R-1142 - 11/08/2011 - AGREEMENT - Resolutions Supporting DocumentsITEM 6.F.2) AGENDA ITEM Regular Board of Trustees Meeting of November 8, 2011 SUBJECT: Professional Services Agreement with Kluber, Inc. for an electrical study of the Butler Government Center FROM: Mike Hullihan, P.E., Village Engineer BUDGET SOURCE/BUDGET IMPACT: $13,860 from Account 421 -90400 RECOMMENDED MOTION: I move that the Village Board authorize the execution of a professional services agreement with IGuber, Inc. for an electrical study of the Butler Government Center in an amount not to exceed $13,860 subject to legal review. Backpround/13istorv: When the Butler Government Center (BGC) was expanded in 2001, several modifications to the electrical system were performed. The resulting configuration has several deficiencies including: • Resistive heat circuits are not segregated resulting in unnecessary electrical billing for non - resistive electrical consumption • Backup generator does not power all necessary emergency functions • Power to computer server room is insufficient The recent decision to centralize dispatch functions off -site adds another power issue. If a new 24 hour, non - emergency, Police call answering function is added in a location away from the current communications center, there is no backup power available. A study of the BGC power system was suggested approximately 5 years ago. While the former Public Works Director interviewed firms and received an unpriced work proposal from Kluber, Inc. due to budget constraints the study never went forward. Kluber was probably chosen to conduct the study because of their involvement in trying to identify the electrical deficiencies at the BGC around the time of construction. Arf\ Current Effort: As part of the ongoing efforts to increase energy efficiency at the BGC and the longstanding electrical distribution issues outlined above, an energy study was programmed for the 2011 budget and $29,000 was budgeted. The study had to be delayed until the decision on dispatch consolidation was complete. Now we face a short deadline (June 2012) for conducting a study identifying alternatives, selecting which parts of the system have to be modified, preparing bid documents, and executing/completing a construction contract. Illinois Code (50 ILCS 510/8) provides for waiving the normal Quality Based Selection process for Architectural/Engineering services for agreement of less than $25,000. Due to the time constraints, Kluber's familiarity with the BGC and their proposed fee of $13,860, I recommend waiving the requirement for a selection board and executing an agreement with Kluber, Inc. for the BGC electrical study. Recommendation: That the Board authorizes execution of a professional services agreement with Kluber, Inc. RESOLUTION 2011- AG -EX1 -R -1142 A RESOLUTION APPROVING AND AUTHORIZING THE EXECUTION OF A PROFESSIONAL SERVICES AGREEMENT BY AND BETWEEN THE VILLAGE OF OAK BROOK AND KLUBER, INC. TO PROVIDE FOR AN ELECTRICAL STUDY OF BUTLER GOVERNMENT CENTER WHEREAS, the Village desires to increase the efficiency of the electricity systems serving the Butler Government Center ( "BGC ") in order to facilitate the operations of the BGC and make the distribution of electricity within the BGC more effective and efficient; and WHEREAS, Village staff has identified several deficiencies in the configuration of the existing BGC electrical system, and desires to retain an engineer to examine the existing electrical system and identify recommended changes to increase the efficiency and performance of that system (the "Project"); and WHEREAS, pursuant to Section 1 -7.6 of the Village Code, contracts for the services of architects, engineers, and land surveyors shall not be subject to the competitive bidding /proposal requirements of Chapter 1 of the Village Code, and shall be awarded in accordance with the provisions of the Local Government Professional Services Selection Act, 50 ILCS 510/1 et seq., unless the total cost of the services provided is less than $25,000; and WHEREAS, Village staff has obtained a proposal from Kluber, Inc. Architects and Engineers ( "Kluber") to complete the Project for a total fee of $13,860.00, a copy of which proposal is attached as Exhibit A ( "Proposal "); and WHEREAS, Village staff have reviewed the Proposal and recommend that the Village Board approve the Proposal and authorize the execution of a Professional Services Agreement by and between the Village and Kluber for the completion of the Project; and WHEREAS, the President and Board of Trustees have determined that it is in the best interests of the Village to enter into the Agreement in a final form as approved by the Village Attorney; NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part of, this Resolution as the findings of the President and Board of Trustees of the Village of Oak Brook. Section 2: Approval of the Agreement. The President and Board of Trustees hereby approve the Agreement by and between the Village and Kluber a final form acceptable to the Village Manager and the Village Attorney to complete the Project for a cost not to exceed $25,000. Section 3: Authorization and Execution of the Agreement. The Village President and Village Clerk shall be, and hereby are, authorized to execute the final Agreement on behalf of the Village. Section 4: Effective Date. This Resolution shall be in full force and effect upon passage and approval in the manner provided by law. Ayes: APPROVED THIS 8" day of November, 2011 Gopal G.
