineer, require the destruction of 1.4 acres of .sees as required by the Ordinance; and WHEREAS, the subject property is unique, as it is steeply sloped, highly wooded, and lies near Salt Creek, with a tributary of the creek running through it.
