RECOMMENDED MOTION: I move to approve Ordinance G-1070 which amends Title 1, Chapter
5D of the Municipal Code relative to the Appointment, Qualifications and Position Duties of the
Village Engineer.
Background/History:
At the present tirne, the Village Engineer is a Department Director position appointed by the Village
President by and with the consent of the Village Board of Trustees.
However with the approved consolidation of Engineering and Community Development into the new
Development Services Department as part of the 2016 Budget, the Village Engineer position has been
modified with respect to its duties and responsibilities within the new Department structure.
Accordingly, consistent with that consolidation, Staff is recommending an amendment to Title 1
Chapter 5D of the Municipal Code relative to the Appointment, Qualifications and Position Duties for
the Village Engineer position. These recommended changes would;
a. Change the appointment of the Village Engineer to the Village Manager (from the Village
President), and
b. Change the supervision of the Village Engineer to the Community Development Director(from
the Village Manager).

AN ORDINANCE AMENDING ARTICLE D OF CHAPTER 5 OF TITLE 1
OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK, ILLINOIS
REGARDING THE APPOINTMENT OF THE VILLAGE ENGINEER
WHEREAS, Article D of Chapter 5 of Title 1 of the "Village Code of the Village of Oak Brook,
Illinois" ("Village Code's currently provides that: (i) the Village Engineer is appointed by the Village
President with the consent of the Village Board; and (ii) heads the Village Engineering Department; and
WHEREAS, the Village Board has determined that it would be more efficient: (i) for the Village
Engineer to be appointed by the Village Manager; (ii) for the Village Engineer to report to the Director of
Community Development; and (iii) to do away with the Engineering Department; and
WHEREAS, the Village President and Board of Trustees have determined that it is in the best
interest of the Village and its residents to amend Article D of Chapter 5 of Title 1 of the Village Code
pursuant to this Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part
of, this Ordinance as the findings of the President and Board of Trustees of the Village of Oak Brook.
Section 2: Amendment to Title 1, Chapter 5, Article D of the Village Code. Article D, entitled
"Village Engineer," of Chapter 5, entitled "Appointed Village Officials," of Title 1, entitled "Administration,"
of the Village Code shall be amended further, and shall read as follows:
1-5D-1: OFFICE CREATED; APPOINTMENT:
There is hereby created and established the office of Village Engineer who shall be
appointed by the Village President, by and with the ooncen+ of the Beard of Trllc+ee-
Village Manager.
1-5D-2: QUALIFICATIONS:
No person shall be appointed to the office of Village Engineer unless such person is
registered under the provisions of the Illinois Professional Engineer Practice Act.
1-5D-3: POSITION AND DUTIES:
The Village Engineer is an exempt position, reporting directly to the Director of
Community Development and is under the authority of the Village Manager. Ihg
Village Engineer is responsible for all duties and activities assigned to the Village
Engineer and the Stormwater Administrator in the Village Code and such other
duties and activities assigned by the Director of Community Development and

Section 3: Severability. If any provision of this Ordinance or part thereof is held invalid by a
court of competent jurisdiction, the remaining provisions of this Ordinance shall remain in full force and

effect, and shall be interpreted, applied, and enforced so as to achieve, as near as may be, the purpose
and intent of this Ordinance to the greatest extent permitted by applicable law.
Section 4: Effective Date. This Ordinance shall be in full force and effect from and after its
passage, approval, and publication in the manner provided by law.
